The 1830 census of Jefferson Co., AL shows Robert Daniel with 1 male 5-10, 1 male 30-40, 2 females 5-10, 1 females 10-15, and 1 female 30-40. Possibly this man, son of John B. Daniel, though his birth year would have to be a year or two earlier. Lived in Franklin Co. 1850. Robert Daniel received a patent for land in Greene Co., AL on October 1, 1835.

He married (1) ELIZABETH JACKS June 29, 1820 in Jefferson Co., AL, daughter of JOHN JACKS and SARAH KEEN. She was born 1802 in Montgomery Co., KY, and died Abt. 1866 in Upshur Co., TX. He married (2) MARY ANN ? Abt. 1870 in Wood Co., Texas. She was born 1814 in VA, and died 1886 in Wood Co., TX.

OHN M. DANIEL:
Our great-great grandfather was born in Laurens County, South Carolina about 1800. Most of his family, including his parents and several siblings, had moved to Jefferson County, Alabama by 1819 (the year of the death of his grandfather in South Carolina). He met and married Elizabeth Jacks in Jefferson County. Jefferson County Marriages show most of his siblings marriages in the 1820s and 30s.

A land patent was issued to John Daniel on February 1, 1822 in Jefferson Co., AL, but it is not known whether this was father John B. or son John M.

The John Daniel who lived in Fayette Co., TN in 1830 is possibly this one, as he is not in Alabama in 1830. Census for 1830, Fayette Co. TN shows the family with two male and two female children whose ages would be right for Nicholas H., William J., Mary, and Penelope. John Daniel purchased approx. 160 acres of land in Calhoun Co., MS on November 16, 1840 and also January 4, 1845. Nicholas Harrison Daniel, oldest child of John M. Sr. also bought land in Calhoun Co. about the same time. (Found on General Land Office website.) John Daniel appears in Yalobusha Co., MS in the 1841 and 1845 state censuses. Land patents for Calhoun County state that he was "of Yalobusha County".

John and William Daniel are listed in the 1850 census index in Yalobusha Co., MS. Original land patents of Yalobusha Co. Mississippi give the following: John Daniel purchased 160.16 acres on 10 June 1838 (indicating the family had recently moved from Fayette Co., TN) and 160.04 acres on 5 June 1841. His oldest son Nicholas Harrison Daniel purchased 165.85 acres on 5 June 1841. Also on the same date 160.00 acres were purchased by John Jacks. The family probably moved to Upshur Co., Texas in 1856 or early '57. Upshur County, TX courthouse records show that he bought 320 acres of land from G.C. Pattillo on 18 April 1857. It was 12 miles west of Gilmer. On 1 January 1861, he granted 40 acres to his son John M. Daniel, Jr., adjacent to 40 acres he had granted his oldest son William J. Daniel. These brothers married sisters, Mary (Wm. J.) and Harriett (John M., Jr) Flanagan. On 8 Sep 1863 he sold 120 acres to J.G. Hammock of Rusk County.

In 1860 the family was living in Calloway, Upshur Co. at census time. (The Calloway community was located near present day Little Mound Baptist Church and cemetery.) In the household were John and Elizabeth and sons Martin and Jessy (Joseph). In 1870, John and Mary A. (second wife) were living alone, next door to John's daughter Sarah Jones, widow, and her four children in Wood County. In the 1880 census he is listed as age 79 with wife Maryann, age 66 (b. VA) in Wood County. In the household were also two granddaughters, Millie Nutt, age 14 (b. TX, father b. GA, mother b. AL) and Tabitha Bennett, age 26, (b. MS, no birthplaces for mother and father.) A Nutt family lived next door. E.D. 6, #210-234, p. 323.

John M. Sr. was named guardian of the children of John M. Daniel, Jr. (Lucinda Jane, James Y., and John M. Daniel III) after his son's death while in service during the Civil War. On the first Tuesday of September 1867 he put up for auction the 40 acres they had inherited after their father's death. The 40 acres sold for $150. The children's mother, Harriett Flanagan Daniel, was already remarried by this time to Isham LaRue.\\

From John F. Daniel: John Daniel owned 160 acres of land in Wood Co. in 1865, abstract # 385. He appears on the tax rolls of Wood Co. until 1881. In 1882 the property belonged to his widow, Mary Ann Daniel, indicating that he died in 1881. Voter registration records 1867-69 show him living in pct.13, in TX for ten years and in Wood Co. six years. Probably registered Aug. 2, 1867.

LIZABETH JACKS:
Exact death date and burial place are unknown. The Jacks family immigrated to Anne Arundel Co., Maryland in the mid-1600s, most probably from the English County of Shropshire, near Wales. A large group of them migrated to North Carolina (Yadkin Valley) and then to Montgomery Co., Kentucky, with some going on to Alabama.

  Notes for MARTIN VANBUREN DANIEL:
From NARA microfilm: M.V. Daniels enlisted in the 22nd Regiment, Co. E, Hubbard's Texas Infantry, the same unit as John M. Daniel, Jr. and C.W. Cox, on 4 March 1862 in Quitman, as a private. Regiment returns said he was absent sick in December 1862. No other information on him is in these records. Walter White says this regiment was hardest hit by the epidemic of typhoid October-December 1862. Many were sent home and never returned to duty. It is not known when or where he died, but he is not found in the census of 1870 in Wood County.

ARAH DANIEL:
It appears from the records that Sarah died after the birth of her third child. The 1830 census shows two females under 5. In the 1850 census of Pickens Co. AL William Stapp is married to Mary. A male, James, age 19, was probably a child of Sarah.

ILLIAM STAPP:
William Stapp received a patent for 40+ acres of land in Pickens Co., AL on October 1, 1835. Other patents under this name include more land in Pickens Co. on July 15, 1854, in St. Clair Co. on July 15, 1854, and in Tuscaloosa Co. on July 2, 1860. The 1830 census of Jefferson Co. gives one male 20-30, two females under 5 and one female 20-30.
