Land Issues concerning James McFarland and his Children

            James E. (Jim) McFarland and his family moved to Fannin County Texas in 1837 from St. Francois County, Missouri. He seemed to be following the McFarland tradition set by his forebears when he moved to Texas to take advantage of the free land being offered to settlers. Throughout his life he worked to enhance the value of his land grant: one way was having a major thoroughfare created through his property- Highway 34 today. He made sure that all of his children were provided with land of their own. The oldest were able to apply for their own land grants, and his daughters and younger sons were given parts of his land grant. His eldest son A. Jackson (Jack) became an even larger property owner than his father and bought and sold property throughout his life. Jackson’s eldest son, James Franklin (Jim), also continued that tradition, providing a foundation in land for each of his nine surviving children.

The documents below are the records of the transactions of James McFarland and his sons from 1838 through the lives of the first two generations of McFarland settlers.

 

Land Grants:

James was granted an unconditional certificate dated February 7, 1839 by the Board of Land Commissioners for Fannin County. (copy of original)

On September 7, 1841, he proved to the board that he had resided in the Republic three years and performed all the duties required of him as a citizen. This document was signed by Bailey Inglish, Chief Justice (copy of original)

No. 79 Class second.

James McFarland presents his claim as the head of a family and a married man and made proof by Jackson McFarland and Curtin Journegan two respectable witnesses that he emigrated to Texas in September 1837 and has continued his residence here from that to the present time. Wherefore it is adjudged by the Board that the said McFarland is entitled to twelve hundred and eighty acres of land and that the same be certified.

No. 80 Class second.

Jackson McFarland presents his claim to land as a single man over the age of seventeen years and made proof by James McFarland and Curtis Journegan two credible witnesses that he emigrated to Texas September 1837 and has continued his residence here from that to the present time. Wherefore it as adjudged by the Board that the sd McFarland is entitled to six hundred and forty acres of land and that the same be certified.

 

 

 

The following information comes from HEADRIGHT LAND GRANTS WHICH WERE REPORTED AS
GENUINE AND LEGAL BY THE TRAVELING COMMISSIONERS-JANUARY 1840 (first printed in 1841_
INTRODUCTION in the reprint is by Carolyn Reeves Ericson )

“Grants of land were given numerous names, depending upon the purpose of the grant. HEADRIGHTS were to encourage immigration and reward native citizens. There were four classes of HEADRIGHTS: The first was granted by the delegates who adopted the Constitution of the Republic of Texas in March of 1834 at Washington-on-the-Brazos. It provided "all persons except Africans and their descendents, and Indians, living in Texas on the day of the Declaration of Independence, are entitled to headright grants, if they be heads of families, one league and one labor, and if a single man, 17 years or older, one-third league" (League & Labor = 4,605 acres; 1/3 League = 1,476 acres) To qualify for a first-class headright certificate, the applicant was required to take the following oath:

"I do solemnly swear, that I was a resident citizen of Texas at the date of the declaration of independence, that I did not leave the country during the campaigns of the spring of 1836, to avoid a participation in the struggle, that I did not refuse to participate In the war, and that I did not aid or assist the enemy, that I have not previously received a title to any quantum of land, and that I conceive myself justly entitled, under the Constitution and Laws to the quantity of land for which I now apply."

In addition, it was necessary to prove by two creditable witnesses that the applicant was in Texas on March 2, 1836 and to prove his marital status. He then paid $5.00 for his certificate, half going to the clerk and the rest being divided between the board members present.
Second Class Headright Certificates went to heads of families and single men who arrived in
Texas as immigrants after the Declaration of Independence and prior to October 1, 1837, provided they remained in the Republic three years and performed the duties of citizenship. Heads of families were to receive certificates for 1280 acres and single men a certificate for 640 acres.


The Third Class Headright Certificates were granted to heads of families and single men who immigrated to
Texas after October 1, 1837, and before January 1, 1842. Heads of families under this class were entitled to 640 acres of land and single men to 320 acres.

Land was issued in the following manner: a board of land commissioners was appointed for each county by the combined houses of Congress. Headright claimants appeared before this board, and, if they produced satisfactory evidence of their eligibility, they were given certificates calling for the amount of land they were eligible to receive. Applicants engaged a surveyor who was authorized to locate and survey the land out of the unappropriated public domain. The surveyor usually received one-third of the land for his services and some of the early land barons amassed a fortune in this manner.

