Hawkins vs Popham" File #124: April 8th 1823

CULPEPER COUNTY COURT: Pleas at the Courthouse of Culpeper County before the Superior Court of law for that part of the 9th Circuit composed of the said County of Culpeper the 8th day of April 1823

Be it remembered that at this same time towit at a superior Court of law held for said county the 4th day of April 1823. John Turner foreman, Ambrose P. Hill, Thomas Hudson, John Hume, Joseph Kilby, William
Crigler, James Morris, James Beckers, James Hawkins, Marshall Patty, John Beckham, Austin Smith,
Robert T. Sims, Joseph Roberts, Joel Inskeep, James S. Stacks, Lewis Y. Field, Page P. Finney and James Sims were sworn a Grand Jury of Inquest for that part of the 9th circuit composed of the County of
Culpeper, and having received their charge, were adjourned until tomorrow morning ten o'clock at which time towit at a Superior Court of law continued and held for said county the 5th day of April in the year aforesaid the Grand Jury appeared in court according to their adjournment; and were sent out of court to consider of their presentments, and after some time returned into court and upon their oath presented an indictment in the words following towit… "Virginia 9th Judicial Circuit, Culpeper County Court. The Jurors of the commonwealth of Virginia duly summoned to attend the superior court of law directed to be
held on for the said county of Culpeper being one of the counties comprising the ninth Judicial Circuit as aforesaid upon their oath present that a certain Matthew Hawkins dec'd in his lifetime intermarried with a certain Hannah Maxwell by whom the said Matthew had a daughter named Elizabeth who afterwards
intermarried with a certain Humphrey Popham by whom she, the said Elizabeth, had a son called Hawkins Popham. That the said Hannah the wife of the said Matthew afterwards departed this life and that the said Matthew thereafter in his lifetime intermarried with a certain Elizabeth Pitcher by whom he had a daughter named Rebecca who is the aunt of the said Hawkins Popham-and the Jurors aforesaid upon their oath
aforesaid do further present that the said Hawkins Popham labourer since the 8th day of December 1788
towit on the 21 day of June 1817 at the county aforesaid, and within the jurisdiction of this court, with force and arms hath illegally, knowingly and willfully married the said Rebecca Hawkins spinster this the said Hawkins Popham's aunt, she the said Rebecca being his Mother's sister, contrary to the statute in that case made and provided and against the peace and dignity of the Commonwealth of Virginia.

And the jurors aforesaid upon their oath aforesaid do further present that a certain Hawkins Popham labourer since the 8th day of December 1788 towit at the county aforesaid and within the Jurisdiction of this court on the 21st day of April 1817 with force and arms hath illegally, knowingly and willfully married a certain Rebecca Hawkins spinster his aunt, she the said Rebecca being then and there the sister of his, the said Hawkins Popham's mother, contrary to the statutes in such case made and provided and against the
peace and dignity of the Commonwealth aforesaid.

And the Jurors aforesaid upon their oath aforesaid do further present that a certain Matthew Hawkins dec'd in the course of his lifetime had two wives, that by his first wife the said Matthew had a daughter named Elizabeth who intermarried with a certain Humphrey Popham by whom the said Elizabeth had a son called Hawkins Popham and that the said Matthew by his second wife had a daughter called Rebecca who is the aunt of the said Hawkins Popham-and the Jurors aforesaid upon their oath do further present that the same Rebecca Hawkins spinster who is the aunt of the said Hawkins Popham labourer since the 8th day of
December 1788 towit on the 21 day of April 1817 at the county aforesaid, and within the Jurisdiction of this court hath illegally, knowingly, and wilfully with force and arms married the said Hawkins Popham the said Rebecca being his mother's sister, contrary to the statutes in such case made and provided against the
peace and dignity of the Commonwealth of Virginia. "John Shackelford calling for the Commonwealth Elizabeth Hawkins and James Hawkins witnesses sworn in open Court 5th April 1823 to give evidence before the Grand Jury upon this bill of Indictment."Evidence "A true bill" [followed by Latin term]
And thereupon came as well the prosecutor for the Commonwealth as the defendants by their attorney and
the said defendents for plea say that they are not guilty in manner and form as in the indictment against them is alledged and of this they put themselves upon the county and the prosecutor for the Commonwealth likewise whereupon came also a Jury towit: John Guinn, Presley Neale, John Wood, William Masey, William [illegible], William Hambrough, John W. Marshall, Georg [illegible], James N. Corbin, Lewis
[illegible], Charles Richard, and James Garnett who being elected read and swore the oath to speak upon the issue joined upon their oath do say "We of the Jury find the defendents Guilty-but because the Court is not yet advised of its Judgements to be given in the promised time is taken to consider thereof.

And now at this day towit at a Superior Court of law continued and held for said county the 8th day of April 1823 came as well the prosecutor for the commonwealth and the defendents by their attorney and the court having mutually considered of its Judgement to be given in [on?] the [premises?] Therefore it is
considered by the court and it is hereby declared that the marriage between the defendents in null and void-and that the Commonwealth charges against them the cost of this prosecution.

[This indictment against Rebecca Hawkins and Hawkins Popham, her ˝ nephew, and the court's declaration that dissolved their marriage may have come from the problems, which arose in settling Job Hawkins estate. Should Rebecca and Hawkins Popham receive a half or whole sibling's share of it? After this first marriage was dissolved, Rebecca Hawkins Popham married John Story before Aug. 1823 and had a large family.]
