In spite of all the information and posts that have been posted on this forum about the land claim case, I still see very little solid historical or legal facts or documentation/paperwork available in here regarding this matter. Just a few quotes from some historical books or dictionaries referring vaguely to the matter. Maybe that is sufficient for some people and they are satisfied with it. Personally I'm not.
I have not seen any real complete or even remotely complete details or any solid proof of what did or did not transpire in the past regarding what happened with the land; nor if what happened with it was even legal, nor the alleged lease or trust agreement/document between the family and the Sulpicians and its actual or real contents (or even where it actually is.) Nor have I seen any evidence as to if it ever actually existed, or if that is just a lie purpetrated by the Church, or just an assumption that it exists. I have only seen people's personal opinions, conjectures, suppositions, etc.
I personally have never recieved or obtained from anyone in this forum or elsewhere any actual documentation or paperwork on the legal case or the matter in general. Nor any of the historical documents mentioned above, nor any of the documents filed in the courts regarding this case(The Original Complaint/Demanduer, Writ, Motion...) filed with the courts in the 1920's or at any other time to initiate the action, or any supporting documents/discovery filed with the original civil complaint. Either by members of the family or this alleged Corporation Tessier.
I am not saying that anyone should try to re-open or re-file anything on this case, or otherwise attempt to re-try the case; whether it be on the grounds or constitutional error, jursidictional error, prejudice or bias, or that certain persons who sat on the bench in this case should have been recused or should have recused themselves from deciding this matter for several legitimate legal reasons. Those reasons alone or others could cause a case to be relitigated at a later time regardless of how much time has past. To be sure, obtaining a reversal or remand would be difficult at best and would take a very savvy lawyer for sure. It would also obviously require being able to back up the families claims with valid documentation.
However, maybe making a case in the court of public opinion could be a more viable option for some just to get some sense of satisfaction or to expose the truth, if there is one out there that needs to be exposed. Or maybe to have what information that does exist in dictionaries and encyclopedias on this matter could be corrected, amended, or added to. What's the harm. It would at least make for some really good reading for years to come and maybe even generate a good book, or even a movie. ;-)
Personally, for me, I am merely trying to obtain more information and to obtain some documentation on this case from someone on this matter for myself and my own satisfaction. And at least for me, bringing forth more information on this matter and bringing out all of the truth(s) would be personally satisfying. Other than the little meaningful info I have seen so far on this forum, I have nothing as far paperwork goes the court filings that initialted the past lawsuit(s) goes, any written opinions of the courts, or a copy of the alleged lease/trust agreement if it ever existed; nor really much of anything but memories of the stories told when I was a child and what I have read on the subject here and elsewhere, which I have seen nothing conclusive one way or another as to what the real truth is behind the story and the legend.
I can understand that some people in here may be tired of talking about the history of the Tessier Land Claim matter and the courts cases; and are satisfied with what they have found, what they know, or think they know, or have just read a little something about in a dictionary or encyclopedia, or just heard from someone else who claims to know everything about this matter or what the truth is. For those who are satisfied with what they know and with what evidence they have and do not wish to discuss it anymore, or are have become exasperated with discussing it, fine I can respect that. That's your right. Then don't talk about it. Nobody is forcing you to discuss it any further or participate in any discussions on it.
However, there are others who do wish to continue discuss the history of the Tessier Land Claim and the associated court cases further. There are those who want more information on the matter and there are those who also seek to acquire some documentation and paperwork on this case for themselves like me. There are people in here that what to discuss it just for the fun of it, the historical significance of it, for the hell of it, or just to bring out more of the truth than has been told. If you don't want to discuss it, stay out of it. Don't respond to my or anyone else's postings. Nobody is forcing anyone to participate in these discussions or postings. Please respect our and my rights in here to pursue discussing the Tessier Land Claim and sharing information on this matter.
If there are other family members out there who are willing to help me in this pursuit or just dicuss the matter without any judgements or derogatory remarks I would like to hear from them. Otherwise, I would ask people to keep their remarks and personal opinions to themselves. I don't need it nor does anyone else. I just want un-bias and un-judgemental information and documentation regarding the Tessier Land Claim, the civil or probate courts case(s), whether it be the one in the 1920's, before or since, and any other legitimate and verifiable information on this case. Help me out here. Please respond and send me what you have on the case. Thank you.