The surveyor's field notes were then approved by the county or district surveyor and certified to the Commissioner of the General Land Office, who issued patents. Land certificates for military service were granted through the Secretary of War instead of by a county commission, with the same necessary surveys and filings. The Board of Land Commissioners met at the courthouse every other Thursday, and it was deluged with applicants. The county commissioners bore the brunt of the burden because they had to pass upon the validity of all land claims. The land law was not very clear and in Commissioner Borden's report of April 10, 1838, he stated that "claims are presented in many different ways and 80 very complex in their nature, that no two ordinary men are capable of deciding justly upon them." Many of the claims were fraudulent. In an effort to prevent fraud, Congress passed a law imposing a punishment of thirty-nine lashes on the bare back and a jail sentence of several months upon all persons convicted of fraudulent schemes to obtain land. So many fraudulent headright certificates were issued that it was said that all of Santa Anna's soldiers had crossed the Rio Grande and obtained headrights as veterans of the Battle of San Jacinto.”

Having proved that all the steps were legal, James was granted his patent in 1845.

 

James McFarland:

Patent #264 for 1280 acres.  2nd class grant. February 23, 1845. In the original survey James’ land includes the North Sulphur River, but in a survey dating from the 1870s  it stops short of the river and two plots that include the river are in the names of a Cunningham and a Fulton.

James makes a few other purchases. In 1847 he buys from Morgan Mullens part of the Rice Smith survey for $9.75. (Book G. p. 368) Then in 1853 he buys land in the Davis Creek area from Allen Tilly. (Book G. p. 442)

 

In the 1850 census James and Jane are fam. #217 living with James, 17, Wm, 16, Mary Jane, 14, Newton, 10, and Arthur, 5. James land is valued at $1000. Land is valued at approximately $1.00 an acre. Fam. #216 is Anna McF. Etheridge with husband Howard on land valued at $100. Fam. #218 is Sarah McF. Sebastian with husband Elijah on land valued at $30. Jackson is living with his family #221 on land valued at $1500. Living not too far away is John McFarland, James older brother, fam. #229 living with his wife Mary, daughter Eliza and her husband Francois Deguire. Jasper McFarland is fam. #225 living next to Andrew White, Thomas P. Ratton, and John and Nancy Pence (Artemissa’s father and mother). Jasper’s land is only worth $89. Cintha A. McF. Tucker is living with husband James C. Tucker, but they have no land. Fam. #176 is Rebecca McF. and husband Hezekiah Blankenship, with no land, living next to Albert, fam. #175 who has land valued at $240.

 

Unaccounted for is John Ewing McFarland. On July 7, 1845 James and Jane appear at the Fannin County court to claim a land certificate for 640 acres in the name of their deceased son, John Ewing McFarland. They are issued certificate #152- a 2nd class headright. I assume he is the McFarland son who died in the Indian raid that led to the establishment of the McFarland cemetery. James and Jane hold on to this certificate until February, 1871 when they sell it to O.P. Richardson for $320.00, or .50 cents an acre. The document reads “the land certificate issued by the Board of land Commissioners of Fannin Co. to our deceased legitimate son John Ewing McFarland.” (Book T, p. 199). When this land was finally surveyed in 1874, it was located in Hunt County along the Caddo Fork of the Sabine River, near present day Caddo Mills. In 1875 the formal land grants, #636 and #637, were issued by the State of Texas to the Heirs of John Ewing McFarland. (certified copies of both documents)

 

James then proceeds to give grants to his daughters and sons-in-law. In 1853 he gives Mary Jane and her husband Wm. R. Terry 130 acres of land from Daniel Davis survey, and Allen Tilley purchase. (Deed Book G, p. 444)  He gives Elijah Sebastian, his son-in-law, and his daughter Sarah, a deed of 44 acres, July 28, 1855 (Book L, p. 84.) Hezekiah Blankenship dies in 1852, leaving Rebecca a widow and Jackson McFarland is the executor of his estate (Box 3, Case #114).

 

In the 1860 census, James and Jane are fam. #598 living with Newton and Arthur R. on land valued at $4000, with personal property valued at $2000. Fam. #598 is L. Cunningham, married to Mary Jane McF. Cunningham, who has already buried 2 husbands. They are living on land valued at $300, personal property at $600. Fam. #599 is Elijah Sebastian and Sarah McF. with land valued at $400 and personal property at $200. The Moses Cunningham and John Hulsey families have moved in and bought big chunks of land near by. Jackson is Fam. #586 on land valued at $3000, with personal property of $2000.

