WARNS PUBLIC NOT TO PICK UP STRAYS
An excited little brown and white dog was returned to its owner, Carl Gordon, Queensville in York County Police Court Newmarket on Thursday and a charge of theft against Mr and Mrs J.S. Adam, 22 Covelly Ave, Toronto, was dismissed on payment of costs.
" I understand that the have been a number of dogs taken from the district of Queensville by motorists passing through" commented Magistrate W.N. Robinson. "People have no business picking up dogs and taking them away. If they happen to see a stray dog they should take it to the police or put and advertisement in the papers and have the owner pay the costs when he claims the dog."
Mrs Carl Gordon testified that her dog had disappeared from her farm on the highway south of Queensville on May 1. She said that on August 28 she noticed the three year old dog in a car driven by the defendant as it slowed down in front of the vegetable booth which she was attending in front of her home. Seh asked the defendant to let the animal out of the car which he did and the dog immediately recognised her. She said that Mr Adam told her that he had picked the dog up on the highway south of Newmarket.
Carl Gordon said that the defendant told him he would return the dog if he, Mr Gordon, would pay five dollars for its keep. Whe he returned from his house to pay the defendant, the latter told him that he had changed his mind. The witness told his worship that Mr Adam gave him his name and address and returned to Toronto with the dog.
At this point in the hearing Constable Joseph Jardine entered the court with the dog. The animal immediately ran to the Gordon family and jumped about in excitement.
"There certainly can be no doubt now as to the ownership of the dog, commented Crown "Attorney N L Mathews, KC
"We don't dispute the ownership of the dog", interupted the defense, "We disagree that this is really a case of theft."
"Yes I rather hesitate to convict a person on a charge of theft in a case like this" stated his worship." It is really a case of the people on both sides becoming attached to the little animal. To convict the defendants would mean they would have a record against them the rest of their lives."
