Thomas is my gggrandfather. This is his will: Thomas Nevins his will dated 1868 and Probated in Jackson CO., MO I Thomas Nivens of Jackson County State of Missouri being now in reasonable health and possessing a sound and disposing mind and memory do make and publish this my Last Will and Testament on the following terms: Item 1st:It is my will that soon after my decease as possible all of my Just Debts shall be paid. Item 2nd: My children by my first wife are now of age and have received a reasonable education and I hereby give and bequeath unto James J. Nivens Five Dollars and to Martha Nivens Five Dollarsand to Joseph Nivens Five Dollars. They three being my surviving children by my first wife. Item 3rd:After the payment of all my Just Debts and above special bequests it is my will that my present beloved wife Ann Isabel Nivens shall have and enjoy during her natural life or until she shall marry again all of the balance of my estate both Real and Personal Estate for the purpose of supporting and educating my children by my present wife and at the death of my present wife then I will that each one of my children by my present wife who may be alive and without children themselves shall receive Six Hundred Dollars and after each one has received that sum then the remainder of my estate if any shall be equally divided among all of my children by both wives share and share alike. In the event ofmy wife marrying again then it is my will that she shall only have a life estate in the third part of all my property that I may die seized and possessed of or in other words a Dower intrust in my estate according to theLaws governing Dower.
