LAST WILL AND TESTAMENT OF MARTHA WELLS OF WELLINGBOROUGH


Will Dated 13th May 1870
Codicil Dated 23rd May 1870

This is The Last Will and Testament of me Martha Wells of Wellingborough in the County of Northampton. Widow which I do make publish & declare in manner following that is to say I Direct that all my just debits and my funeral and testamentary expenses shall be fully paid and satisfied by my Executors hereinafter named as soon as conveniently may be after my decease I Nominate and Appoint my Son in Law James Thomas Hobson of the Town of Bedford, Merchant and my friend William Cleaver of Wellingborough aforesaid gentleman to be the Executor and Trustees of this my Will. Whereas I have already given to my daughter Mary Kingston Wells ( who now resides with me) absolutely an electro-plated tea and coffee service and all other plated articles in and about my present dwelling house on the day of the date hereof and the same are now in her possession and under her exclusive control. I bequeath unto my grandson Edward Ekins Cromar ( the eldest son of my late daughter Martha Adams Cromar) absolutely my gold watch with the chain thereto ( but not the appendages) and in the case the said Edward Ekins Cromar shall die in my lifetime then I bequeath unto my three daughters Emma the wife of John Askham Harriett Hardwick the wife of James Thomas Hobson and said Mary Kingston Wells or such of them as shall be living at my decease absolutely in equal shares and proportions all my wearing apparel and I hereby declare it to be my will that no payment for mourning shall be made by my executors out of my estate my intention being that the several members of my family shall themselves pay for whatever mourning they respectively may choose to have I bequeath the following pecuniary legacies namely:- to my daughter Emma Askham the sum of fifty pounds and to my son Henry Ekins the like sum of fifty pounds and as to all my personal estate and effects whatsoever and wheresoever not hereinbefore otherwise disposed of. I bequeath the same and every part thereof unto the said James Thomas Hobson and William Cleaver their executors administrators and assigns upon trust to sell call in and convert into money the same or such part thereof as shall not consist of money and with and out of such part of my personal estate and effects as shall consist of money to pay all my just debts and my funereal and testamentary expenses and the pecuniary legacies hereinbefore bequeathed and then to pay the residue of the said moneys to my said daughter Mary Kingston Wells absolutely to whom I bequeath the same accordingly I give and devise unto the said James Thomas Hobson and William Cleaver and there heirs all and singular those five freehold messages cottages or dwelling – house situated in Kings Place in the parish of St Mary in the borough of Bedford together with the yards , gardens, outbuildings and appurtenances thereto belonging ( which said hereditaments were some time since purchsen by me and were conveyed to me by an indenture dated on or about the thirteenth day of October 1865 expressed to be made between Thomas John Green and the said James Thomas Hobson of the first part William Freswarter of the second part and myself of the third part) and all (if any) other my real estate whatsoever and wheresoever ( hereinafter called my said real estate) To hold the same unto and to the use of them the said James Thomas Hobson and William Cleaver their heirs and assigns for ever upon the trusts following (that is to say) upon trust that they the said James Thomas Hobson and William Cleaver or the survivor of them or other the trustees or trustee for the time being of this my will ( hereinafter called my Trustees or trustee) do and shall during the natural life of my said Daughter Mary Kingston Wells receive from time to time as the same shall become due the rents issues and profits of my said real estate and lay out and expend from time to time such sum and sums of money as my trustees or trustee in their or hid discretion shall think proper in keeping my said real estate in tenantable repair order and condition and in insuring the buildings thereon from loss or damage by fire. And during the natural life of my said daughter Mary Kingston Wells do and shall pay the said rent issues and profits after deducting therefore time to time what shall have been so as aftersaid laid out and expended for repairs and insurance into the proper hands of her sole and separate use free from the control debts or engagements of any husband with whom she may intermarry but so that she shall not have the power to dispose of the said rent issues and profits in the way of anticipation and from immediately after the decease of my said daughter Mary Kingston Wells. Upon further trust that my trustees or trustee do and shall as soon as conveniently may be after her decease sell all my said real estate either together or in parcels and either by public auction or private contract and either with or without any special or other condition or stipulations relative to title or otherwise with power to buy in my said real estate if put up for sale by auction or any part thereof and to rescind or vary any contract for sale and to resell the property so bought in or the contract for the sale whereof shall have been so rescinded as after said without being answerable for any loss or diminution in price and with power also to execute assurances give effective receipts for the purchase money and do all acts and things for completing any such sale which they or he may think proper and I declare that my trustees or trustee shall stand possessed of the moneys to arise from the sale of my real estate ( after payment of all costs and expenses attending the same) and of the rents issues and profits thereof in the meantime and until such sale ( hereinafter called the trust fund) upon the trusts following ( that is to say ) upon trust to pay thereout the following pecuniary legacies namely to my said daughter Emma Askham the sum of fifty pounds, to my son Henry Ekins the sum of fifty pounds, to my grandson Edward Ekins Cromar the sum of fifty pounds, to my grandson Henry Cromar the sum of fifty pounds and to my grandson Charles Cromar the sum of fifty pounds to whom respectively I bequeath the same accordingly and as to the residue of the trust fund upon trust to pay the same to my said daughter Harriett Hardwick Hobson absolutely to whom I bequeath the same accordingly. But in case she shall die in my lifetime or in the lifetime of my said daughter Mary Kingston Wells then the trust to pay the same to my granddaughter Ida Mary Hobson absolutely to whom I bequeath the same accordingly.
Provided always and I declare that in case all or any or either of them the said Emma Askham, Edward Ekins Cromar, Henry Carter Cromar and Charles Cromer shall die in my lifetime or in the lifetime of my said daughter Mary Kingston Wells the respective pecuniary legacies or sums of fifty pounds lastly hereinbefore bequeathed to them her or him so dying shall lapse and fall into the residue of the trust fund for the benefit of my said daughter Harriett Hardwick Hobson or my said granddaughter Ida Mary Hobson (as the case may be). Provided also and I further declare that in case my said son Henry Ekins shall die in my lifetime or in the lifetime of my said daughter Mary Kingston Wells leaving lawful issue him surviving and living at the time of the decease of my said daughter Mary Kingston Wells the pecuniary legacy or sum of fifty pounds lastly hereinbefore bequeathed to him shall not lapse and fall into the residue of the trust fund but shall be paid to and divided between and amongst such issue in equal shares to whom I bequeath the same accordingly provided also and I further declare that the pecuniary legacies or sums of fifty pounds and fifty pounds hereinbefore bequeathed to my said daughter Emma Askham shall be for her sole and separate use and benefit and that her receipts alone be valid and effectual discharges for the same. I devise and bequeath all estates vested in me as trustee or mortgagee unto the said James Thomas Hobson and William Cleaver their heirs executors and administrators subject to the trust and equities affecting the same respectively but so that money secured by any mortgages shall form part of my personal estate provided always and I declare that if the trustees hereby appointed or either of them shall die in my lifetime or if they or either of them or any trustees or trustee to be appointed under this provision shall die or desire to retie from or refuse or become incapable to act in the trust of my will before the same shall be fully performed then and in every such case it shall be lawful for the then continuing trustees or trustee for the time being of this my will or if there shall be no continuing trustee then for the retiring or refusing trustees or trustee or the acting executor or administrator or executor or administrator of the last acting trustee to appoint any other person or persons to be a trustee or trustees in place of the trustee or trustees so dying or desiring to retire or refusing or becoming incapable to act as aforesaid and upon every such appointment the trust premises shall be so conveyed and transferred that the same may become vested in the new trustee or trustees either jointly with continuing trustee or trustees or solely as the case may require. And every such new trustee (as well before as after the trust premises shall have become vested in turn) shall have all the power and authorities of the trustee in whose place he shall be substituted and I further declare that the respective trustees for the time being of my will shall not be answerable for each others acts or receipts nor for involuntary losses happening without their respective default nor for money only for conformity and shall be at liberty to retain and allow to each other out of all monies coming into their hands all expenses incident to the execution of the trust and powers of this my will and hereby revoking and making void all former wills and codicils by me at any time heretofore made. I do declare this to be my only true last will and testament in witness whereof I the said Martha Wells the testatrix have to every sheet of this my last will and testament( contained in five sheets of paper) set to my hand this thirteenth day of May one thousand eight hundred and seventy -------------------- Martha Wells.

