To the Honorable John W. Green Judge of the Superior Court of Chancery for the Fredericksburg District.
Your Orator James Hawkins humbly complaining sheweth unto the Court that a certain Job Hawkins a brother of your Orator departed this life sometime in the year of our Lord intestate, without issue and without having ever been married, and that at a court held for the County of Culpeper on the ___ day of ___ 18___ [original document had blanks] administration of the Estate of the said Job was by the said Court granted to your Orator. That the said Job died seized and possessed, or entitled to, several small tracts of land in the County aforesaid towit about 158 acres in one tract, and about 264 acres in another tract devised to the said Job and to your Orator jointly by the last Will & testament of Matthew Hawkins their father now dec'd which have never yet been divided between them-and the said Job was further more seized and possessed at the time of his death of about 390 acres more in three different small tracts which he had purchased of different persons. And your Orator sheweth further to the Court that the said Intestate was also possessing of sundry slaves and some perishable estate; that the slaves consist of six in number male and female and are of the following names towit Isaac, Andrew, Winney, Lucy, Eliza, Thornton. Your Orator shews further to the Court that the said Matthew Hawkins dec'd had by his first wife seven children namely Elizabeth, Mary, Susanna, John, Phebe and Job the intestate, and James your Orator. That after the death of his first wife he married again and had one other child by the name of Rebecca. That the said Elizabeth intermarried with a certain Humphrey Popham, the sd Mary with a certain Goodrich Lightfoot, the said Susan with a certain Benjamin Duncan and the said Phebe with a certain Thomas Popham. That the said John Hawkins has since departed this life, but whether Estate or Intestate your Orator is uninformed, as the said John at the time of his death lived in a distant state [North Carolina]-leaving a Widow and four children namely John, William, Sally & Polly Hawkins which last your Orator hath understood is married to a man by the name of Brice Imes, and your Orator hath understood that the said Sally is likewise married but to whom he does not know & has not been informed-That the said Phebe has likewise departed this life in the lifetime of the said Job Hawkins her brother leaving six children namely Job, John, Nelly, James, Thomas & Phebe and that the said Benjamin Duncan is likewise dec'd, leaving the said Susanna his Widow & Relict. And that the said Rebecca the half sister has intermarried with a certain Hawkins Popham-And your Orator shews further that this is advised that the real and personal estate of the said Job Hawkins the Intestate, upon his death descended and passed by law to the aforesaid persons including your orator in parcenary male & female according to the act directing the course of descent except that the said Hawkins & Rebecca his wife she being of the half blood are entitled to only half as much as her brothers & sisters of the whole blood-And your Orator shews further to the Court that the slaves aforesaid cannot be divided in kind, as your honor may see from the numbers stated above compared with the numbers of the parties entitled to distributions and he is advised under such circumstances that your honor will direct them to be sold and after the Intestate's debts are paid if the perishable estate should fall short direct a distribution of the surplus amongst the Distributees.
And your Orator shew further that it is greatly to be desired that there should be a division of the lands above mentioned; first of those parts held jointly between himself and the said Intestate and secondly of all the lands of the said Job amongst his brothers and sisters and the representatives of such as are dead; which as most of the parties are absent, residing in another state, cannot be effected without the aid and intercession of the Court. And your Orator is at the same time willing that his administration account shall be settled & after leaving in his hands enough to pay the debts of the estate, if they be not then all settled, that there shall be a general distribution of the whole Estate at the same time, upon the Distributees giving bond & security to refund as the law in such case requires. To the End therefore that the said Humphrey Popham & Elizabeth his wife; Goodrich Lightfoot & Mary his wife, Susanna Duncan, Hawkins Popham & Rebecca his wife, John Hawkins, William Hawkins, Sally Hawkins & Brice Imes & Polly his wife children of John Hawkins dec'd, also Job Popham & Phebe Popham children of Thomas Popham & Phebe his wife together Executor or administrator of the said John Hawkins dec'd when his name shall be made known or discovered may be made Defts. To this Bill, and that it may be decreed that the lands aforesaid be divided according to the rights of the several parties, first by dividing the lands devised as aforesaid into two equal parts and allotting one part thereof to your Orator and the other to the representatives of the said Job the Intestate and then by dividing the whold of the lands to which the Intestate was entitled at his death amongst his said representatives, only giving the said Hawkins Popham & Rebecca his wife, the half sister aforesaid, half as much as to the others, the representatives of those who are dead taking the share or shares only to which their ancestor would have been entitled had he or she been living-That the said slaves be sold and after leaving in the hands of your Orator as much as shall appear to be necessary for the payment of debts & that the residue be divided equally amongst the parties aforesaid only giving the half sister as aforesaid a half share. And that your Orator's account of his Administration be settled before a commissioner of this Court to enable your honor to do complete Justice to the said parties-they upon receiving their distributable parts or any portion thereof giving to your Orator a bond to refund as the law requires. And that your Orator may have such other and further relief in the premises as to the Court may seem proper. May it please the Court to grant to your Orator the Commonwealth Court of Chancery [partly illegible here].
