Elbert Harrison Allen (b. July 15, 1825, d. March 23, 1883)
Elbert Harrison Allen (son of Mathew Allen and Rebecca Drummond) was born July 15, 1825 in Woodruff, Spartanburg County, South Carolina, and died March 23, 1883 in Oxford, Calhoun County, Alabama. He married Fannie E. Stamps.
Notes for Elbert Harrison Allen: WILL OF ELBERT H. ALLEN:
Know all men by the present that I Elbert H. Allen of the town of Oxford County of Calhoun, and the state of Alabama. Physician being in good health and of sound and disposing mind and memory; do make and publish this my last will and testament, hereby revoking all former wills by me made at anytime heretofore. And as to my worldly estate and all my property, real and personal or mixed of which I dispose hereof in the manner following to wit. My will is that all my just debts and funeral expenses shall be my executor's hereafter named, be paid out of my estate as soon after my decease as shall by her found convient.
I give to my youngest son James T. Allen ($1,000.00) One Thousand Dollars or the sum equal to one third (1/3) of the entire amount which may be drawn at my death, upon the policy which I hold in the Mobile Life Insurance and made payable to my other three children P.F. Allen, J.T. Allen and E.T. Allen.
I will that my youngest sons James T. Allen and E.T. Allen shall be educated at Oxford College or some institution of like character and the expenses thereof paid out of my estate. I hereby appoint my wife Fannie E. Allen to be Executrix of this my last will and testament, and for her expressly will that no bond shall be required of her as Executrix.
And I will that after my death, my Executrix shall take immediate possession of my estate and shall use the same for the future maintenance and support of herself and my legal heirs, and shall have all the rights and powers to manage and control said estate that I would have if living; to sue and be sued, to sell, exchange, or otherwise dispose of any belonging to said estate, real personal or mixed and to legally convey the same be deeds, bills of sale or otherwise and said deeds and conveyances, where property signed by her shall be valid by law.
And I will that when my wife dies, all my property, real personal, or mixed, shall after paying all just debts against said estate and faithfully complying with all the stipulations and requirements, set forth in the body of this my last will and testament, be equally divided between my legal heirs, to wit-Percy Flint Allen, Jessie Thalia Allen Elbert Tully Allen and James Troy Allen.
This division shall be made by sale of the property or otherwise as my Executor or Executrix herein after named may deem most eligible.
And I do hereby appoint my oldest son, Percy Flint Allen my Executor to take immediate charge of my estate and fully execute and carry out the requirements of this my last will and testament.
And I further will that no bond be required of either Executor or Executrix given under my hand and seal this 2nd day February 1882.