CODICIL DATED 23TH MAY 1870

This is a codicil to the within written last will and testament of me the within named Martha Wells. Whereas under and by virtue of my within written will the residue of the trust fund therein mentioned is to be paid to my daughter Harriet Hardwick Hobson absolutely to whom I have thereby bequeathed the same accordingly. But in the case she shall die in my lifetime or the lifetime of my daughter Mary Kingston Wells then the same is to be paid to my granddaughter Ida Mary Hobson absolutely to whom I have thereby bequeathed the same accordingly. Now I do thereby further declare my will to be that in case both of them the said Harriet Hardwick Hobson and Ida Mary Hobson shall die in my lifetime or in the lifetime of the said Mary Kingston Wells the residue of the said trust fund shall be paid to the within named James Thomas Hobson absolutely to whom I do hereby bequeath the same accordingly. But in case he shall not be living at the decease of the said Mary Kingston Wells then the sane residue shall be paid to and divided to and amongst all and every my children and child who shall be living at the time of the decease of the said Mary Kingston Wells and the issue then living of such of them as shall be then dead in equal shares such issue to take a parents share only to whom I do hereby bequeath the same accordingly. And in all other respects I do hereby confirm my said will in witness whereof I have hereunto set my hand this twenty third day of Mat one thousand eight hundred and seventy--------------- Martha Wells
