I Ely Cox, being of sound and disposing mind and memory, being also of advanced age, and considering the uncertainty of human life have thought proper to make and ordain this my last Will and Testament, in manner and form as follows, to wit:

The true intent of my last section above is that the death of my said wife, the land alluded to shall pass into the hands of my said grandson Cleveland Cox by valuation and legal transfer to be held in trust by him for the use and support of his father and mother and their children until the time specified and that his said father may work, manage and enjoy the benefit of it but in no case be allowed to dispose of it or any part thereof. Wofford ____________________________________________________________________________________Note of Edna Westmoreland: Betty jean Dill brought this will of Ely Cox to me on 3/3/1997. Notice in 1871 he named his grandson Cleveland Cox in trust of his estate. Ely Cox died and Cleveland Cox left Spartanburg County, South Carolina and went to Texas. The family never heard from him again. he left South Carolina about 1880, and his brother-in-law, Sam Woodruff went with him, and by 1882 or 3 Sam Woodruff died in McKinney, Texas, leaving 4 children and a widow, Mary Elizabeth Cox Woodruff in South Carolina. ____________________________________________________________________________________Notes of Edna Westmoreland: Ely Cox built the old home where Walt Bevill lived when you children were growing up. The land had been deeded to Ely and his wife Elizabeth Allen. I was told that he lived a short time around Walnut Grove, and moved the timbers he used for the foundation for this old home from Walnut Grove, around 1820. this is March 12, 1994 and the ruins are still visible unless the pulpwood people didn't knock it down. They were cutting two weeks ago. Grandma Minnie was born in this old home, so was her first born Lola. I saw Ely and Elizabeth Allen Cox's family bible while Barbara Carter was living in uncle "Wister" Cox home. I suppose Harriet Carter Moses has it now. (1994). Also there was a picture of Ely and Elizabeth Allen Cox hanging on the wall in the "sitting" room while Uncle "Wiss" and Aunt Hattie lived there. Ely Cox was a very distinguished looking old man, white short beard and hair was white. these pictures were made by your great-grandfather Sam Woodruff who was a photographer, the old tin type ones. I copied the Bible records thus: Emeline Cox born November 8, 1818 in Spartanburg County, South Carolina (No further information (1996) when I saw the old bible, I did not see any marriage records. Carwyle Cox born Jan. 30, 1820 died Jan.28, 1917 Married Jul.29, 1847 Cassandra Holcombe Matilda Cox born feb.17,1822 in Spartanburg County, South Carolina, died 1855 in Laurens County, South Carolina. Buried in rock crypt in old Martin Graveyard near Harry McCordi in Laurens County Mary Ann Cox born Oct. 15, 1827 died 1886 or 1887. She was the fourth child of Ely and Elizabeth Allen Cox, born in Spartanburg County, South Carolina, and was recorded in the bible she married in 1841 to Reuben Martin. She is buried in Bethel Cemetery, Woodruff, South Carolina, near her parents, no tomb, and I have found no records that she was married.
Note: Casper Wister Allen visited South Carolina in July 1889, and while he was here obtained dates from tombstones in Bethel Cemetery. he was a nephew of Elizabeth Allen Cox. John Cox born Jul.4,1830 Spartanburg County, South Carolina, died unknown at this time. He was not mentioned in the will of his father Wily Cox, so he must have left South Carolina before 1871.
