This is abstracted by Jill L. Huter and once again you will see that James Abernathy is the Jurat which means he certified that the will was accurate. I don't know why everybody keeps listing James Abernathy as a witness when he is plainly the jurat and if he wasn't a member of the family I don't know why they didn't get one of the children to certify the will and if you see the original copy you will see that James Abernathy signed his own name. If you click the Robert Abernathy ca 1800 wife Sarah will next you will see that James Abernathy and John Rockett are witnesses - the son and son-in-law of James Abernathy the Jurat in the previous 1772 Robert Abernathy will. James Abernathy the Jurat drowned in 1785 ( according to a lot of people ) so was not on his father's will ( Robert Abernathy ca 1800 will - wife Sarah Abernathy ). And also the Granville, NC, tax list of 1757 in message #3167 on this forum which you have to ignore if you don't think that James is the son of the Robert Abernathy on the 1757 Granville tax list. I guess you could say he was maybe a cousin or something which there is no evidence of that I am aware of. I am just trying to get my family tree as accurate as I can with what information is available and for the next genealogist that comes along in my family. Maybe next year of 50 years from now - who knows. I am sure that you are trying to get your family tree as accurate as you can but I am not sure of exactly who your Abernathy ancestors are except I think you are from Miles and Ursula which I know a little about because my mother is descended from Ursula's brother Josiah. Jill thanks for at least asking about James Abernathy and why I think he is the son of Robert and Sarah Abernathy. In most cases being on a tax list like the 1757 Granville with no other known records would be as good as gold in the vast majority of family trees. Like you I am trying to get my family tree as accurate as possible and I believe that I have James Abernathy and his wife Elizabeth Cox in their right places. Right now everyone is free to do their own family tree however they wish and that is what I am going to do. You seem really nice Jill and I would be happy to help you in any way I can. If you are wondering why I post some of these records it is because I am going to use them on my Roots Web family tree. I have one but it is not close to being finished.
