Notes for JOHN HARVEY GRAY: John Harvey and Mary Elizabeth Ivey (Gray), along with seven of their nine children, moved to Allen, Indian Territory, in 1907, immediately before Statehood. They came from Marcella, Stone Co., Arkansas, by passenger train, but chartered stock cars for all their livestock, farming tools and household items. Since Allen was some two years away from a proper railroad, they arrived in Calvin, Oklahoma, where they were met by two of John's brothers, Johnanthan and Dave Gray. Johnanthan was a farmer and Dave owned a General Merchandise store in Old Town Square. John Sr. was a farmer, stockman and a trader. Their first home was in Old Allen. They sold that house to Dr. Rose, and John bought 360 acres of land seven miles south of Allen. Highway 48 runs through part of that land today. Both Boggy and Sincere Creeks ran through the land. He began buying and clearing until he owned 1600 acres. John built a large 6-room house with a front porch which ran the width of the house. The windows in the attic gave the house the look of a two-story dwelling. The land John cleared was virgin land and very productive. A renter , Will Cross, was an especially good farmer. He planted the middles in corn, thereby raising two crops of corn on the same land in the same year! John had some trouble with the law in the 1930's, it is said a hired hand named Charlie Long made a obbnotsh comment to his daughter Janie, John told him to appolize, the man picked up a rock and John shot him twice. He was in prison about a year, I don't know how he got out or settled thing. Another story said it was during the middle of the night (Winter) and the stove ran out of wood so John's best friend went out and got some wood, John thinking someone was trying to break in, shot him. After all this Jim Hays was never a member of any church until he was 87 years old and was baptized July 11, 1954 in the First Christian Church of Fontana, California. Until this time I can remember him telling me that "God was everywhere and didn't have a house that you were required to attend to be saved. All you had to do was treat all people equal and fair and God would know you as a good person. Following are some stories told to my Aunt Selma Lee Hays Howerton by her Dad My great grandfather James Harrison Hays. 1. WAGES HAVE SURE GONE UP When I was a young man, I started work for a fellow by the name of George Scales- he was the second richest man in Indian Territory. He was a rancher and owned a store. I worked for him for about three years and I got a salary of $20.00 a month, I lived on half of that and sent the other half to my mother. I finally got a job working for the Government Survey and thought I had the best job in the world....I was making $40.00 a month! 2.THE ODDFELLOWS MEETING Our school superintendent, a fellow by the name of Montgomery and myself, went to an out of town meeting of our lodge as it's representatives. As a courtesy, they ask the guest to speak. Montgomery got up and made a real inspiring talk and expressed his thanks for the nice session we had just attended. They then asked me to speak...since Montgomery had covered our local activities, I couldn't see any sense in my repeating it all over again - - - so I got up and said, "Since brother Montgomery has described our activities, I don't believe there is anything I can add to what he said. You see, he and I are like the story in the Bible where Moses was called on by the Lord to attend a meeting, but Moses complained he had no delivery of speech; so the Lord sent Aaron with Moses to deliver the words as they came from Moses heart. It is much the same with my lodge brother and me....I do the thinking and he delivers the speech. Everyone was so tickled that they didn't have to sit through another long speech, that I got bigger applause than Montgomery did for his fine speech! 3. THE WIFE GOT MAD! It was at another Oddfellows meeting, I got up to talk and saw the cuff on my shirt was frayed with some strings hangin from it. I held up my arm and said " Look here, my wife forgot to take the scissors and trim my cuff before I left home." Everyone laughed - but some big mouth told the little woman and she didn't share in the humor. 