John Stith (son of Robert Stith and Mary Townsend) was born 1625 in Kirkham, Lancashire, England91, and died 1693 in Westover Parish, Charles City County, Virigina91. He married Jane Mosby on December 1656 in Henrico, Charles City County, Virigina91, daughter of Edward Mosby and Unknown Unknown.

The Stith family appears to have been quite numerous in th e parish of
Kirkham, Lancashire, England. John Stith was the first Stith to appear
in American historical records. He was educated in England and was an
attorney at law. His passage to Colonial America was paid by Samuel
Eale, t he owner of a large tobacco plantation. He repaid his passage
quickly from in come earned in his practice of law. He first appeared in
the Charles Cit y C ounty militia records in Virginia as a lieutenant in
1656. This record wo u ld indicate he arrived before he was age 31. A
later record shows John as C a pt ain in 1676 when he was actively engaged
on the government side in Bacon ' s Re bellion, an uprising of Virginia
farmers led by Nathaniel Bacon against t he c olonial officials. In June
of 1676 an act was passed by Bacon's House to disa ble John Stith and
Edward Hill from holding office. This partisan ac t w as re pealed in
September 1676 when Bacon died of malaria and his rebellio n c o llaps ed.
However, during the fighting, Bacon's forces captured Jamestow n an d
burne d the city. To address the discontent that gave rise to the
reb e llio n , the G overnor, Sir William Berkley appointed John Stith as
one
of t he pers on s commi ssioned to take depositions in regard to the
grievances o f the peop le of Charl es City County in 1677.
In 1656 John married Jane Mosby . It is pr obab le that this was John's
second marriage as some researchers ha v e indicate d th at he w as first
married to Jane Drury, perhaps while still in England. Howev er, thi s
has
not been documented.
In 1680 he held the ran k of Major in the m ilitia, was a practicing lawyer
and one of the magistrates o f the cou nty. In 1685 an d 1686 he
represented his county in the House of Bu rgesses. He died around 16 93
near Williamsburg, Virginia.
Jane was twice wid owed when she mar ried John in 1656. Her first husband
had the surname o f Gre gory. Ja ne and M r. Gregor y had no children.
However, when she marrie d John she was J ane Parso ns the re cent widow of
Joseph Parsons and was preg nant w ith his chi ld. When the child was born
she was given the name of Agne s Jane Stith. Altho ugh she w as in fact a
Parsons by blood, she was raised as one of John's child ren, and shared
wit h his other children in his estate an d will.
Although no birth rec ord has bee n found, it is believed that John a nd
Jan e Mosby had a another da ughter who married Thomas Hardaway, since a
p atent (d eed) is record ed in 1686 which trans fers land from John and
Jane
S tith to Thomas Hardaway. Also, the name "Stith Hardaway" was used by
the desce ndants o f the Hardaway f amily.
T he descendant s of John and Jane (Mosby) St ith were very prominent, n ot
only i n Virginia, b ut in Georgia, South Caroli na, North Caroline and
Ken tucky. One of the most p rominent branches settlin g in Nort h
Carolina
were th e descendan ts of Dr. Buck ner Stith, who settl ed in Rockin gham
county in 1820 . He marrie d Lucinda Blac kwell, daughter o f Capt. Thoma
s
Blackwell, who was for many yea rs a member of the Senate.
