Thomas Kirtley Senior left a will in Madison Co., VA that was written 6 Sept. 1798 and probated 24 Jan. 1799 [Madison Co., VA Wills 1:203-5.]In it he mentions his "three youngest sons" James, Jonathan and Joseph.Joseph received several Negroes along with joint ownership of 340 acres where father Thomas lived. Thomas gave this land jointly to his sons Thomas, James, Jonathan and Joseph. The Madison Co., VA Land Tax Books record this tract through 1807 as 344 acres belonging to the Thomas Kirtley Estate. The index to the Madison Co. deeds has two entries dated 27 Aug. 1807 that perhaps are related to the sale of this land. The index has Dorothy Kirtley &c to Thomas Graves Jr. and Joseph Kirtley &c to Thomas Graves Jr., both in Madison Co., VA Deeds 4:358. You might want to check this deed. Often the wives sign and release their dower rights. Joseph did not marry Elizabeth Sims until 1810 so if this is your ancestor there should be no wife for him when he signs, unless this was a second marriage.