4. SHERMAN SURE CAN RUN. We lived on a farm in Canute Oklahoma and always had a big bunch of boys hanging around. One of my own boys, Sturgeon, was just scared of his shadow; he got in the habit of going across the creek every night with another boy by the name of Bert Campbell, he was a bigger scaredy cat than Sturgeon. They would go down to the Dobb's tent, a sharecropper that lived across there and they would play poker and not feel like working the next day. One night I talked Sherman and Frank Campbell into going down there and scare the other boys. I woke up and none of them were home yet so I just left my night-shirt on and pulled on my shoes and walked down there, just as I walked up, I saw Sturgeon and Bert running. I hid behind a tree to watch the fun. Frank ans Sherman were laughing as I walked up behind them and tapped Frank on the shoulder.....he took off running too! When he ran by Sherman, Sherman just fell on the ground laughing even harder, just as I was about to speak, he jumped up and started running and telling too. The next morning Sherman said to me, "Dad, Frank and me scared them boys alright, and then something scared Frank and he came running by me I fell to the ground laughing when I looked up and saw the longest, whitest thing I ever saw in all my life, I beat all three of them to the house." THOMAS and ANNA RAIL do not appear on any other census reports or other records that I have searched. I am not sure where this family was living during the 1840's and 1850's. The three known children surface again in 1860 in the St. Louis, Missouri and Bellville, Illinois area. ANNA GOODMAN RAIL 1826 - ? Oakdale, Washington Co., Illinios-------part 1, page 541 THOMAS HOUSTON RAIL THOMAS HOUSTON RAIL's Civil War records indicate that he was in St. Louis County, Missouri in 1860. There is a copy of an affidavit signed by him dated April 14, 1893, stating that in April 1860 in St. Louis County Missouri, he accidentally cut his foot, with an axe, while cutting logs. Not too far away in Clinton and St. Clair Counties, Illinois, His brother R.J. RAIL. R.J. owned property in Clinton County, IL. There is copies of THOMAS HOUSTON RAIL and his brother RICHARD JACKSON RAIL's Civil War Records. They both entered the Union Army as privates at Trenton, Clinton County, Illinois on August 14, 1862 and reported to Camp Butler. They were mustered into Captain Randall's Company E, 117th Regiment, Illinois Infantry. Both served until 1865. THOMAS was nineteen years old, five feet four inches tall with blue eyes and brown hair. His date of birth was listed as April 16, 1843 at Maury Co. Tennessee and his occupation was listed as farmer. THOMAS served in this unit for the entire time that it existed, three years. There were sixty-eight enlisted men from Clinton County, Illinois in this unit. The regiment was organized at Camp Butler, Ill. in September 1862 by Col. RISDON M. MOORE, and Captain WASHINGTON, U.S.A. The unit left Camp Butler on November 11, 1862 for Memphis and remained there until July 5, 1863 when it went to reinforce Helena, Arkansas. In December they pursued General FORREST in western Tennessee, losing three men in a skirmish at Lafayette, Tennessee. Later they served at Vicksburg and Meridian, Mississippi, and were involved in the Red River Expedition and the capture of Fort DeRussey. They then served in the battle of Pleasant Hill and Grand Ecore. On April 14, 1864 they offered relief to the gunboats and transports at Campti, Louisiana and were engaged at Cloutierville, Cane River, Bayou Rapids, Governor Moor's plantation and Bayou Roberts. During their return march to the Mississippi they were involved in daily skirmishes. They were in the battle at Yellow Bayou and reached the river on March 20 and Vicksburg on March 27. The unit also helped Marmaduke from Chicot Lake and Columbia, Arkansas and returned to Memphis on June 10, 1964. On June 23 they returned to the battle at Tupelo and Old Town Creek. On July 14 they were engaged at Oxford and Hurricane Creek and returned to Memphis on August 30. For a short period they were ordered to Jefferson Barracks, Missouri and were engaged at Franklin, Jefferson City, Sedalia, Lexington, Independence, and Harrison. They returned to St. Louis on November 19, 1864. On December 1, 1864 they were moved to Nashville, Tennessee for the battle of Nashville. In the pursuit of Hood, they reached Clifton on Jan. 4, 1865. They were in New Orleans in January, Dauphine Island in March, and then moved to the Fish River. In late March and April they fought at Spanish Fort and helped capture Blakley. On April 13, 1865 the regiment marched to Montgomery and then back to