LAST WILL AND TESTAMENT OF JOHN HUTCHINSON-March 16, 1869
In the name of God, Amen.
I, John Hutchinson of Upper
Mauch Chunk, in the Borough of Mauch Chunk
County of Carbon in the state of Pennsylvania, being
weak of body but of sound mind and memory
do make this my last will and testament, at the same
time revoking all former wills made by me declaring
this to be my last will and testament.
First I recommend my soul into the hands
of God my heavenly Father.Trusting only to the
merit and mediation of Jesus Christ My Lord,
whose I trust I am for acceptation and salvation.
My body to the earth, whence it was taken,
to be laid as in a bed to rest, to sleep in
Jesus till the last trump shall sound.
My wife and children to the divine blessing
and providance, with all my children's children,
to be brought up in the nurture and admonition
of the lord.
And I give and bequeath to my dear
wife Jane Hutchinson all that certain lot or piece
of ground as sixteen on the plot or plan situated
on the northwardly side of South Street in Upper
Mauch Chunk in the Borough of Mauch Chunk
Count of Carbon State of Pennsylvania.Bounded
southwardly by said South Street.Eastwardly
by lot No. Fifteen, Northwardley by a twenty five feet
wide alley, and westwardley by lot No. Seventeen,
with all the buildings and improvements thus on.
With all the household furniture and chattles now
owned by me, as long as she the said Jane
Hutchison shall live and remain unmarried.The
income of which shall be used by her for the benefit
of herself and minor children.And the said
Jane Hutchison my wife shall have no right to sell
or dispose of in any way, the aforesaid real estate
or household furniture.
But if the said Jane Hutchison my
wife shall either marry or die before my
youngest child Jane Hutchison shall have
attained the age of twenty years, then the
property shall fall into the hands of the three
trustees hereinafter named Samuel N. Hutchison,
William Thompson, and James Ross, the income
of which shall be used by them or any of them
which shall survive the others, as they shall
determine for the benefit of the children
which shall then be under age.And when the
youngest child the aforesaid Jane Hutchison
shall have attained the age of twenty years
then the trustees shall sell the said property
at the best advantage they can, and they
shall divide the money equally among my six
children or their heirs which shall then be
living.
And if my wife the said Jane Hutchison
shall live and remain unmarried until after
my youngest child the aforesaid Jane Hutchison
shall have attained the age of twenty years
then after the death of my wife the property shall
be sold by the aforesaid trustees or any of them
then living and the proceeds divided equally
among my six children or their heirs which
shall then be living.
At the same time I appoint my
brother Samuel N. Hutchison and James Ross
joint executors of this my last will and
testament to which I have hereunto set my
hand and seal this sixteenth day of March
in the year of our Lord one thousand eight-
hundred and sixty nine.
