Hello All, I found the following at MARYLAND STATE ARCHIVES on line. Could someone tell me, is this the Tobias Stansbury that was married to Honor Bowen?And he married a Mary 2nd? The following is full of information regarding this Tobias. Thanks for any help. Shirley
Assembly Proceedings, March 17-April 21, 1762. An Act to impower Mary Stansbury Widow and Administratrix with the Will annexed of Tobias Stansbury late of Baltimore County to Sell the Lands therein mentioned for the payment of the Debts of the Said Tobias Stansbury
Whereas Mary Stansbury Administratrix with the Will annexed of Tobias Stansbury late of Baltimore County deceased by her Humble Petition to this General Assembly hath set forth that the said Tobias Stansbury her Late Husband died leaving five Daughters and one Son an Infant now about three years Old of which Children she is Mother and Natural Guardian and that upon the Death of the Said Tobias Stansbury her late Husband she took out Letters of Administration and hath regularly Administred the Effects of the said Tobias Stansbury so far forth as they have come to her Possession or knowledge, Notwithstanding which they are severall Considerable Debts due from the said Tobias Stansbury still outstanding, and that the said Tobias Stansbury died seized of about five thousand Acres of Land lying in Baltimore and Frederick Counties the Sale of part of which she apprehends will raise Money Sufficient to Satisfy the Residue of the Debts due from the said Tobias Stansbury and will thereby leave the other real Estate whereof the said Tobias Stansbury died Seized to come to the Possession of his Heirs or Devisees free from all Incumbrances. And Whereas a Committee appointed by the Lower House to examine into the Facts set forth in the said Petition have reported that it appears by an Account passed by the Deputy Commissary of Baltimore County and lodged in the rerogative Office that the said Mary Stansbury hath fully Administred her deceased Husbands Personal Estate and overpaid the same and that there still remains Several large sums of Money and Tobacco due from the said deceased on Bonds and otherwise. It is therefore prayed that it may be enacted. And be it Enacted by the right Honourable the Lord Proprietary by and with the Advice and Consent of his Lordship's Governor and the Upper and Lower Houses of As- sembly and the Authority of the same That the said Mary Stansbury shall be and is by Virtue of this Act impowered to Set up and expose to Sale at Publick Vendue to the Highest Bidder the following Tracts or Parcels of Land, that is to say the said Tobias Stansbury's Part of a Tract of Land called Fellfoot enlarged lying in Frederick County containing one thousand and Six Hundred Acres, also one other Tract of Land lying in the same County called Hallams Lookout containing two hundred and fifteen Acres, likewise two other Tracts of Land lying in Baltimore County the one called Stansbury's Inheritance Containing one thousand four hundred and forty acres the other Tract called Rosses Manor containing Seven Hundred and Seventy Acres or any or either of them or such part or parts of them or of any or either of them as may be sufficient to raise Money to Satisfy and pay the Debts still remaining due from the said Tobias Stansbury as aforesaid three months Notice of the Time and Place of such Vendue being first given in the Maryland and Pensilvania Gazette, and the said Lands or any or either of them, or any part or Parts of them or of any or either of them and all the Estate Right and Title of the said Tobias Stansbury therein respectively at the Time of his Death to make over and Convey by Indenture of Bargain and Sale or by any other Proper Conveyance to any Person or Persons who shall bid and give the best and highest price therefore as fully and Effectually to all Intents and Purposes as if the said Mary Stansbury was herself in her own Right Seized of and in the like Estate in the said Lands and other the Premises respectively as the said Tobias Stansbury was Seized of at the Time of his Death and the monies arising on such sale or Sales to lay out apply and dispose of for and towards the Payment and Satisfaction of the Debts of the said Tobias Stansbury which he did owe at the Time of his Death and still remain due and unsatisfied and to the Satisfaction and discharge whereof the Personal Estate of the Said Tobias Stansbury will not extend. And the overplus thereof if any shall be and remain and shall be secured for and paid to such Person or Persons in the same manner and in the Same proportions as the several Lands which in Virtue of this Act shall be actually sold are by the said last Will and Testament directed or permitted to pass. And to the End that discovery may be made of such overplus if any should be and that the same may be duly secured accordingly. Be it Enacted that the said Mary Stansbury shall before such sale or Sales give Bond with sufficient Sureties to the Deputy Commissary of Baltimore County in the same manner and Form as is usual in Cases of Intestates Estates (which said Bond shall be by him Transmitted to and lodged in the Prerogative Office) with Condition to the same that the said Mary Stansbury shall dispose of any Account for the Monies arising by such Sale or Sales Agreeably to the Intention of this Act and shall at such Sale or Sales produce a Certificate for the said Deputy Commissary of such Security having been given and also that the said Mary Stansbury shall within Six Months after any Vendue as aforesaid account with the Commissary for the Produce of Such Sale and give security for the Ballance (if any) in the same Manner as if the same was properly personal Estate, to be distributed and paid according to the meaning and Intention of this Act. Provided always and be it Enacted that this Act shall not extend to impower the said Mary Stansbury to burthen or charge the Orphan or Orphans of the afd Tobias Stansbury or any Person or Persons Claiming by from or under them or any of them with any General or other Warranty than against the Said Tobias Stansbury and his Heirs.