their home at Camp Butler, Illinois. They were mustered out on August 5, 1865 by Captain JAMES A. HALL. During their service the 117th Regiment traveled by rail 778 miles, by water 6191 miles, and by marches 3207 miles. They were engaged in six battles and thirty-three skirmishes. THOMAS HOUSTON RAIL's military records indicate that he was promoted to corporal in April of 1864 and state specifically that he was involved in battles at Tupelo, Miss., Hurricane Creek, Miss., Franklin, Missouri, and Blakely, Alabama, Clinton, Miss., Ft. DeRussey, LA., Pleasant Hill, LA., Marksville Prarie, LA., and Yellow Bayou, LA. After THOMAS RAIL's discharge from the army his life becomes more difficult to follow. He married SARAH ANN McCAULEY after his military service was completed. I believe that they were married in St. Louis, County, MO. Their oldest son RICHARD J. RAIL was born there in1869 and wrote in his biography that they lived there until 1876, when they moved to Arkansas. SARAH McCAULEY died in Marion County, Arkansas July 3, 1876. They lived about ten miles northwest of Western Grove in a house that they rented from a NEWT. CASH, a farmer that lived near them. Various records have THOMAS working as a farmer in White, Logan, Searcy, and Conway, Counties during the next several years. He worked at the wheat mill near Marshall, AR. and for a time worked and lived at Bruno, AR on the farm of NEWTON BOSH where he worked as a cropper. In 1878 THOMAS became a Methodist / Episcopal Minister out of the Russellville, Arkansas Conference. The Arkansas 1880 census has this family living in Mountain Township, Logan County, Arkansas. This census report offers a lot more information about the family. It shows that THOMAS HOUSTON RAIL was born in Tennessee , Nov. 1842 ( I believe it should be April, 1843 ), and that both of his parents were born in Tennessee. SARAH JANE STRANGE RAIL is listed an born Sep. 1851 in Alabama and both of her parents were born in Mississippi. There is a copy of an affidavit dated 1893 stating that THOMAS is fifty years old and lived in Cleveland, Conway County, Arkansas. Other affidavits have him, at age fifty-two, (1895 ), and age fifty-five ( 1897 ) living in Scotland, Van Buren County, Arkansas and in 1899 and 1904 living in Russellville, Pope County, Arkansas. According to a biography written by his oldest child, RICHARD J. RAIL, in 1935 the family lived in St. Louis County until 1876 when they came to Arkansas. That places THOMAS in Searcy, White, Logan, and Conway Counties during the next several years. THOMAS worked as a farm laborer and in 1878 he became a Methodist / Episcopal Minister in the Russellville, Arkansas Conference. He worked as a circuit rider in Arkansas, Indian Territory and Texas until about 1900. He then settled in Little Rock and then moved to the Morrilton area until his death in 1901. My mother recalled that he preached at Ada, Adona, Casey, Morrilton, Fort Smith, Russellville, Atkins, and Clinton, Arkansas, Bonham, Texas, and several places in Indian Territory (Oklahoma). One of the most informative documents that was found is a deposition given by SARAH JANE STRANGE RAIL on January 19 1907. She stated that THOMAS has two brothers R. J. and ERV ( Ervin or Irving ) RAIL and a sister ELIZABETH RAIL DAVIS. She further states that R.J. is a cripple that he lives in Shawnee, Oklahoma and she does not know the location of the others. She said that their parents died when they were young. She also says that she has two sisters in the Judsonia, Arkansas area. Their names are LEMINDER (?) LITTLE ( or SETTLE ) who is married to MARION LITTLE and a JOHANNA BABER. The Searcy County Court House was destroyed by fire in 1880 and all marriage records were lost. Oct. 13, 1869 - From the Columbia Herald: "Bloody Work: A desperate and bloody affray took place on Helm's Branch, in the eastern part of town, last Saturday evening about 3 o'clock, between a man named RAIL, constable in the 1st. Civil District of the county, and a man from Giles County named Osborne. It seems that Rail, finding a woman in that locality barefoot, took her a pair of shoes. The shoes were brogans, and TAYLOR of Pulaski, laughed at them. Rail and TAYLOR had quarreled about this and OSBORNE came out to see what was going on. Rail thinking OSBORNE was coming to help TAYLOR drew his pistol. Osborne struck RAIL with a stick and RAIL shot him in the arm. OSBORNE then fired his pistol and struck RAIL in