Smith County, Tennessee Will Book # 8 Page 233 Daniel Dillard Will The last will and testament of Daniel Dillard I, Daniel Dillard of the County of Smith and State of Tennessee, being of sound mind and disposing memory, though weak of body considering the uncertainty of this mortal life do make and publish this my last will and testament, hereby revoking any and all wills by me made at any time. 1st It is my will and wish that all my just debts be paid, my funeral expenses etc. 2nd I will and bequeath to my beloved wife, Francis Dillard, all of my estate both real and personal, during her natural life or during her widowhood, after paying my debts as first provided for her own use and benefit, during her life or widowhood and for the aid and help (keep?) of our youngest children herein named , to wit; my son DanielDillard,Miles Dillard, my youngest daughter, Aldona Dillard, also one that my wife Francis Dillard is pregnant with at this time, until they become eighteen years of age, then all of my effects to (be)equally divided between all of my children and my grandchildren, that is to say share and share alike. That is to say, Elisha Dillard, Margaret Treywick (?),Patsy Harrises heirs, Malvina Pools heirs, Daniel Dillard Jr., Miles Dillard, Aldona Dillard also the child my wife is pregnant with at this time. 3rd Having great confidence in my beloved wife, Francis Dillard, I hereby appoint her my executrix to this my last will and testament, without security during her natural life or widowhood and after which, I appoint James G. Wyatt my executor in her room and stead with the same power to carry out this my last will and testament, this the 19th day of July 1869. Daniel --- (his mark) Dillard The above written instrument was subscribed to by the said Daniel Dillard in our presence and acknowledged by him to each of us and he at the same time declared the same to be his last will and testament; and we al? the testators reque? and in his presence signed our names as witnesses to the same on the day it bears date. J. G. Wyatt, N. E. Smith State of Tennessee Smith County County Court for said County, September Term 1875. The will of Daniel Dillard deceased was processed in open Court by the Executrix, Francis Dillard and offered for probate. Then came the subscribing witnesses to said will, J. G. Wyatt and N. E. Smith, who being duly sworn deposed at the time they were called to witness the record ? of the said will, (that Daniel Dillard) was of sound mind and disposing memory and that he acknowledged the free execution of the same in his presence and that he afterward died in said County and State. Whereupon on motion of said Executrix said Will is ordered to be submitted to probate and is recorded and filed. Given under my hand at office, this the 18th day of September 1875. S.
