Regardless, Seabury and Kerlin's ommission of not contacting the Balli's on their share of the royalty is fraud. The Balli's have a vested right in perpetuity on the mineral rights. Who took them away, Texas courts, not likely, they have no jurisdiction. In the last laws issued by Spain the NOVINISIMA RECOPILACION DE LAS INDIAS, Spain released its royal patimony to the land owners, including the Indians; likewise if you purchased a land grant, the fruits were yours, and had to pay 1/5 of the tax to the King. The laws that ruled in this new world were the RECOPILACION DE LAS INDIAS, read the wording on the original surveys. Texas can always refer back to LAS SIETE PARTIDAS, the original Spanish law, but we should adhere to what is in the surveys.