the abdomen. It made me think of the many times that I had partaken of the hospitalities of not only Uncle HENRY, but all the OAKLEYS, than whom a better set of men never lived. It not only reminded me of the OAKLEY family, but of the HARBISONS, the FLYS, the RAILS, E.J.SPENCER, GEN. WILLIAMS, JOHN POTTS, Esq. BAKER, and the balance of mankind, and a sprinkle of the womankind. Then I remembered that in one of my canvasses they gave me every vote in precinct No.1..." The shoes were brogans,and Taylor of Pulaski, laughed at them. ...Rail and Taylor had quarreled about this and Osborne came out to see what was going on. Rail thinking Osborne was coming to help Taylor, drew his pistol. Osborne struck Rail with a stick and Rail shot him in the arm. Osborne then fired his pistol and struck Rail in the abdomen. "A story told by Leona SHANDY JOHNSON in 1964 stated: Nancy RENDLEMAN, with her husband, Jacob SHANDY, moved from NC to Floyd Co., IN, shortly after they were married. There the new people and the new ways gave Nancy some trouble. The language had changed from what she knew at home; the word "threshold" was one she never quite got used to. Land on the other side of the state offered more comfort and profit, so they journeyed into Dubois Co., IN, and there the younger children were born. The call of opportunity further west still enthralled Jacob, so he gathered his family and belongings and started down river for Missouri. In 1857, they settled on good land in Atchison Co., MO, the extreme northwest part of the state where the town nearest them was Phelps City. Jacob established a homestead, built a store, found a good school and a railroad. His needs were filled. Nancy and Jacob live d there many years, prosperous and respected. Nancy RENDLEMAN SHANDY had a worthy life, a life full of the experience of that time and place. When she was seventy-five, she still had seven children living. Her husband, Jacob, failed from the time of her death, and died at age 77 years in 1881. The Rev. LANGLEY of Watson, MO, was their pastor. His obituary in the Phelps City paper reads; Death of an old citizen, Jacob SHANDY, one of the oldest and most respected citizens...Mr. SHANDY removed with his family to Atchison County in 1853, and has ever since made his home here...he and his wife are buried in the same lot with his son, J. "Granny Shandy" Family tradition has that after Nancy RENDLEMAN and Jacob SHANDY married in 1 825, his mother "Granny Shandy" lived with them until she was over 100 years old. The story handed down was that Granny SHANDY drowned herself in the river because she was 'tired of living' at the age of 106. He was born in Perth, near Edinburg, in Scotland, and in early life emigrated to the United States. David Meeks Elms may have liked what he saw in Texas as a result of his excursion as a member of Capt. Jesse Bean's Mounted Rangers. In 1832 Bean recruited men in Independence and adjacent counties for the purpose of keeping down trouble among the Indian tribes to the west, and between Indians and white squatters on their land. They called themselves the Arkansas Mounted Rangers. In 1832 the Rangers were called to Fort Gibson because of unrest in what was then Indian Territory. From Fort Gibson they traveled through Indian country and may have swung into the northern part of Texas. Besides David Meeks Elms, other members of the Rangers were James and Garrett Elms, sons of Samuel, and Richard, John and William Peel. A young journalist who happened to be at Fort Gibson asked to accompany them, which was granted. This young writer, Washing Irving, memorialized the expedition in his book "A Tour of the Prairies." By the time David Meeks Elms settled in Texas, the Indian tribes had been beaten back and somewhat pacified. However, small bands of young braves would occasionally make forays into white settlements, stealing horses, cattle, even children. In one of these raids, David Luther Elms was the victim of an attempted abduction. Taken to Texas at the age of three by his parents, David Meeks and Malinda Ann O'Neal Elms, he was about 12 years old at the time of the raid. Malinda Ann was of the family who founded the community of O'Neal, a short distance up the White River from Batesville. These O'Neals had first lived on the south side of the river, not far from Thomas Elms, near the present community of Marcella. They were found to be encroaching on Indian land and forced to vacate that