Know all men by these presents:

That I, Marshall B. Lake, farmer, of Taylor County, West Virginia, being of sound mind and disposing memory, do make and publish this, my last will and testament in the words and figures following, that is to say:

First, - I order that all my just debts shall be paid with convenient speed.

Second, - I will, bequeath and devise to my wife Anna the same interest in all of my estate, both real and personal, of which I may die seized and possessed, that she would be entitled to should I die intestate.

Third, - I will, bequeath and devise to my daughter Katherine Vanscoy two hundred dollars ($200).

Fourth, - I will, bequeath and devise to my son Joseph M. Lake the sum of two hundred dollars ($200).

Fifth, - I will, bequeath and devise two hundred dollars ($200), one cow or the worth thereof, and bed and bedding, to be paid out of my estate, and also in addition the one sixth part of the rest and residue of all my property and estate, of whatsoever kind, and wheresoever situate, to my son Wateman T. Lake, upon Trust, to hold the said cow and bed and bedding for the sole use and benefit of my daughter Rebecca, and to invest the sum of two hundred dollars ($200) and the said one-sixth part of the rest and residue of my estate or the proceeds of the sale thereof, in his absolute discretion from time to time, during the life of my said daughter, and to pay all or any part of the income thereof and investments thereof, or if he shall from time to time see fit, any part of the capital thereof, unto my said daughter, or at his absolute discretion to apply the same for the maintenance and personal support of my daughter in such proportions and in such manner, in his absolute discretion, as he shall from time to time think proper.
Sixth, - I will, bequeath and devise to my sons, Fred Lake, Minor V. Lake, Thomas P. Lake, Wateman T. Lake, and Joseph M. Lake, each one-sixth part of the rest and residue of all my property and estate, of whatsoever kind, and wheresoever situate.

Seventh, - It is my express wish that one of my sons keep my land, and that it shall never become the property of John T. (or F.?) Findley.

Eighth, - I nominate and direct that Wateman T. Lake shall be executor of this will and testament.

In witness whereof, I have hereto set my hand and seal, in the presence of the witnesses whose names are hereto subscribed, this the 15th day of December 1908.

First, - My funeral expenses and just debts shall be paid.

Second, - The whole residue of my estate, I devise to my husband Marshall B. Lake.

I hereby appoint my said husband executor of this my will and I direct that he give no bond or security. In witness whereof I do hereunto set my hand and seal this 15th day of January 1883.
