Bandit Robs Autoist
When Sherrill Sheppard, 4720 College Avenue, stopped is automobile in the alley in the rear of his home at 10:15 p. m. Thursday he was met by a bandidt, who covered him with a revolver.The robber took a bill fold from Sheppard's pocket and removed $3 from it, then tossed the fill fold into the alley and escaped.
Last Will and Testament
I, Sherrill T. Shepard, of Indianapolis, Indiana declare ths to be my Last Will, and revoke all other wills and codicils that I may have made.
Article I
I, direct that my enforceable debts, expenses of my last illness and funeral and administrative expenses of my estate, shall be paid by my executrix from the principal of my residuary estate.In her discretion my executrix may continue to pay any installment obligations incurred by me during my lifetime on an installment basis or may prepay any or all of such obligations in whole or in part and my executrix may in her discretion distribute any asset encumbered by such an obligation, suject to the obligation.I, direct that all inheritance, estate adn succession taxes (including interest and penalties thereon) payable by any reason of my death shall be paid out of and be charged generally against my residuary estate without reimbursement fromany person.This provision shall not be construed as a waiver of any right which my executrix has be law or otherwise, to claim reimbursement for any such taxes which become payable on account of property, if any, over which I have power of appointment.
Article II
I, bequeath all my personal effects and household goods and the like not otherwise effectively disposed of, such as jewelry, clothing, automobiles, furniture, furnishings, silver, books and pictures (including policies of insurance thereon, if feasible), to my wife, Ella T. Shepard, Hereinafter referred to as "my Wife", if she survives me by thirty (30) days, or if she does not survive me to my three (3) children, Mary Geraldine Green, Suzan Veronica Barker, and Sherrill Ada Oberlies, in substantally equal shares, per stripes.
Article III
I, devise and bequeath all my residuary estate, being all property, wherever situated, in which I may have any interest at the time of my death not otherwise effectively disposed of, but not includng any property over which I may have power of appointment, as follows:
1.To my wife, if she survives me for thirty (30) days, or2. If my wife does not survive me, to my three (3) childen, Mary Geraldine Green, Suzan Veronica Barker, and Sherrill Ada Oberlies, in substantally equal shares, per stripes.
Article IV
In determining the meaning of the words "children", "grand-children","issue", and "per stripes", for the purpose of this will, adopted children of any person, including myself, shall be treated as though they were natural born children of that person.
Article V
I, appoint my daughter, Suzan Veronica Barker, executrix of this will.My executrix shall have the following powers, and any others that may be granted by law, to be exercised in her discretion without Court Order:
a. To retain any property of my estate; b. To sell any real or personal property of my estte, for cash or on credit, at public or private sales, for any purposse; to exchanged any such property for other property; to grant options, to purchase or acquire any such property; and to determine the prices and terms of sales, exchanges and options. c. to emply attorneys, aduitors, depositaries, proxies adn agents, with or without discretionary powers; and to keep any property in the name of an executor ora nominee, with or without disclosure of any fiduciary relationship; or in bearer form;
d. To collect, pay, contest, compromise or abandon claims of or against my estate, whereever situated; and to excute contracts, conveyances and other instruments, including instruments containing covenants and warranties binding upon and creating a charge against my estate, and containing provisions excluding personal liability.e. To enter into any transaction authorised by this Article with trustees, executors, or administrators of any other trust or estate in which any beneficiary hereunder has any interest even though any such trustee or representative is also executor hereunder;
f. To make any distribution or division of my estate in cash or in kind or both;g.To allot different kinds or disproportionate shares of property or undivided interests in property amoung the beneficiares, and todetermine the value of any such; h.To invest in any property, real or personal.
Article VI
In the event my wife and I die under such circumstances that there is no sufficient evidence to establish who survived the other, I hereby declare that I shall be resumed to have survived my wife.In Witness Whereof, I have initialed the three (3) pages preceding this one and hereunto subscribed my name in the presence of the undersigned witnesses, who act as such at my request, this 22nd day of June, 1978.(signed) The foregoing insturment, consisting of four (4) pages, including this page, each page being typewritten only on one side was at the date thereof by the said Sherrill T.