side of the river, and had simply moved over to the north bank. The lad David Luther, on that fateful day, had gone with a neighbor toward the hills to gather firewood. Suddenly the mounted Indian's appeared and attacked a nearby farm, killing a man and woman and grabbing two small girls up on their horses with them. They then made for David Luther's wagon, killing the driver and taking the boy up on one of their horses. After a short distance, the larger of the two girls got loose from her captor and started running. The Indians began chasing her, and in the excitement David Luther Elms escaped. These Indian raids continued for some years. As the number of white settlers increased, they began to organize bands of men for protection and to pursue the marauders. These groups began to call themselves Rangers, and among the first of them was David Luther Elms when he became a grown man. He was known by the nickname of "Indian Dave". He lived to be 86 years old, dying at Boise City, Oklahoma, in 1932. A descendant, Charlsie Briggs of Tulsa, remembered her great-grandfather. Notes for CHRISTOPHER ELMS: ELMS FAMILY HISTORY (BOOK) by Charles W. Hutchinson The parents of Christopher Elms were John and Catherine, who, I believe, must have come from Ulster, in the largest wave of Scotch-Irish emigration about 1730, and settled in the "Irish Settlement" on the Conococheague, then Cumberland County, now Franklin County, Pennsylvania. I have found no record of any Elms families in Pennsylvania previously. This settlement was in Antrim Township, most of the early residents having come from the province in Northern Ireland. The "Irish Settlement", as it was called in those days, was a misnomer, as the people were predominantly Scots who had lived in Ireland. In the implantation of Ulster by King James of England, history tells us he invited Scots to settle there, but some English yeoman from northern England were also sent. Later, French Huguenots, fugitives from Catholic persecution about the time of the massacre of St. Bartholomew, were also invited, as they were also Protestant. These three strains intermarried in Ulster during the century or so they lived there, until religious persecution by the Church of England, and also economic oppression, resulted in successive waves of flight to America. Pennsylvania was the only colony offering true religious freedom. All the others, with the exception of Catholic Maryland, were under true domination of the Church of England, from which the Ulster people had fled, or by the Puritans or Congregational churches which were also intolerant of the mostly Presbyterian Scots Irish. In an earlier wave of immigration, five Chambers brothers had arrived in Pennsylvania. One of them, James, established a station in the Wilderness beyond the frontier (now Chambersburg, PA). In the ongoing boundary dispute between Pennsylvania and Maryland, a committee was formed to go to the King in England to tesify and to give their views. One member of this commission was James Chambers. While he decided to visit his birthplace in Antrim. No doubt his stories of land free for the taking influenced his relatives and friends to migrate to Pennsylvania also, and most then settled below his post and mill, toward the Maryland Border. The community, about 1730, became known as the "Irish Settlement" on Concocheague Creek, the largest water in present Franklin County. Greencastle is the nearest town today. This was the residence of Christopher Elms, given when he enlisted in 1758 as a drummer boy, 15 years old, in the French and Indian War. Elms being an English name, it is probable that the first of the name to appear in Ulster were some of the English yeomen previously mentioned, from the north of England, perhaps Northumberland. The name is probably derived from a description of the locality in which they lived. During the French and Indian War, the Scotch-Irish on the Pennsylvania frontier suffered repeatedly from Indian attacks. Some 5,000 of them were said to have been massacred, with hardly a family that escaped losing members. Even after the signing of the peace treaties the attacks continued, for when the war ended the settlers pressed on into Indian lands in southwestern Pennsylvania, despite efforts of the Quaker government to warn them off. It is possible that John Elms, father of Christopher, died in one of these attacks, for in 1759 guardianship was appointed for Christopher and