I have connected Thomas and Alexander as the sons of Henry Avera and Ann (Unknown--Probably Ann Nichols), based on the following fact.
HERE IS A GOOD CONNECTION THAT MAKES ALEXANDER AND THOMAS AVERA THE SONS OF HENRY AVERA AND HIS FIRST WIFE ANN NICHOLS.
At the court held the 3rd Wendsday of August, being the 17th day, 1715 (Aug. 17, 1715)
Four separate defendants were brought before the court--Thomas Poole, Alexander Avera, Thomas Avera, and John Whitfield--and fined for not going to church on Sunday and not excusing theirselves. They were ordered to pay the fine directly to the churchwardens for use of said parish. Remember,John Whitfied was the grandson of Jane Avera who she was appointed guardian of 12/18/1695, after his father Thomas Whitfield died. This connects them all together, and I think that we can safely say that Thomas and Alexander Avera were the sons of Henry Avera and Ann Nichols, his first wife.It also sets the date of death for Thomas Avera (Rebecca Avera’s husband) as between 8/17/1715-1/20/1719. It looks like these guys were all skipping church together, and obviously were connected here.
In addition, Henry Avera, Sr. was the first Avera and only Avera to arrive in Elizabeth City County in 1642, and court records begin to document him being there in the mid 1660s.Alexander and Thomas Avera show up in court records in the later 1600s.Since Henry was the only Avera there prior to seeing Alexander and Thomas, and the fact that Thomas died in 1715, which would be at an average age for one of Henrys sons by his first marriage, this is additional proof that Thomas and Alexander were the sons of Henry and his first wife (probably Ann Nichols)

THe following is a receipt that Henry Avera, Jr.gave to his mother Jane for his share of his father's property.This proves that Henry Jr. was 21 in 1695, and that his father Henry Sr. passed on prior to 1695, NOT THAT HE DIED IN 1695.It fixes Henry Jr'sbirthdate as 1674.
THIS PROVES SON HENRY'S AGE----

There was a Henry Avery who came to America with his wife Ann in 1642,( per the book Early Virginia Immigrants 1623-1666 by George Greer that I found in the library in Stillwater, OK.) and this Henry and Ann originally settled in Yorke County, VA., which is right next to Elizabeth City County.There was no record of death in York County for Henry, and no other types of records there either, for Henry Avera, or any other Avera, during the 1600s-early/mid 1700s.It would be loogical to assume that Henry moved across the county line to Elizabeth City County. Henry and Ann had at least 2 sons, Alexander and Thomas Avera.Thomas Avera went on to marry Rebecca and died between 1715-1719.There was interaction between these two sons, and Thomas Poole (son of Jane Poole who later married Henry Avera) and John Whitfield (grandson of Jane Poole who later married Henry Avera after Ann died.)It is that connection that leads me to connect this Henry with a second wife Jane whose first husband was John Poole, and then had 2 more sons with Jane--Charles Avera and Henry Avera, Jr. Alexander and Thomas Avera, Thomas Poole, and John Whitfield all went to court on the same day in 1715 and were fined for not attending church on Sunday.The marriage of Henry Avera to Jane who was first married to John Poole has been proven.The marriage of Henry Avera to Ann Nicholsand their emmigration to Virginia has been proven.The children of these marriages has been proven. I ahve found absolutely nothing to indicate that there were two Henry Averas living in Elizabeth City County, VA in the mid 1600s.In addition, the children from Henry's first marriage had interconnections with the children of Henry and Jane (his second wife) and the children of Jane and John Poole (Jane's first husband).Because of these facts, I have connected the line this way.
The most widely accepted belief of the origin of the Avera Families is that the family originally came from France during the French Huguenot movement during the 16th and 17th century when they were being persecuted for their protestant beliefs. They migrated to England, Wales and other places and eventually to the new world ~ America.I have read this is several different places.Our Henry was either born in England, or possibly came there from France.In any case, the ship he took to America left from England and he arrived in Virginia in 1642.Most likely, if he wasn't born in France, his parents were.

There is an Ann Nichols who married a Henrie Avery in England in 1639.(Lds research/web site) This may be and probably is the same person.Immigration records show a Henry and Ann Avera emmigrated to York County, VA in 1642.(see above)

Did our Henry Avera come from Uxbridge, England?Following is an e mail that was sent to me by Donna Carpenter Cuzze on 7-4-2005, that shows marriages of surnames Avery, Copeland, Whitfield, Nichols, and Poole in the late 1500s, early 1600s there.All of these surnames show up again in Elizabeth City County in the late 1600s.A coincidence --perhaps.More research may need to be done on this possible connection backwards into the 1500s in the future.

