He married ANN SMITH16 October 13, 1840 in St. Anne's Parish, Annapolis, Anne Arundel County, Maryland, daughter of UNKNOWN SMITH and SUSANNA//. She was born Abt. 1823 in poss. Anne Arundel County, Maryland17.

ICHARD BENSON STEWART:
There is a possibility that Richard is the son of Thomas and Elizabeth (Benson) STEWART. If this is true, then his middle name is Benson. Thomas was the son of Ebenezer and Susannah (Caples) STEWART. He was born Feb. 14, 1778 and d. May 16, 1835 at the age of 57 yrs., 3 mos. & 1 day. Elizabeth was his first wife who died June 16, 1819, daughter of Thomas BENSON who d. 1795. Thomas' second wife was Elizabeth COLE (BAML dated July 1, 1820). She survived Thomas.
On July 17, 1835 Ebenezer STEWART, Joseph B. STEWART of Baltimore City and Benson STEWART, Elizabeth STEWART, Susan STEWART and Margaret Ann STEWART of Anne Arundel Co., filed a petition in the Court of Chancery stating that their father, Thomas STEWART died May 17, 1835, having made a will, devising all of his property to be divided among all his children. He named his eldest sons Ebenezer and Joseph B. STEWART as executors. Joseph B. STEWART renounced the executorship. The decedant left a widow Elizabeth, the children named making the petition, and also the following children who are infants under the age of 21: Richard, Abraham, Maren?, Rachel, Margery, Nancy, Thomas S. and Mordecai STEWART.

Their last child born in Maryland was Florance, born about 1854. Therefore, sometime between the birth of Florance and the time that the 1860 census was taken for Warsaw, Richmond County, Virginia, the family left Baltimore and moved to Warsaw.
The 1860 Richmond County census also lists a Susan(n)a SMITH, age 72, born in Md. living with them. This could very possibly be the mother of Richard's wife, Ann Stewart. This needs more research.

Richard was in the Virginia 9th Calvary, Co. K during the Civil War.