his brother William, minors. No date has been found for the death of John Elms, nor have the circumstances been disclosed. Catherine Elms, his widow, remarried to a Mr. Thompson before 1767, when John's estate was finally settled. The settlement might have been delayed because of the constant Indian troubles. Catherine Elms Thompson's maiden name has not been determined. It could have been Smith, as a William Smith was the one who applied for guardians to be appointed for Christopher and William. It could also have been Morehead, for a John Morehead was an administrator of John's estate, along with Christopher and William. Neither is the maiden name of Christopher's wife Margaret known. It could also have been one of the above. It is certain that there was a connection with the Morehead family, for the will of John Morehead, Antrim Township, Cumberland County, in 1775, names a daughter Ann Elms. Moreheads and Thompsons were numerous and prominent in early Cumberland County. A William Thompson became a general in the Revolutionary War from that area. After Braddock's disastrous attempts to take Fort Duquesne in 1755, when his army was ambushed six or eight miles before reaching the objective, the frontier fell into turmoil with constant Indian attacks. Most settlers fled from their homes and went back as far as Carlisle for safety in more populated areas. Meanwhile the British began preparing another army, one they knew would be strong enough to succeed where Braddock had failed. It took three years to assemble and outfit this force under General Forbes. In 1758 this army took to the road Braddock had carved, passing through the Conococheague area, dipping down into Virginia at Winchester to avoid the mountains, then back northwest toward Ft. Duquesne, from which everyone had evacuated before his arrival. Occupying the fort, Forbes changed the name to Fort Pitt, now Pittsburgh, Pennsylvania. Since Christopher Elms enlisted as a drummer boy that year, 1758, it is possible that he joined Forbes' army as it passed through his neighborhood. John Armstrong Christopher, now age 24, was probably married about this time to Margaret. Her full name may have been Margaret Ann as John Morehead's will in 1775, Antrim Township, Cumberland County, mentions a daughter Ann Elms. After Bouquet's defeat of the Indians at Bushy Run in 1763, and the Treaty of Muskingum in 1766, all white captives were to be returned, and whites were to be restrained from settling on Indian lands. This was virtually ignored by the whites, who immediately began moving into those areas, despite warnings from the English authorities. The governor of Pennsylvania issued a warning "on penalty of death, without benefit of clergy." Still the squatters defied the Scottish soldiers trying to enforce it. The governor appointed a committee to go into the wilderness area and convey his warning. According to the Colonial records of PA, the members of this committee were Rev. John Steele, Presbyterian pastor at Carlisle, John Allison, Capt. James Potter, and Christopher Elmes (sic), Esq., all of Cumberland County. The committee reported back to the governor on April 2, 1768, and gave a list of names of those who had been warned. It was to no avail. Indian attacks increased, culminating in Pontiac's War, and 1770 was the last year in which the name of Christopher Elms appears in Cumberland County tax lists. There's a lot of Hadden's in Logan and Butler Counties, Kentucky. Some related and some (not yet). I descend from a William Hadden, probably not yours, who died in 1818 in Butler County. He had a brother Elisha. Some have theorized that a number of Elisha's children married Hadden's who were the sons of Samuel Hadden of Montgomery Co., Ky. Samuel may or may not be a third brother. I don't know if this will be of much help to you are not, but I have been tracing William and Elisha Hadden through Virginia, Eastern Tennessee (formerly Greene and Washington Co.'s N.C.). From Rockbridge Co., Va. through Greene and Washington Co's there is a man named Keith who is always witnissing deeds for Elisha. I suspect that this Keith was possibly married to a Hadden girl. Good luck. Your Alfred is a kinsman my William Hadden who died in Butler Co., Ky. I went to White Co., Ill. about four years ago researching this branch. One of Williams's sons went to White Co. and died there. William's probable brother Elisha, who witnessesed Williams Will in 1818, removed