John Soverns Sr and Jr, Mary Soverns, Robert Falls POA to Azariah Ayers 1814

Know all men by these present that we John Soverns, SR and John Soverns, JR and Robert Falls of Gibson County, and Indiana Territory, have nominated Constitutence once appointed and by these present, do nominate Constitute and appoint Azariah Ayers of the same County and Territory true and lawful attorney in fact for the following purpose to wit “ Whereas John Hume in and by his last will and testament made the following devise and bequest Viz. is my desire that my Executors herein after named, cause to be made the sum of two hundred pounds current money out of my personal estate and debts due me which is to be equally divided between the children of Mary Soverns” and whereas the said Mary Soverns is now the wife of the said John Soverns, SR and is one of the daughters of the said John Hume and as such is intitled to a share and distribution ofthe surplus of his estate not disposed of by his will and whereas the same Robert Falls intermarried with Anne Soverns, one of the children of the same Mary Soverns and thereby became entitle to one fifth of the two hundred pounds to witthe sum of forty pounds and having received part thereof sold the residue to John Soverns Jr. and whereas the said John Soverns Jr. , Ebenezer Soverns, Mary Soverns and Hannah Soverns are also children of the said Mary Soverns and the said Ebenezer, Mary, andHannah being indents the said John soverns, Jr. was appointed guardian to them by the court of common pleas of Knox County the Territory of Indianaat their November term in the year one thousand eight hundred and six as by the certificate of Robert Buntin Esquire clerk of the said court here.
Unto annexed under the seal of his office it fully and legally appears that now be in knows that I, the said John Soverns, SR, husband to the said Mary Soverns, daughter to the said John Hume, Dec’d do hereby authorize and empower the said Ayers to sue for recover and receive all monies or property coming to me from the estate of the said Hume in right of my wife as fully as can be by word expressed and in my name to make sign seal and deliver all such receipts releases deeds or acquitances as may be necessary in the promise and I the said Robert Falls do authorize and empower the said Ayers to ask, demand, and sue for recover and receive all all and every balance and ballansor residue due and coming to me from the estate of the said John Hume in right of my said wife Ann, one of the children of the said Mary Soverns, and account with any pay such balance or balances to the said John Soverns, JR to in the premises.And I, the Said John Soverns, JRdo in my own right and as guardianto my wards, Ebenezer Soverns, Mary Soverns, and Hannah Soverns, children of the said Mary Soverns and legatees of the said John Hume, Dec’d do authorize and empower the said Ayers to ask, demand sue for and recover and receive all monies or property coming from the estate of the said John Hume, dec’d, in my own right and in right of my father, John Soverns, Senior in right of the said Robert Fallsand in right of my said wards, Ebenezer Soverns,Mary Soverns and Hannah Soverns and to sign and execute and deliver all such receipts, releases,deeds, discharges, and acquaintneces as may be necessary in the premises hereby giving and grantingour said attorney our full and whole power and authority in the premain as fully as words can be expressed, and upon settlement by our main attorney with Thomas Sturgeon the executor of the said John Hume, dec’d the following credits are to be allowedby our said attorney to wit “forty pounds paid John Soverns, JR,April 6, 1806, also a receipt of the same date given by John Soverns, JRfor 18 pounds given to Robert Falls in full as one of his share as one of the legatees of the said Hume,and also the sum offifty four pounds received by the said Ayers March 29, 1811 by order of the said John Soverns, JR,and we empower our said attorney to appoint and attorney or attorneys under him for the purpose of the aforesaid and his or their authority at pleasure to revoke and we do and will by thesepresents ratify and confirm whatsoever our attorney or his substitute or substitutes shall do or cause to be done in the premises.In witness thereofwe have hereunto set our hand and seal this 27th day of May 1814.

This day John Soverns, senr, Robert Falls and John SOverns, JR appeared before me a Justice of the Peace in and for Gibson County in the Indiana Territory and the said John, the senior, in right of his wife Mary Soverns, the said Falls in the right of his wife Ann, andthe said John, the younger, in his own right and as guardian to his wards Ebenexer, Mary and Hannahauthorized , acknowledged and delivered the forgoing power of attorneyas and for their voluntaryact and deed.Given under my hand and seal this 27th day of May 1814.
