To the worshipful the Justices of said court
The petition of Mary Haywood widow of James Haywood respectfully showeth unto your worships that her said husband died intestate in Montgomery County during the month of December last(3) leaving him surviving the following children to wit Elizabeth Haywood,(4) Benjamin Haywood,(5) James Haywood,(6) James D. Haywood(7) & wife Disey, Isaiah Haywood,(8) William R. Haywood(9) & wife Nancy, Wilson Haywood(10) and Richardson Haywood(11) who are his only heirs at law your petitioner further showeth that her said husband at the time of his death was seized in fee simple of a tract of land situate in said county adjoining the lands of James Haywood & others and containing by estimation two hundred acres your petitioner further showeth that she deserves to have her dower in the said land allotted to her and to that end she prays your worships to order a writ to issue to the sheriff commanding him to summon twelve freeholders connected to the parties neither by . . . or . . . and entirely disinterested to . . . the aforesaid tract of land and to allot and set apart to her one . . . part thereof including the dwelling house and all out houses, buildings and improvements . . . to the same for the term of her natural life, and report their proceedings in due form of law may it please your worships to order subpoenas with copies of this petition to be issued to the said Elizabeth Haywood, Benjamin Haywood, James Haywood,(12) James B. Haywood & wife D . . ., Isaiah Haywood, William Haywood & wife Nancy, Wilson Haywood and Richardson Haywood requiring them to appear at the next term of this court and show cause if any they have why the prayer of your petitioner shall not be granted . . . .

5. Benjamin Haywood (1818), child of James Duncan and Mary Haywood
6. James Haywood (Abt. 1835 - Abt. 1862), child of James Duncan and Mary Haywood. Note that neither James nor any of his issue are named in the subsequent estate filings. This indicates that James died without issue shortly after his father. Perhaps James died in the American Civil War.
7. James Duncan Haywood, Jr. (Abt. 1824 - Abt. 1870), child of James Duncan and Mary Haywood
8. Isaiah Haywood (1829 - Abt. 1865), child of James Duncan and Mary Haywood
9. William Riley Haywood (1827), child of James Duncan and Mary Haywood
10. Wilson Haywood (Abt. 1832 - Abt. 1862), child of James Duncan and Mary Haywood. Note that neither Wilson nor any of his issue are named in the subsequent estate filings. This indicates that Wilson died without issue shortly after his father. Perhaps Wilson died in the American Civil War.
11. Richardson Haywood (1833), child of James Duncan and Mary Haywood
12. Note that two children named James are indicated twice in the same document.