from Butler Co., Ky to Warrick Co., Ind. then to Clark Co., Ill. from which Coles Co. was created and where he died. William Hadden's son William Jr. married Jane Lanham from whom I descend. The Lanham's also moved to Clark Co. and one of their girls married and lived in Crawford Co., Ill. It is believed, but not yet proved that Samuel Hadden of Montgomery Co., Ky. is a brother to William Sr. and Elisha Hadden. Janie ANOTHER ELMS LINE: 'NOT OURS' The Family of Tree of Charles Elms and Rebecca Withers Elms of Mecklenburg County, North Carolina by Janie Elms Matthews When my uncle Ernest Harris Elms, and I began our search for our Elms ancestors, we could not go beyond his grandfather, William Albert Elms who owned a farm and died in Union County, NC in 1928. Ernest obtained a copy of William's death certificate that listed his father as John [wrong]. He talked to cousins, but no one could tell him anything about the family; however, a relative sent him to Flint Hill Baptist Church Cemetery in York County, South Carolina where he found the graves of Charles and Rebecca Elms. This lead plus a transcript of the entries of a Grier family Bible put us on the path of finding our roots that went deep into the soil of Mecklenburg County. The progenitors of the Elms Family in North Carolina and South Carolina were Charles Elms/Elloms and Rebecca Withers/Weathers whose marriage bond was signed on 17 August 1785, in Warren County, North Carolina. Rebecca was the daughter of Reuben Weathers and Celah Zills who moved from Surry/Sussex County, Virginia to Warren County, North Carolina in the 1780's and then to Mecklenburg County, North Carolina before the end of the century. Their descendants married members from early Mecklenburg families: Alexander, Davidson, Grier, Spratt, Harris, Hunter, and many others. The best known member of the Elms Family was a son of Charles and Rebecca, William W. Elms. W.W. was a merchant in Charlotte in the 1830's and 40's and is mentioned many times in J. B. Alexander's The History of Mecklenburg County From 1740 to 1900, published in 1902. In 1820 Charles applied for a pension based on his Revolutionary War service. He stated that he had served in the military with the third regiment from 1781-82. This regiment was raised in the Warren County area; therefore, he had lived in the area prior to his marriage. In his affidavit, Charles said that he did not have his discharge papers because he had given them to his sister who had "removed to the western country." He was discharged at Continental Village in 1782. None of the papers mention the loss of one of his eyes during the war, but we found several references about the injury. An affidavit filed in Rowan County in 1802 quoted an unnamed lieutenant: "Charles Ellums {sic} was wounded with loss of his eye whilst in the service of the United States..." From his Revolutionary War service records at the NC Archives, we know that in 1820 Charles applied for and received 128 acres of bounty land based on his service for the years 1776, 1777, and 1778, but we do not know where the land was located. In 1873, John Rosser gave an interview in Memphis, Tennessee about his childhood in Mecklenburg County. He remembered Charles Elms as a pensioner who had served in Washington's Legion and had lost an eye in the battle of Eutaw Springs. Charles' gravestone in Flint Hill Cemetery in York County, South Carolina causes some confusion concerning his military record owing to the carver's "3" that looks like a "5" in the death date of 1836. The date appears to be 1856 rather than the actual 1836. From his military records, I know that his pension stopped at his death on 6 January 1836. Several other Elms family members with the same style of gravestone have death dates that appear to be in the 1850's; however, from newspaper abstracts I know the dates of deaths to be in the 1830's like Charles'. I recently found that Charles' grave has not been decorated on Memorial Day even though his stone reads: "A Soldier of the Revolution". The committee must have reasoned that he would have been too young to serve in the Revolution since he was seventy-nine at the time of his death. Charles and Rebecca settled in the southern part of Mecklenburg County, North Carolina at the end of the eighteenth century. Several of the Withers relatives made the trip and also settled in the Pineville area of the county. Reuben Withers, father of Rebecca, and his brother