Convict Number 240, transported on the "Castle Forbes" to Van Diemen's Land for 7 years for sheep stealing. Castle Forbes left Cork, Ireland on 3 October 1819, arriving in Sydney, via Bombay, on 27 January 1820 with 140 male convicts and the 34th and 89th Regiments. The ship's master was Thos L. Reid. The ship departed Sydney on 12 February 1820 and arrived in Hobart on 1 March 1820 with 180 male convicts.

James was issued with Free Certificate number 1819 on 15 May 1826. He worked as a stockkeeper and was mentioned by Governor Arthur's Land Commissioner (Roderic O'Connor) when he visited the Deloraine area on 6 March 1828: "At about four miles distant on the opposite side of the Western River, stocker of the Derwent Hotel, has established himself on Crown Land of great extent and fine quality and has a large herd of cattle. A free man named Cubit who looks after them has frequently been speared by natives. He had received dangerous wounds a few days before we were there, the natives telling him that they would have him yet."
James was at constant war with the blacks, having a reputation of shooting more blacks than any other man in the Colony, and, in return, receiving a number of spear wounds, none of them fatal. In September 1831 he was wounded eight times before he could get back to his hut and gun, after going to the creek for a bucket of water. (Source: History of Deloraine)
James prospered and at one time owned 400 acres at "Brookhill", Chudleigh; 500 acreas "Homewood", land at Gawler and North Motton, 185 acres "Donegal", Deloraine, and 644 acres at Cressy.
His later days were spent at Chudleigh and he died at Brookhill in 1857 at the age of 61 years. He is buried in Perth.