 

James and Jane sell 200 acres of their headright to son Newton McFarland for $100 on May 23, 1870. Deed Book T, p. 275

All three documents are the conveyance of land titles to Anna Ethridge, Sarah Sebastian and Arthur McFarland. It seems that James and Jane McFarland wanted to disperse most of their land to their children while they were still alive, knowing that they would not be living much longer.

Sarah is given 156 acres, Anna is given 160 acres, Sarah gives to Arthur 44 acres that she had been given previously in 1855 (part of Rice Smith survey).

 

 

Jackson McFarland:

Claimed Patents #520, #521-320 acres each in Fannin Co., 2nd class grant-File 115, certificate #73 November 21, 1845.

            He also purchased 640 acres for $645 from Reuben Brown Nov. 4, 1845  (Brown’s land grant sits above the Daniel Davis grant.) Fannin Co. Deed Records, Book I, p. 386.  So by 1845, Jackson already had as much land as his father received from his original land grant.

 

            Jackson continues to buy and sell land throughout his life, provided a strong land base for his children. In 1850 he paid $176 for 176 acres from the Daniel Davis survey (Book H, p. 509) and in 1855, paid $500 to Allen Tilley for 300 acres on Davis Creek from the Davis survey (Book H, p. 508.) It is from this land that he later gives his son James Franklin his start.

            Jackson sells 55 acres to Robert S. Cox for $400 in January, 1863 from his survey that was next to the Daniel Davis survey (Book N, p. 562.) He then sells 35 acres for $275. to Sarah Fry, also from the same headright. Because the prices are much higher than before, and the year is 1863, while the Civil War is occurring, I assume the payment was is Confederate money.

            The end of the war brought depressed land prices, because in 1867 Jackson purchased 200 acres from Louisa Ann McClure for $55.00 from the Joseph English survey.

            In September, 1867 Jackson “gives to my beloved son John Win McFarland (Ewing) 300 acres for $1.00 from the Daniel Davis survey on the north line of the James McF. survey. (Book P, p. 235)

           

Albert McFarland:

A 4th class certificate #94 for 320 acres is conditionally granted to Albert McFarland, a single man, who attained 17 by October, 1841. (According to the McFarland family Bible entry, Albert was born November 10, 1824-so actually he was one month short.) This is dated April 4, 1842. The survey is done in Sept., 1842 and the land borders Jackson McFarland’s and Caleb Wood’s surveys on the south side of the North Sulphur River, near the Hunt County line. On January 5, 1846, file 598, Albert is issued Cert. #96, which states that he is now entitled to this land unconditionally and it is a 3rd class grant. Finally, the Patent #446 is issued on May 18, 1852 for the surveyed land. It is signed by Governor Bell of the State of Texas. He sells land from this patent to A. Dillingham for $140 in 1853. (Book G, p. 434)

 

On April 12, 1852, Albert McFarland appears before officials in Hunt County and declares that he is a family man and living on land at the headwaters of the Middle Sulphur that appear to be vacant and he is filing for a preemption grant. On July 27, 1855 it is verified that he has been there for three years and a survey is done. The land is for 125.89 acres in Hunt County, next to the lands of S.D. White and J.D. Goodman. The patent #944 is issued and signed by Governor Runnels in January, 1859.

 

Albert has a rather confusing record. He appears in both the Fannin Co. and Hunt Co. census in 1850, and the ages and wife and children are hard to decipher with certainty. In the Fannin Co. census, on January, 1851, he is living on his land and his sister Rebecca McF. and husband Hezekiah Blankenship seem to be living on Albert’s land also. In October, 1850, an Albert Mcfarling, born in Missouri also, is living in Hunt Co. This Albert is the same Albert that appears in the 1860 census in Hunt County, and his children are mentioned in later court disputes involving James and Jane’s land disposition in the 1870s. I am not sure if there is one or two Albert McFarlands.

 

Fannin County:  Albert sells 320 acres of the Walter Pool headright for $85 to Edward S. Groves in November, 1853. (Book K, p. 421) Albert then sells part of his claim to Hezekiah Blankenship, his brother-in-law for $180. (Book H, p. 235.)