In the ejectment brought by Robert Westlock on the demise of Thomas Poole, plaintiff, against Pasco Curle, infant. Whereupon James Ricketts and Jane his wife was admitted defts for lands and tenements in the _____ to wit: one dwelling house, one garden sixty acs of land, 30 acs fo wood, and 30 acs of _____land with appurtenances in the parish and Co. of Eliz. City, which Thomas Poole to the sd. Robert had demnified for a term not yet expired, did enter and force him from his farm afsd and did eject and other enormities to him did do to the great damage of him the sd Robert and aft the peace of our Lord the King that now is, and whereupon Robert by Samuell Selden his Atty complains that when the afsd Thomas Poole the 10th day of May 1715 at Eliz. City had demnified to the afsd Robert the tenemants to be held and occupied by him the sd Robert and his assigns from the first day of the same May until the end of five years not yet expired.The sd. Pasco on the 12th day of May 1715 with force and arms, damages 10 Pounds money to which deft pleads not guilty.
Whereupon evidence being heard and jury impanneled finds for the deft."We find the last will and testament of John Poole dec'd pro and rec in Eliz. City Co. Ct dated 17 Mar 1667 with and endorsement thereon from John Poole the younger to Robt. Beverly dated 10 of 8br 1702 and hereunto annexed.We find that sd John Poole the Elder died seized of fee in the land in question.We find pattent granted to Jane Poole dated 6 Apr 1671 of land in question and annexed.We find a deed ack and rec in Eliz. City Co. Ct from Jane Avery to her three sons, vizt Thomas Poole, John Poole and William Poole dated 5 Jan 1688 with endorsement thereon from John Poole to Robt. Beverly dated 23 8br 1701 both of the land in question and hereto annexed.We find a deed from John Poole to Robert Beverly dated 13 8br 1701 of land in question hereto annexed and ack and rec in the General Court.We find the last will and testament of Nicho. Curlehereunto annexed whereon is devised to his son Pasco Curle the land in question.We find that Jane Poole who had been the wife of Jno. Poole the Elder dec'd, mother to Tho. and John Poole now living and Wm. Poole now dec'd by her husband the sd John Poole the Elder after the death of sd Poole was marryed to one Henry Avery of this County and he died before Jane and she died afterward when she was Avery's widdow and went by the name of Jane Avery at her death.We find an inquisition dated 26th day Nov 1702 under hand and seal of Jerome Ham deputie of John Lightfoot Esq, Escheator of Eliz. City Co. and a jury sworne before him to enquire whether 474 acs of land late in the possession of Jane Poole did escheat to her Majt and hereunto annexed.We find the land in question to be the 474 mentioned in the inquisiotion. We find a pattent from Francis Nicholson Govrnr dated 16 day of April, 1704 by which the land in the declr mentioned is granted to sd Thomas Poole, lessor of the plt.We find that Thomas Poole the lessor of the pltf is the Eldest son and heir of Jane Poole, afterward Jane Avery, and if upon the whole matter the law be with pltf., we find for pltf one shilling damage.If not, we find for the deft. Joseph Banister foreman. Which on motion of the parties was ref'd for the matter of law to be argued.Now being called and argument heard, the court considering the same are of the opinion that the law is for the Pltf."Therefore ord that plt recover the lands and tenaments in the declr mentioned which is granted giving sec according to law.
Ordered that Thomas Poole pay to Thomas Avery acc to law for 15 days attendance for him aft Pasco Curle with costs at Exon.

Jane Averett (Avera), widow, is appointed guardian to John Whitfield, orphan of Thomas Whitfield, deceased.She being the grandmother to the orphan, giving bond and security.Security:Thomas Poole.
This proves that the Ann who is the wife of Thomas Whitfield in his will (1694) , was the daughter of Jane Avera, who was first married to John Poole, and secondly to Henry Avera. Based on the age of Ann, & the fact that Ann and Thomas Whitfield had 4 children when Thomas Whitfield died in 1694,we know that Ann had to be the daughter of John Poole and Jane, not Henry Avera and Jane.
