October term 1868 Chancery Court Wilson County Texas: After the death of Josiah Owen there was a complaint against his children as to the distribution of the property filed in the Chancery Court of Lebanon, Wilson County, Tennessee by John A Brogan and his wife Jemima of Rutland Co. Tenn. the former widow and second wife of Josiah Owen.Dated the Second Monday in Apri 1867. She apparently had been married to him for 4 or 5 years at the time of his death. Concerning land on Sanders Fork where he resided at the time of his death and a number of slaves. Children listed in complaint are Pleasant T Hubbard agent of Josiah Owen decd. Anthony Owen, Fountain Owen decd, Christopher Owen, M. Frances, James, Wm. Saml, Gideon, Eizabeth, Amanda, Monroe, S C Odem and wife Elizabeth, James Owen decd. James Owen was the administrator of his affairs as Josiah died intestate. However he was in bad health at the time and afterwards civil law was suspended on account fo the war and said administrator died before civil law was restored. The woman Edy was old and worthless and permitted to choose her home and go where she pleased. The boy Jery did not belong to the estate of Josiah Owen. He only had a life estate in said boy and then he belonged to the brothers and sisters of James Owen dec. The said James in his lifetime was the owner of said boy and prior to his death he gave siad boy to his father Josiah Owen and his mother rinnten owen during their lives and then to his brothers and sisters. which gift was evidenced by the will of James Owen which was taken charge of by the said Josiah but never offered by him for probate. The original will has been lost or destroyed by fire in the hands of Anthony Owen which was caused by an accidental burning of his home. Jemima came to the marriage with her own stock horses, cattle, household and kitchen furniture which she took with her as well as an agreeded upon amount by the family to keep peace. She was satisfied with teh amount and the defendents believe she would still be satisfied if left to her own sense of right and justice without any outside influence from a subsequent husband. The negroe Nelso was taken possession of by S C Odom and wife in Sep 1860 and retained by them until he was free. The other negroes have been disposed of as stated. Fountain Owen took the boy Jerry and he has been since made free. The land was set apart as follows 130 acres was set apart for the minors and the ballance to Christopher Owen. The rents of the piece have been worth but little owing to the disturbed condition of the county. James Owen has been dead over six months and had no administrator. It was decreed that the defendents wer eto make a sum of $500. with interest from Oct 16, 1867 to John A Brogan and his wife Jemima.The land was sold at public auction at which time John A Brogan and His wife Jemima purchased it for $705.00
