      358. Daniel5 Bemis (John4, John3, John2, Joseph1)1827 was born 05 Mar 1758 in Weston, Middlesex, Massachusetts1827,1828, and died 04 Jan 1832 in Weston, Middlesex, Massachusetts1829. He married Patty Winch1830,1831 18 Nov 1784 in Weston, Middlesex, Massachusetts1832, daughter of Joseph Winch and Mary Beals. She was born 12 Mar 1763 in Framingham, Middlesex, Massachusetts1833, and died 13 Jan 1823 in Wayland, Middlesex, Massachusetts1834.

[Received from David Bemis]

· Daniel Bemis fought in the Revolutionary War, enlisted as a private, in Captain Fullers Co. 37th Regiment company return dated Prospect Hill, October 6, 1775. They marched on the alarm of April 19, 1775. Further Daniel and John, his brother John? Were paid for watching British Prisoners held at Cambridge, MA. on April 2, 1782. As recorded in the town records for Weston, MA.
· Daniel also served in Capt. Asabet Wheelers Co. for three months And ten days, in Cambridge, MA. Co. for six months in Rhode Island in 1777.
· Daniel also served in Capt. Fisk's Company
· In 1799 Daniel Bemis and his brother Lot were appointed by the Town of Weston as "Hogreaves" (people who viewed hogs to see if they were ok).
· In 1803, Daniel Bemis, and a Samuel Smith were appointed by the Town of Weston as "Fence Viewers"
· In May 1814, there is a Daniel Bemis listed in the "Census of the Children" ages 4-18. At this time he is shown to have three children in this category in the North West District of Weston: Abijah, Joseph, and Henry, no ages were given.

Daniel Bemis Guardianship/probate

Daniel Bemis; had an action filed against him by the town of Weston In 1822 involving his property and debts owed to people and the town. The issue involved certain suits filled, and some relatively important people in the Weston, MA area. Those people involved and complaints filed against Daniel Bemis are: Nathaniel Hobbs, Henry Hobbs, and Washington Pierce, dated February 14th 1822. It should be noted that Mr. Pierce was the town constable at that time. The reasons for this action in being filed by the town of Western was that Daniel Bemis was said to be a drunkard, and a spendthrift. The specific language of the complaint is as follows "excessive drinking, idleness, and spendthrift that lessens his estate so as to expose himself in his family, does also thereby endanger and expose the said town of Weston, MA. In light of these actions the town of Western appointed a guardian and bounder, Mr. Washington Pierce, who was to oversee Daniel's estate. In the judge that presided over this matter in the Middlesex Probate Court is Judge Samuel P.P. Fay, and the signatories, were; Agustus H. Fisk, Isaac Fisk, Benjamin Jones, a "Physician", and James Billings, a "Gentleman". As part of this action a sum of $10,000.00 was placed in escrow with the Middlesex Probate Court. In the probate actions there are numerous persons named to money was owed and paid. A rather unusual notation made in the probate was this, "the sum of $5.00 was paid to a George Morton for a funeral for his wife who was "burned to death". In 1825 Washington Pierce it is noted was removed from office as Daniel's guardian. In 1827, a Horatio Allen was appointed "Guardian, and then removed in 1829. It seems that his later life, as outlined in this court action, was difficult. He was on medication from a Doctor Ames, and in 1822 his residence was paid on a month to month basis and at one point he was receiving care for a "bleeding sore" in 1827. What actions there were seemed to have been completed in the year 1829. At one point in the Guardianship there is a reference to the assigned guardians as being "overseers of the poor", apparently Daniel was "poor" Daniel dies in 1832, four or so years after the last action.

The Revolutionary War

Records show that during the Revolution seven Bemis' from the town of Weston served in the war. From Daniel's family there were John, Nathaniel, Jeduthan, and Daniel. Timothy, their older brother, was on the Board of Correspondence. This board was responsible for getting information and letters back and forth to the local and state communities, as well as other states regarding the plans and procedures for the war. In addition to these brothers there were Jacob, James and Thaddeus Bemis, apparently relatives, that also served in the War. They were part of various companies of soldiers from Weston, and fought in numerous battles of the war. 5 Daniel, who applied for a pension, was noted to have fought in the battles of Bunker Hill, and at Bemis Heights, in up state New York.4 At this time men were allowed to enlist for short periods of time (days, months or years) and then return home. In many cases during the course of the war they would enlist in the local army 3- 4 times. Daniel Bemis for example enlisted in the army five times for a total of two years, eight months service. It was not until 1818 that Daniel applied for a pension due to his "reduced circumstances", and in 1820 he received the pension \\\\

An interesting note made in the book "Weston, A Puritan Town" by Emma Ripley wrote the following excerpt. I do not think she is correct. First, his wife Patty did not die in 1842, she died in 1823 in a fire. Second, Daniel and Patty, as far as can be determined had four or more children, of which Luther, Abijah, Joseph and Henry were but four of. They may have had two or more daughters as well. Thus Daniel did have legal heirs, but why the house was lost such as it was is not known.

"The house on rising ground with lawn sloping to Sudbury Road, now the home of Frank B. Dow, Jr., was built by John Bemis, brother of Dinah Bemis who married Jonathan Stratton. Of the fourth generation from Joseph Bemis who was in Watertown in 1640, John married Hannah Warren of Weston in 1731. His family numbered twelve children, of whom Daniel, the youngest, born in 1758, inherited farm and homestead and married Patty Winch of East Sudbury in 1784. After the death of his widow Patty (or Martha) in 1842, there were no direct heirs and the Bemis property was finally sold in the 1880's to Mr. Moses H. Fuller. Mr. Fuller, born in Weston, had lived for many years in St. Louis, Missouri, and was glad to return to the old New England."
