Nancy Elizabeth (Betty) Ayers (JUL1894-15MAR1912)was a daughter of Mary Lydia Tate and Alexander Davidson Ayers.Her mother died giving birth to her and her father remarried Annie Guynn in 1903.Alexander was a son of James J. and Elizabeth Ayers.
Her brother, William Davidson Ayers and his wife Verina were in the courtroom that day.Court testimony shows that he was there as an armed deputy though it may have been an informal deputization if that's true because I have not found a record of his employment as such.
The trial testimony of Floyd Allen shows Betty was a witness though it is not clear what type she was;Judge Bolen said she was a defense witness while Dexter Goad said she was a prosecution witness. Oldtimers say she lived on Floyd's land and was a character witness. However, some researchers say she was there as a witness for another trial.I have found no record of her being called for any other trials for that session of court.
She was most likely shot by one of the deputies or possibly William Foster.She most definitely was not shot by Floyd Allen as was claimed.She knew she was shot as she replied to a statement by her sister-in-law that she was "only scared" with "No, I am killed."So, she knew she was shot.However she went home without medical attention and died the next morning.