 

Hunt County:    Albert is appointed as overseer of road building in Hunt County in 1860. Albert dies in the Civil War in 1862, shortly after joining up with the 22 Texas Cavalry. The fight over Jane McFarland’s will is carried out by his heirs.

 

Jasper McFarland:

On Feb. 7, 1853 the Texas Legislature passed an act concerning preemption land claims. It was surveyed on Nov. 20, 1853, and on Nov. 24, 1856 Jasper was granted preemption certificate #15 for 177 acres on the waters of the North Sulphur that adjoined the headrights of Reuben Brown, John McConnell, and Wm. K Bridge. This is witnessed by R.W. Lee and James R. McFarland. This is finalized when he gains Patent #365 for this 177 acres on November 3, 1857, signed by Governor E. M. Pense. This land would be adjoining where Jackson had built his home on the Reuben Brown survey.

In 1853 Jasper paid $88 for 177 acres from W. S. McClure from the Reuben Brown and McConnell headrights. (Book G, p. 316) All 177 acres of land is then sold in February, 1857 by Jasper and wife Clarissa to Susan A. Hunt $350 in cash and another $350 in promissory note. Book L, p. 399. A tidy profit!

Jasper moves to Hunt County, near Caddo Mills and Clinton, and is present there in the 1860 and 1870 censuses. Later Jasper acquires Patent #515 on Oct. 8, 1887 for 41.4 acres in Hunt Co.

 

 

On Fannin County census in 1870, p. 265

James and Jane are living as family #99 on land valued at $2000 with their widowed daughter Sarah Sebastian and her children. James Tucker, son of Cinthia Ann McF. Tucker (deceased), age 17, is living with them.

Arthur is shown as family #98 on land valued at $1200, age 26 married to Mary E, age 30, from Illinois, with three children using McFarland name: James F. 3, Lillian E. 5, and Edwin age 1.

Newton is family #97 living on land valued at $1200 with wife Sarah C., children Columbus, 8, James R, 6, William A. and Mary Jane, aged 3.

Anna Ethrige (different spellings appear in different documents) and husband Howard are family #96 living on land valued at $1000.

 

Land in this area must be valued at $6.00 an acre in 1870.

 

Therefore it can be seen that James and Jane had divided sections of the land grant and given them to their children who were too young, or female, to have acquired land from the Republic of Texas.

 

Living not far away, Jackson McFarland is family #116 living on land valued $8500. Jackson has acquired several properties, but is not living on his own patents, instead is living on the land he bought from Reuben Brown in 1845 which sits just north of Hwy. 1550 at FM 3475.  He is living next to Andrew White, a friend who had also come down from Missouri and received a land grant. James’s brother, John McFarland (82 yrs.) is family #110, living with daughter Emily Pettit (44 yrs.). John’s land is valued at $2500, and Emily’s is $2000. They are living up the #3475 road in the Flag Springs community, north of Jackson’s home.

 

Rebecca McFarland had been married to Hezekiah Blankenship living on land belonging to Albert McFarland in the 1850 census. Albert sold them land, Book H, p. 235. Hezekiah dies in 1852, and the original record of the probated estate is also found in the Probate Box 3, Case #114 in Fannin County Courthouse. It states that he died in testate on Oct. 13, 1852 with an estate of  about $1500. His wife, Rebecca Blankenship is requesting that the estate be administered. R.W. Lane appeared to collect a note of $18.56 in January 1854, and Albert McFarland came to collect on one plow and one covering for coffin, dated March 9, 1854. Jackson signed this document as County Commissioner.  Rebecca marries George Wilkerson. In 1870 they are living on land valued at $2000 that appears to be hers. She owned a total of 340 acres. She was living in the Woods Community near the Harpers.

 

Jasper McFarland is living in Hunt County in 1870 on land valued at $2000.

 

Son William died in 1852. Their other son, James was on the 1850 census at age 17, but not located in Fannin County in 1860. There is a James McFarlan in Collin County near Farmersville, age 28, born in Missouri, married to a Mary, age 25, born in Illinois. This could be him.  According to family stories he died coming home from the Civil War. James appears to be the J.R. McFarland that enlisted in 1861 in the 14th Brigade, and then in the 22nd Texas Cavalry, Co. C.

 

Cannot find Albert’s heirs in the 1870 census, although they certainly are in the area because they appear in the various lawsuits.

