On Motion of John Currie Esquire,representing to the Court,that only Eleven of the Jurors had signed the Inquisition on the Writ of partition on the Valuation issue at last December Court for the Real Estate of Henry Aten deceased on a Petition then presented by Henry Aten Eldest Son and Heir at Law of the said Henry Aten deceased,the Court do order,that a new Writ issue,Returnable to next Court.

The 17th of said March
And now the Sherif,to wit: Jonas Hartzell Esquire,returns,that he by Vertue of a certain Writ to him directed,issuing out of this Court had held a certain Inquisition for the partition or valuation of the Real Estate late of Henry Aten deceased which follows in these Words,to wit,"Inquisition Indented taken at Mount Bethel Township in the County of Northampton and State of Pennsylvania the 24th day of February in the Year of our Lord one thousand seven hundred and seventy nine,before Jonas Hartzell Esq. High Sherif of the said County by Virtue of a Writ of Partition or Valuation to him directed and to this Inquisition annexed by the oath and affirmation of John Nelson,Elisha Barton,David Eayers,Thomas Conly,Robert Ritchy,Francis Halbert,Michael Hess,Christian Benter,George Reymel,Robert Baer,Asa Everett and James Oliphant twelve honest and lawful men of the said County who upon their respective Oaths & Affirmations do say that the Lands of Henry Aten deceased in the township aforesaid cannot be justly divided unto and among the Children of the said deceased without prejudice to and spoiling the whole. Wherefore the Inquest aforesaid do value and appraise the same to wit; one of the Tracts of Land,bounded by land of Derrich Aten and others containing one hundred& fifty acres & an half at the sum of Eight Hundred& Twenty Seven Pounds Fifteen Shillings of good and lawful money of Pennsylvania; and the other tract bounded by the said Derrich Aten and others containing about Two Hundred acres more or less,at the Sum of Three Hundred & Fifty Pounds Lawful Money aforesaid. In Testimony whereof as well the said Sherif as the Inquest aforesaid have hereunto set their Hands & Seals the Day and Year aforesaid.John Nelson,seal. Elisha Barton,seal, David Ayers Seal,Thomas Conally,seal, Robert Richart, seal, Thomas Halbert,seal, Michael Hess,seal, Christian Benter,seal George Reymel,seal, Robert Beer,seal, Asa Everet,seal,James Oliphant,seal, Jonas Hartzell, Sherif,seal. Which Inquisition being read and fully considered by the Court, It is ordered,that the Valuation and Appraisement so made as aforesaid remain Firm and Stable forever, Whereupon Henry Aten Eldest Son and Heir at Law of the said deceased,aforesaid in Court, and declared himself ready and willing to accept of the said Lands at the Valuation aforesaid,and offered to the Court John Mack and James Cauly both of Mount Bethel Township Yeoman as his securities for the payment of the Shares of the other Children of the said deceased Who are approved of by the Court. And thereupon the Court do order and award the said Land unto the Eldest Son,to be enjoyed by him his heirs and assigns forever.And that from henceforth the other Children of the said deceased shall be forever debarred of all Rights,Title and Demand whatsoever of in and to the said Premises or any Part thereof,And the said Henry Aten is allowed One Year for the Payment of the Shares of the other Children of the said deceased without Interest;And it is also ordered that the Costs and Charges arising hereupon be borne and defrayed by all the parties concerned.
