Jeremiah Lochary Land - 1725
I was wrong about the 1736 date.The date of this purchase deed is March 22, 1725.I found it in the purchasing index in the Delaware Archives at Dover, Delaware.I have not been able to get back to Dover, Delaware to find out when he sold this land which is a separate sold index. It is the best I could translate it but still very, very long so here goes:
This Indenture made the twenty second day of march in the year of our lord one thousand seven hundred twenty and five being ofthirteen? year of the reign of King George over Great Britain be between William McMahan of the County of New Castle in the territories of the county of Chester in the provence of Pennsylvania yeoman and Jennet is wife ofthe one pairt AND Jeremiah Lochary of the County of Chester in the provence of Pennsylvaniawfore?? yeoman ofthe other pairt.
Where as William Pen Esqr Proprietor of the ?? Provence and Territories by a certain pattanunder the hand and seal of the Province bearing date of twentythird day of October Anno-Domine 1701 for the consideration there in mentioned di grant and convey unto his daughter Latitia by here Kren name of Latitia Pen a certain tract of Land reputed or known by the name of the Mannor of Stennig. Situated on the North side of Brandewine Creek pairt there of in the lords county of New Castle and the other pairt there of in the county of Chester.Containing by computation fifteen thousand and five hundred acres.?? have to here the Leatitia her half and assigned for ever as by the ?? patent recorded in the ???? other at Philadelphia in Patent book A: Vol 2 page 404 and may more fully appear.And where as the ?? Latiaia has since inter-married with William Aubrey of London Merehart who by there letter of Attorney under there hand and seal duly??euted bearing Patent Eight day of February annoDomine 1713 reciting as herein as recited did constitute James Logan and Rees Thgomas of the ?? Province of Pennylvania Gentlemen were lawfully attourneys joyntly andseverally for them and in there names to bargan for and convey all and every or any lands tenements andllereditaments in the several(were in recited) indentures grants and patens and every or any of them mentioned or intended to be granted and conveyed with the appertaances of the first mentioned track of land there by recited including to any person or persons what some ever for the out most and best valon and price that can be gotton for the same. And for them and for there names to sign seal and execute such conveyance and conveyances of the lands??? the appertanances or any grant or granted have of to any purchases or purchasers as the cases of the like nature as or cases of the like nature are usually made by executed in the Provence as in ?? the of?? writing or letter of Attourney recorded in the enrollment office at Philadelphia in book D:3 Vol 5 page 79 as may more fulley appear.And were as by the certain indenture tripartitie bearing date of second day of June last past made or mentioned to be made lesveen of ?? William Aubrey and Latitia his wife of the first part, of Ms James logan and Reed Thomas of the second part and of Ms William McMahan of the third part.They of Ms William Aubrey and Latitia his wife by ???? attorneys of Ms James Logan and Reed Thomas for if consideration there in mentioned did grant and convey unto ?? Ms William McMahn thence certain pieces or parcels of land.Peti????? Dying as bine in the county of New Castle(being part of the Mannor) Containing in the whole nine hundred and sixty one acres and three quarters of one acre of land. Behold to him of Ms WilliamMcMahan his hears and assigns for ever. Under the yearly quit rent of one shilling sterling for each hundred acres payable to Ms William Aubrey and Latitia his wife and heirs of?? Latitia on the first day of March for ever as in ?? by the recited indenture Tripartite recorded in the rools office at New Castle in Book H (K?) page 58 and may be more fuller appear.
Now this indenture writtin??? That the Ms William McMahan and Jennet his wife for and in consideration of the sume of one hundred and eight pound of lawfull money of America to them in hand paid by Ms Jeremiah Lochary. At or before the sealing and delivery here of the receipt where of they doe hereby acknowledge and here of doe agree and for over discharge theMs Jeremiah Lochary his heirs and assigns by these presents have granted bargained for aliened enfe offered??? And confirmed by these giveferils???Doe grant bargain sell alsin enfeoff and confirm unto the Ms Jeremiah Lochary his heirs and assigns all that giaie?? Or parcel of land situated lying hold? Being in the county of New Castle being part of the nine hundred and Sixty one acres and three quarter of one acre of land.Beginning at a corner marked Hickory tree at a corner of Samuel Ruth's land.Thence south by the land of William Cox and Thomas Nichols one hundred and six? perches to a black oak thence eastby the land of Ms William Cox and the land of Thomas Holingworth one hundred and ninety eight perches to a grost then north thirty degrees easterly by the land of the Ms William McMachan Sixty One Perches to a post thence West by North by the Land of the Ms Samual Ruth one hundred and thirty eight perches to a dogwood tree thence north by the same land Seventy six perches to the post then west by the land of Samual ruth one hundred and ninety four perches to the place of beginning containing one hundred and eight acres together with all the meadows woods ways waters watercourses fishings howlings? Huntings rights liberties previledges here toamend and appertenances what so ever ????the land here by graned belonging or on any ?ise appertaing and the reversions and remainders resel issues and profite there of and also al the state right sitle and in?reet what some ever of them the Ms William McMachan and Jannet his wife of in or to the here by granted premises one ?en copies of all deed Evidences and writings concerning the same to had and made at the proper cost and charge of the Ms Jeremiah Lochary, his hears and assigned so if only proper use and betook? Ms William McMachan his hears and assigns and against Ms Jennet his wife and against all and every other person and persons what some ever lawfully claiming or to claim by from or under hime then or any of them shal be well warrant and for ever defend by thess presents. And the Ms William McMachan for him less? Ms Jennet his wife and for his heirs Executors and administrators doth covenant premise and grant to and with the paid Jeremiah Lochary his heirs and assignes by thess presents that he and Ms William McMachan and Jennet his wife and there heirs and all and every other person and person whom so ever having or lawfully claiming or that shall have or may at any time hereafter to have or claim any estual Right Title or Interest ofon or to the one hundred and eighty acres of land and promises hereby granted orang??