 

 

Court Cases and Decisions Concerning the Inheritance of James McFarland

 

James McFarland died on October 18, 1871 without making a will. Jackson and Jasper went to court on November 27, 1871 and requested to be appointed administrators of their mother’s estate, saying she said she did not want to handle it. The estimated worth was $10,000. (Box 16 Case #507-Lawyer was H.W. Lyday) Jane McFarland and her children signed an agreement on Dec. 13, 1871 that released the property to Jane during her natural life. That included the 302 acres from the James McF. headright (the homestead), 32 acres headright of John McConnel, 291 ¾ acres headright of M.H. Ragsdale of Hunt County on the waters of South Sulphur, and then horses, cows, hogs, farming implements., etc.  It was signed by everyone except the heirs of Albert McFarland.

Jane Jackson McFarland died May 14, 1872 with the following will; however the children who were left out of Jane’s disposition of land disputed the will and the following documents were found in Fannin County and Hunt County files. I am putting them in chronological order.

WILL OF JANE (JACKSON) MC FARLAND - WIDOW OF JAMES MC FARLAND

The State of Texas                             

County of Fannin

In the name of God, Amen.       

 

I, Jane McFarland, of said county and state being of sound mind and  memory and considering the uncertainty of this frail and transitory life, and certainty of death, do therefore make, publish, ordain and declare this to be my last will and testament, that is to say;

 

First, after my lawful debts are paid, then the rest, residue, and remainder of my estate both real and personal consisting of such property as was set aside for my use and benefit as surviving widow of James McFarland, deceased by referees duly chosen by mutual consent to superintend the distribution of said estate between the parties legally entitled to receive the same to be disposed of as follows:

     To my son, Jackson McFarland, I give and bequeath the sum of twenty-five dollars.

     To the heirs of Albert McFarland, I give and bequeath twenty-five dollars.

     To Robert Tucker, heir of Cynthia Tucker, I give and bequeath the sum of twenty-five dollars.

     To my daughter, Sarah Sebastian, I give and bequeath the sum of twenty-five dollars.

     To Anna Ethridge, I give and bequeath the sum of twenty-five dollars.

     To Rebecca Wilkerson, I give and bequeath the sum of twenty-five dollars.

     To Mary J. Cunningham, I give and bequeath the sum of twenty-five dollars.

     To my two sons, Arthur and Newton McFarland all the rest, residue  and remainder of my estate as set aside by said referees, and otherwise  disposed of by me prior to my decease consisting of land, horses, cattle,  hogs, oxen, farming implements, corn, oats, household and kitchen furniture, wagon, cash on hand, and any and all other property that I now have or may  have at the time of my decease, to be taken charge of by my said sons, Newton  and Arthur, and divide equally between them upon such terms as they may agree.

      Likewise, I make, constitute and appoint my said sons, Newton and  Arthur to be executors of this my last will and testament and hereby revoke  all former wills by me made, and said executors shall at the time of my decease take charge of all my effects, and dispose of them as they see proper, becoming responsible to each of my heirs for the amount herein bequeathed to them respectively, and my said executors shall within twelve months time, from time of my decease pay over to James H. Hulsey, the amount of two hundred dollars with instructions to divide the same equally between the eight first named heirs.

Will filed May 18, 1872, four days after Jane’s death. The will must have shocked the rest of the children, and they called in outside help to work out an agreement.

 

 

II. Referees investigated the properties owned by the children and filed their proposal for distribution on August 31, 1872

III.      Contest of application of will filed Sept. 6, 1872.

Application by Newton McFarland and Arthur McFarland to probate Jane McFarland will. (Arthur and Newton do not want to go by the distribution created by neutral parties, but instead want Jane’s will carried out.)

 

Summary: Contested by Jackson McFarland, Jasper McFarland, Sarah Sebastian, Anna Ethridge, Mary J. Cunningham, and the heir of Cynthia Tucker, all heirs of Jane McFarland.

The above heirs state:  the will was written at a time when Jane McFarland was old and infirm, as stated before the will was contested, and the court awarded each child equal shares.

