Sir Malcolm Fleming (son of Sir David Fleming and Isabel) died November 24, 1440 in Scotland. He married Elizabeth Stewart on June 28, 1413, daughter of Robert Stewart and Muriella De Keith.

Sir Malcolm Fleming Lord of Biggar and Cumbernauld.

Sir Malcolm as son and heir of David Fleming of Biggar (Knight to him and his male heirs) received from King Robert III the castle and lands of Cumbernauld and others and a charter from Robert, Duke of Albany, for the lands and barony of Biggar. Sir Malcolm was hostage for the return of King James I when he was allowed to visit Scotland, May 31, 1421, and a Malcolm, Lord of Biggar, he was nominated as a hostage for his majesty's release by treaty on December 4, 1423. He was allowed to visit Scotland May 31, 1421. He had a safe conduct to come into England to meet King James December 13, 1423. Accompanying William, Earl of Douglas, to the Castle of Endinburg, he was, after a mock trial, along with the Earl and his brother, found guilty of treason, beheaded there November 24,1440, and his lands of Monycabo forfeited.

Sir Malcolm Fleming was the son and heir of Sir David Fleming (died after September 1382) and Christian; great-grandson of Sir Patrick Fleming of Biggar (a second son) and______Fraser, daughter of Sir Simon Fraser; great-great-grandson of Sir Robert Fleming (one of the leading men of Scotland) follower of Robert the Bruce (Sir Robert Fleming joined Robert the Bruce in his effort to rescue the crown and restore the liberties of Scotland).

Sir Malcolm Fleming, Lord of Biggar and Cumbernauld married before June 28, 1413, Elizabeth Stewart, daughter of Robert (Duke of Albanyand Governor of Scotland) and Muriella de Keith, daughter of Sir William de Keith, Great Marischal of Scotland.
