In the Name of God Amen, I Jacob Levy of Frederick Town in Frederick County in the state of Maryland being sick and weak in body but of sound and disposing mind memory and understanding considering the certainty of Death and the uncertainty of the time thereof, and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please god to call me hence do therefore make and Publish this my last will and Testament in manner and form following: That is to say First and principally I commit my soul into the hands of Almighty god and my body to the earth to be decently buried at their discretion of my Executor herein after named and after all my Just Debts and funeral charges are paid I give and bequeath unto my four children Rebeccah Levy, Elizabeth Levy, Sophia Levy and David Levy all my Property Real Personal and mixed to be Equally divided among them share and share alike and if any one or more of them die without legal Issue then it is my will that her or his Share be equally divided among the Survivors.
It is my will and desire that my Executor sell all my personal estate as soon after my Death as may be convenient to him and after Pay my Debts and funeral charges that he Divide the remainder of the Money among my four children afore named equally share and share alike to be paid to them when my Executor shall think they stand in need of it or a part of it. This also my and will and desire that any Executor shall sell my real property in Frederick Town county and state aforesaid as well as my part of an undivided Tract or parcel of land lying in Canhawa [Kanawha? Now located in W. Va.]County in the State of Virginia which was Deeded to my father David Levy by Charles Shoemaker and when sold it is my desire and direction that my Executor put the money arising from the sale of my real property at Interest in safe hands. It is my desire that my Executor pay to each of them their respective Share and not before.
It is my wish and desire that my Executor sell my property lying in Frederick Town and Virginia Land to the best advantage for my children he taking his own time to make sale of it so as to be ready to pay my children as within directed. It is also my will and desire that my Executor join in a petition [?] deed with my Brothers and sister so as to complete a division of the aforementioned Virginia Land so soon as he and they may think proper.
And Lastly I do hereby constitute and appoint my earthly friend Henry Baer to be my sole Executor of this my last will and Testament revoking and annulling all former wills by me heretofore made ratifying and confirming this and none other to be my last will and Testament. Frederick County to wit on the 23rd day of October 1809 then came Henry Baer and made Oath on the Holy Ev[?]angels of Almighty God that the foregoing Instrument of writing is the true whole will and Testament of Jacob Levy late of Frederick County - Deceased that hath come to his hands and possession and that he doth not know of any other.