 

IV. September 14, 1872

 

Arthur McFarland — VS — the heirs of Jane McFarland — Filed Sept. l4, l872

 

     Arthur states the other executor named in Jane McFarland’s will was son Newton McFarland, that Newton departed this life on the 2nd day of Sept. 1872 at his residence in the County of Fannin, State of Texas.  That his mother, Jane McFarland was about 70 years of age when she wrote her will, was born on the 5th day of February 1801, and had for several years before her death been in delicate health, but was not weak in mind when she wrote the will.  Newton McFarland moved into the house of his mother at her insistence after the death of their father, James McFarland.

 

V.  In Box 16 Case #527 is 62 handwritten pages of testimony given before the probate court  concerning Jane’s will and state of mind when she wrote it. This is dated January 25, 1873. In summary, all the neutral witnesses to Jane’s health and mind, and her free choice concerning the disposition of her property, testified that although they were somewhat surprised by how she left almost everything to Newton and Arthur, she knew exactly what she was doing. Dr. H.J. Henderson, the family doctor who had known and treated everyone in the family since 1862, testified that he met with her many times before and after she signed the will, and that she was of very sound mind. She was up to date on current events, and could discuss Scripture as well. She had been told (probably by Jackson and Jasper) that she could not dispense the property while she was still alive, but when she learned otherwise, she decided to write this will. She told her doctor and the other witness (S.D. Johnson) that her older children had received much more help from the parents than the youngest, and in the last years it was the youngest who took care of the property. Therefore she wanted Arthur and Newton to receive the bulk of the estate. (p. 5 of the testimony)

In Nov. 1873 Jackson paid James R. Tucker $300 in gold for his undivided interest in the estate of James McFarland. (Book W, p. 55)  Then Jan 1, 1874, Jackson paid W.S. Mayo and wife $83. for their interest in the disputed inheritance. (Book W, p. 236.)

 

In Book Z, p. 605, Arthur and Mary E. McFarland are selling his rights to 73.5 acres of the 302 acres to B. N. Browning for $300 in gold coins, $300 in a promissory note, and $280. in a 12% interest bearing note. This is in 1873.

 

 

IX.   1874:     Deed Record found in Book S, p. 196-199, Hunt Co. between Heirs of James and Jane McFarland over Land Distribution. Grantee is Jasper McFarland and Grantor is Sarah McFarland (wife of Newton McF. Deceased.)

Before me G.J. Mayo Justice of the Peace and Notary Public in and for said county of Fannin devsmaccy (?) came L. T. Cunningham, Arthur Mcfarland, Sarah Sebastian, Sarah Mcfarland, Executrix, and Howard Ethridge to ….known by whom the foregoing  and bearing date July the 9th 1874 appears to have been executed and acknowledged that they Executed the same for the consideration and purposed therein Stated, also came Mary J. Cunningham wife of L.T. Cunningham and Anna Ethridge, wife of Howard Ethridge and having the same by me fully explained to them and being by me examined separate and apart from their said husbands acknowledged that they signed the same of their own free wills and accord without the fear of or my undue influence of these said husbands and wish not to retract it.

What all this means is that, using the figures that divided up the estate and all properties and gifts that the referees came up with in 1872, the children Jackson, Jasper, J.R. Tucker, Rebecca, and Albert’s heirs paid to the other children Sarah Sebastian, Anna Ethridge, Arthur McFarland, Sarah (Newton’s wife), and Mary Jane Cunningham—cash for the amount valued for their apportionment in land so they became the owners of the disputed land.

 

 

July 21st, 1874: Arthur petitions the court to sell 15 acres because he needs the money. (Book H, p. 559) Then on September 18, 1874 he is petitioning the court to sell his inheritance. (Book H., p. 545)

Sarah, the widow of Newton is petitioning the court to sell the land that was willed to her family by Jane and then Newton.

 

So I am not sure what happened with the agreement signed by everyone in Hunt County.

In August 1875, Jackson bought out C.J. and her husband Wm. M. Farmer’s interest, as well as sibling’s Mary A. McFarland and W. P. McFarland. These are the heirs of Albert McFarland, deceased. Deed Record Book Y. p. 438

 

 

XII. The Conclusion

 

In Book Z, p. 247, dated January, 1876 is a private sale by the court of Arthur’s inheritance to Jackson for $1850.

 

In February 19, 1877 Jackson conveys to his daughter Nancy Jane Cunningham 160 acres from the Bridges and Whittenburg surveys for $1.00. Deed Record book 14, pp. 458-59.

