I William Overstreet Senior
of the County of Charlotte and state of Virginia being of sound and disposing
mind do make this my last will and testament in manner and form following
towit:
To my beloved wife
Elizabeth Overstreet I leave during her natural life the plantation on which I
now reside.
I also leave to her two
negroes by the names of Nancy and Coleman, her choice of my horses, her choice
of two cows and calves and one third part
of my stock of hogs and sheep.
I also leave her one third
part of my household and kitchen furniture and one third part of my plantation
utensils.
I give to my daughter Anna
Tucker wife of Meriman Tucker the tract of land on which the said Tucker now
resides lying on the north side of Mitchells old road containing by recent survey
two hundred and twenty four acres.
To her and her heirs
forever I conceive the aforesaid tract of land to be the said Anna's full
proportion of my whole estate.
My will and desire is that
all the rest of my negroes and other personal estate I may ????? of except what
I have left to my wife be valued and according to the valuation ??? for by my
three sons John, Richard, and William
and the lots drawn by them I give to them
their heirs or ??? forever yet as they are all of lawful age they may
accept any other ??? of dividing that may be agreeable to the whole of them.
It is ??? ??? as I have advanced some of my said sons more than others that the account which I shall leave be taken
into consideration so that each may get his exact share and no more.
My will and desires is
that at the death of my wife the tract of land leaved her and on which
??? together with the two negroes and other personal estate be sold on a ??? of
twelve months and the money arising there from be equally divided among my said
three sons John, Richard, and William.
Lastly I hereby appoint my
sons Richard Overstreet and William Overstreet executors to this my last will
and testament.

This last will and
Testament of William Overstreet was
presented in court and the same was proved by the oathes of George Kent, and
Thomas Hamlin two of the subscribing witnesses thereto and ordered to be
recorded and Richard Overstreet and
William Overstreet the executors therein named recorded in open court the ???
of the execution thereof and on the motion of George Kent who made oath
according to law administration of the said Estate (with the will annexed is
granted here him on giving bond and security whereupon he with Nathaniel
Breedlove, Thomas Hamlin, and Richard Overstreet his securities entered into and
acknowledged then bond according to Law for that purpose.

This Indenture made and
entered into this twenty second day of July in the year of our lord one
thousand eight hundred and thirty five between Richard Overstreet and Judy his
wife, and William Overstreet and Eliza his wife of the County of Charlotte
State of Virginia, and John D. Overstreet and Cynthia his wife of the County of
Walton State of Georgia of the one part. Robert E. Bouldin of the County of
Charlotte State of Virginia of the other part.
Witrespeth that whereas William Overstreet the Elder late of the
County of Charlotte State of Virginia deceased, did by his last Will and
Testament which is of Record in the Clerks Office of said County to which for
greater certainty is referred, loaned to his wife the tract of land on which he
then lived for the term of her natural life.
Which said Tract of Land is more particularly underneath described, and at the death of said William
Overstreets wife he directs the said Tract of Land to be sold, and the proceeds
equally divided amongst his three sons the said Richard, William, and John and
whereas the Widow of said William Overstreet Senior having departed this life
and the said Richard, William, and John having long since attained to the age
of Twenty one years have naturally agreed to sell said Tract of Land to said
Robert E. Bouldin.
Now this Indenture ??? that
the said Richard Overstreet and wife, William Overstreet and wife, and John
Overstreet and wife for and in consideration of the first and full sum of five
hundred and thirty eight dollars good and lawful money of Virginia to them in
hand paid by the said Robert E. Bouldin the receipt whereof is hereby
acknowledged have given, granted, bargained, and sold by these present do give,
grant, bargain, and sell the said Robert E. Bouldin his heirs and ??? forever.
One certain Tract piece or
parcel of land situated lying and being in this County of Charlotte on the
waters of Louse Creek, containing by recent survey Two Hundred and sixty nine
acres, be the same more or less and bounded as follows to wit: beginning at William Norths line on Ridge
Road, thence his lines, S55 W58 poles to a creek, and S51 W61 poles to the road
at Mount Carmel. Thence along Bouldins lines after leaving the meeting house
acres, S55 W94 poles to a red oak stump S20 1/4 E50 1/2 poles to a whiteoak S2
1/2 W 2 1/5 poles to white oak , S18 1/4 W103 poles to White Oak, then along Price and Richardsons lines S41 1/2 E12
poles to a poplar, thence N 69 1/2 E54 poles to Bruces Mill Road, thence N68
E92 poles N Breedloves Corner white oak near the main road, thence his lines

To have and hold the above described Tract, piece, or
parcel of Land with all and singular the rights, member, and appertances
thereunto belonging or in any wise appertaining with the revision and revision
remainders, and remainder rents, ??? and profits and every part and parcel
thereof to him the said Robert E. Bouldin his heirs and assigns forever, and
the said Richard Overstreet and Judith his wife, William Overstreet and Eliza
his wife, John Overstreet and Cynthia his wife for themselves and their heirs
covenant and agree to and with the said Robert E. Bouldin and his heirs, that
they will forever Warrant and defend a good and lawfulright and title to the
above described Tract, piece, or parcel of Land against the claim or claims of
all and every person or persons whatsoever.

the fighting at Hatchers Run:
The 56th Virginia did not
fall back with the rest of the brigade, but stood its ground. The bluecoats
kept coming with their officers leading
out in front and their flags flying. They jumped into the rifle pits and fought
hand to hand against the men of the 56th Virginia. There was a wild melee of
clubbed muskets, clanging metal, and grappling men. According to Major E. M.
Woodward of the 198th Pennsylvania, "it was a confused struggle of firing,
thrusting, cutting." The 56th Virginia was surrounded and cut off.
From page 102:
The bluecoats captured
nearly the entire 56th Virginia Regiment - about 135 officers and men. The
other regiments of Huntons Brigade escaped and made their way safely to their
starting point, the deep trenches on the White Oak Road near Hatchers Run where
General Lee waited for them.
Only a handful of men in the
56th got away; the regiment almost ceased to exist as a unit. The few men in
the 56th Virginia who escaped capture at Hatchers Run joined other regiments
whenever and wherever they could and fought to the end. One or two men of the
56th were killed, wounded, or captured at every encounter between Hatchers Run
and Appomattox.
On the morning of April 12,
1865, when Lee's army stacked arms for the last time on the rain soaked ground
of Appomattox Court House, there were only 32 officers and men of the 56th
Virginia left.
One captain, two
lieutenants, one first sergeant, one quartermaster sergeant, one commissary
sergeant, and twenty five privates surrendered and accepted paroles.

I, Eliza Overstreet,
residing at Randolph in the County of Charlotte in the State of Virginia, do
hereby apply for aid, under an act of the General assembly entitled "An
act to give aid to soldiers, sailors, or marines of Virginia, maimed or
disabled in the war between the States, and to the widows of Virginia soldiers,
sailors, and marines who lost their lives in said war in the military
service." And I do swear that I am the widow of Wm R. Overstreet who was a
member of 8th Va Regiment, Company H and who, while in the discharge of his
duty in military service during the late war between the states, lost his life. And I do further swear that I am not
receiving aid from or a pension from any State or from the United States, and
that I do not hold any national, State or County office which pays me in fees
or salary over three hundred dollars;
that my income from no source amounts to three hundred dollars; and that
I do not own in my own right property of the assessed value of one thousand
dollars; and that I am now entitled to receive annually the sum of thirty
dollars under the terms of the aforesaid act of the General Assemby.