Issac were among this group. Issac and Reuben were the sons of Thomas and Lydia Weathers of Surry/Sussex County, Virginia. Rebecca's mother, Celia Withers, was one of the thirteen charter members of Flint Hill Baptist Church (just across the border from Pineville) in 1792. Charles appeared on the records in Mecklenburg County for the first time when his was listed on the tax list in Mecklenburg County in 1797. The first land record was in 1803 when he obtained a deed from William Smith for 109 acres of land on McAlpin's Creek. Even though he was a landowner in the state, Charles did not appear on the census until 1820 when he was listed in Mecklenburg County. His marriage bond, pension application, deeds, and his will tell us something about our ancestor and his long residency in Mecklenburg County. Ernest and I have searched for over a year for his origin, but his beginnings continue to be a mystery. So far, Charles is the "Adam" of our line. Charles and Rebecca had ten children who survived to adulthood. The children are listed in his will in the North Carolina State Archives. They were: Charles, John (my line), Ezekiel, Edmund, Reuben, William W., James, Rebecca Daniel, Lucinda, and Nancy Moss. Charles left several plantations, livestock, furnishings, and sixteen slaves to his children. One slave named Silvy had been left to Rebecca by her father in his will dated 2 March 1806. Nearly every person named Elms in North and South Carolina can trace their lineage to one of his sons. Through his will, we are given a glimpse of this man named Charles. Judging from the tone of his will written in 1835, he is apparently still trying to establish his right to his pension: Know all persons that I Charles Elms Sr. of the said State and County being advanced in years but in usual good health and as I humbly conceive or believe of sufficient sound memory and judgment declare and do make and so far as I myself can do it do confirm the following to be my last will and testament filing a plea in the recollection of the many struggles and difficulties I with my companions in arms during our revolutionary war, waded through and _______? when we bled freely to procure a government of laws. I now beg of those of my fellow citizens who may survive me and may have an agency in the execution of the law to lend me their aid to support my rights and privileges which I humbly conceive the laws are intended to secure to us and to our prosperity. I therefore presume to make this my last will and testament in the following manner (viz.)... Charles left little to two sons Edmund and Reuben who had apparently left the area. Each was left only $20 if they were alive and applied for it and $600 to their heirs, if any. I found a record of a Reuben W. Elms who obtained a bond for marriage to Elizabeth Ann Loudrum on 28 March 1847, in Knox County, Tennessee. It is my theory that this Reuben was a son or grandson of Charles and was named for his maternal grandfather, Reuben Withers. The Grier family Bible record provided the link to our unknown ancestors. Among those listed was James Elms who married Melvina Grier Blankenship, widow of Jackson J. Blankenship, on August 18, 1858, in Mecklenburg County. Her family's Bible was a valuable aid in tracing our family. In the entries we found the known grandfather, William A., plus his father and mother, and his mother's family. It identified William's father as James Elms who died June 20, 1862. At first I doubted his death was a War Between the States fatality; however, I found James listed in the North Troops Book covering Company H, 11th Regiment. James died at Camp Davis near Wilmington of disease only seven weeks after enlisting. His son William was only three months old, and his daughter Martha Eulelia was two years old. Ernest's grandfather (my great-grandfather) did not remember his father. It was natural for neighbors and the doctor who signed his death certificate in 1928 to assume his uncle John was his father. James A.'s will listing his children, niece, and wife is in the North Carolina State Archives in Raleigh. Charles and Rebecca's sons had heirs who passed the name down through generations who no longer recognize each other as family. Ernest and I hope that our research will provide the link to our shared ancestors and lead us back to "the boat" that brought our first Elms ancestor to America and to the stories that our grandfather was not able to pass along.