 

On September 2,1878 Sarah, who married again after Newton McFarland’s death in 1872, goes to court to get a final disposition of the funds- I assume, her half of the money received from Jackson’s purchase of the land, and the case over the estate of Jane McFarland is finally closed. (Deed Record Book I, pp. 513-514)

 

As late as 1878 Arthur was planning on being in Fannin County because he was named as a trustee for the school and cemetery at Oak Ridge in a court document dated June 19, 1878. However, new territory had just opened up in West Texas and Arthur, as well as his cousin from Missouri, Charles McFarland, and Joel T. Hulsey were interested in moving. Arthur and Mary Ellen leased their homestead property to E.E. Futch for $1100 for 5 years from 1880 to 1884, based on a promissory note signed on August 14, 1879. (Book 6, p. 65) and leave Fannin County.

 

In 1880 Arthur’s family is settled in Coleman County, Texas, living near Charles Newton McFarland, grandson of John McFarland (brother of James) and the son of Newton and his wife Mary Catherine Pettit. Another neighbor of Arthur’s is Joel Thomas Hulsey (who is son of John Wesley Hulsey) and his wife Anna Rebecca Pettit (daughter of Mary Emily McFarland Pettit- therefore granddaughter of John McFarland.) What a tangled web!!

 

On June 5, 1880 in Coleman County, Mary E. and Arthur McFarland signed a deed acknowledging the sale of their homestead in Fannin County of 126 and 2/3 acres to Jackson for $1650. (Book 8, p. 97, 98) This seems to be a very generous amount- over $12.00 an acre. Jackson may have been afraid that the land would go to the family who was leasing the land.

 

Jackson sells to his son Cyrus Sylvester various lands, the 126 and 2/3acres from the Arthur deed (various bits on McFarland Creek including 44 acres from the Rice Smith survey, and 82 acres from the James McFarland survey), and another 640 acres, the headright of Wm. Griner for $2000. The date is Oct. 14, 1880. (Book 8, p. 393)

 

For $1000 Jackson then sells to Artemissa on October 26, 1880 the rest of the land he had acquired from Arthur back in 1876. In particular was the 302 acres of the original land grant that was now owned by Jackson. This document was signed by Arthur and Newton Jackson and filed for record on October 23, 1884 after Jackson’s death. (Book 18, p. 410) It seems that Jackson, who died August 14, 1883, wanted nothing to do with Wills and was disposing of property by deed instead. It is interesting that he was deeding it to his wife Artemissa, so she could do with it what she pleased.

 

Deed records show that Sarah Sebastian deeded to F. F. Sebastian land on Sept. 1, 1883 from the James McFarland land grant, Book 19, p. 135.  Then it says that F.P. Sebastian and wife Mary Jane on Sept. 22, 1885 conveyed it to N. J. McFarland, in Book 21, p. 326-327.

 

 

In 1880 census records: The McFarlands are living in Prec. 4, Fannin Co., Dist. 26

 

Newton McFarland’s descendants: living on their farm. Newton’s wife Sarah Tucker has remarried, to W. L. Luster born in Ohio. They are family #285, page 433. C. A. (Columbus Arthur) is adding to his inheritance and buying 25 acres from the original James McFarland survey for $76. on Nov. 21, 1880 (Book 18, p. 142) Then in April 1883, C.A. purchases another 25 acres from the James McFarland survey for $125 from O.L. Gilson. Deed Record Book 14, p. 430.

 

John Etheridge, child of Anna McFarland and Howard Etheridge is fam. #382. James Blankenship, son of Rebecca McFarland who has now remarried and moved to Oklahoma, is fam. #215.

 

John Ewing, son of Jackson, is fam. #420, p. 435. On the same page is Nancy Jane, married to William Wylie Cunningham, and Mary Jane McFarland’s descendants from her marriage to L.T. Cunningham.

 

James Franklin’s family is fam. #459 on p. 437 living on land purchased by Jackson originally from the Daniel Davis survey, next to three Hulsey families.

 

Missing in the census records are Artemissa and Jackson as well as Newton Jackson McFarland. Were they traveling? We know they were living there because of the various deed transactions, but somehow they missed the census takers or the page where they are listed is missing from the records.

