Notes for JAMES DANIEL, SR, JUDGE:
Old Cherokee Families, Notes of Dr Emmet Starr, vol 3, Grant, by David Hampton & Jack Baker, pg2;
In the compilation for the family of James Daniel (Grant 1-1-1-8) Hampton & Baker have an additional child inserted as Peter Daniel 1-1-1-8-4x with the notation "48 d 54" which I take to mean born in 1848 and died in 1854; however, in the list of names of Cherokee emigrants under the Treaty of 1835, dated April 1838, there is an entry A415 for Widow and heirs of Ja's Daniel (Long Swamp, GA) for the amount of $5,270. The notation reads "The name of the widow is Mary Daniel, the names of the heirs as far as are certained are Betsy, now W' Sam'l K Ware [Susan Daniel], James Daniel, Martha Daniel and Ezekiel Daniel. It is supposed there are some others, perhaps two [unreadable part]". This entry indicates that James died before April 1838 and could not be the parent of a Peter born in 1848.