 

 

Artemissa Pence McFarland died on July 6, 1907. The children, probably remembering well what their parents went through in the 1870s, amicably divided the land she had “bought” from Jackson, and confirmed the division with a series of deeds. In consideration of a sum of $1.00 each:

            To Cyrus Sylvester went one acre from J.T. Hobbs survey, next to Jackson McF. survey. Also another one acre tract from the Hobbs survey. (These would be in the town of Ladonia.) Also 40 acres from the Jonathan Voyles survey. Also 230 acres of the Jackson McFarland survey, Patent No. 521 that is adjacent to Daniel Davis southeast corner. (The other 90 acres of that 320 survey had been deeded to R.S. Cox by Jackson McFarland many years before.) Deed Book 105, pp. 600-601.

            To Newton Jackson McFarland went the 302 acres that had been the disputed land from James’ headright, inherited by Jane McFarland. Deed Book 105, p. 602

            To Nancy Jane Cunningham and husband William Wylie Cunningham went 309.68 acres, part of the Reuben Brown survey. This was the land Jackson and Artemissa had made as their home. Deed Book 111, p. 430.

 

 

 

Arthur McFarland in Coleman County

 

            When Arthur and Mary McFarland moved to Coleman County they both filed for land grants in their own separate names.  In 1873 the Texas Legislature passed “An Act for the benefit of Actual Occupants of the Public Lands.” It is under this act that Arthur and Mary filed for two land grants of 160 acres each in Coleman County.

            On August 21, 1881 Arthur appeared before the District Court of Coleman County and applied for 160 acres of vacant land from the public domain of the State of Texas, claiming that he was without a homestead of his own. On August 25, 1884, the formal Proof of Settlement under Homestead Act was issued granting the surveyed land to Arthur. The survey for this land places it on the waters of the South Jim Ned Creek in Coleman County, and it is called a Pre-emption Survey #154. Then on September 9, 1884, Arthur and Mary E. sell this pre-emption land to D.F. and W.B. Roddan for $200. (copies of the certified documents) If you check on a current map of this area, it is filled with oil wells- I wonder if any are there!!

            In June, 1882 Mary E. McFarland purchased 160 acres for $125 as part of a pre-emption survey that had originally been surveyed for W. D. Wyatt in 1879. It was called  pre-emption survey #137. It is located on the Jim Ned Creek also. The document states that Mary E. is an assignee of W. D. Wyatt, and together with Wyatt and his wife Nancy A.  has occupied and improved the homestead for a period of three consecutive years, beginning in Sept. 1879. She claims in this document that she does not have a homestead other than the above. A notarized document dating to April, 1884 acknowledges the transfer of the pre-emption survey in exchange for a “valuable consideration.” The final patent #519 is issued on May 23, 1884, and signed by Governor John Ireland.

 

I feel that Wyatt is somehow related to the Terry family. I found it strange that both Mary and Arthur could file for pre-emption land grants and wondered if they were not living together, although no one in the family indicates a separation. Arthur sold or granted his land in Coleman County and moved to Indian Territory around 1888. More research needs to be done.

            Of all the McFarland land granted, bought, and sold over the years, only a few of the original acres of James and his children are still in the hands of McFarland descendants. James Franklin McFarland added to his 176 acre gift from his father Jackson over the years until it had grown to over 3000 acres in Fannin and Hunt Counties. That land provided for the children’s college educations and foundations in various businesses such as the First National Bank of Ladonia and the Pecan Gap Cotton Oil Company. At his death the land was divided between his nine living children, and helped provide the foundation for their families. By the 1960s, however, they had all sold their inherited lands. Cyrus Sylvester (Bose) McFarland’s land and investments provided well for his two children, Ethel and William. They had no blood descendants, but used their wealth to enrich Texas Christian University, and various relatives, with their behests. Ethel also gave Ladonia Cemetery the funds it needed to purchase the grounds now named the McFarland section. John Ewing McFarland’s children were raised on his farm in nearby Silver City. His descendants are scattered throughout east and west Texas. Newton Jackson McFarland continued to farm his land, raising a large family and dividing the homestead inheritance among his many children. Ambrose Sylvester McFarland farmed the main homestead land during his lifetime. The McFarland cemetery was in part of that land. Today, Agnes Churchwell Breedlove still owns 20 acres of James’ original land grant. Twenty acres of Jackson and Artemissa’s land from the Reuben Brown headright, passed down to Nancy Jane and William Wylie Cunningham, is also in the hands of their descendant, Rhonda Cunningham Shinpaugh.
