F.R. Capps Deed to J.W. Cochran
Registered March 3rd, 1851, at 3 o'clock p.m. State of Tennessee--Weakley County
I, F.R. Capps, have this day bargained and sold and do hereby convey to J.W. Cochran for the sum of five dollars to me and the other considerations herein after mentioned a negro man named Willis and all the estate which may come to me by decent from my father to wit, Wm. Capps now deceased, both personal and real, to have and to hold the same to the said Cochran, his heirs and assigns forever I do covenant with the said Cochran that I am lawfully seized entitled to the as part of the above named estate and have a good right to convey it and also to the said estate which may be my interest in the same and every part thereof to the said Cochran, his heirs and assigns against the lawful claims of all persons whatever, but this Deed is made for the following use and trust and for no other purpose.That is to say I am indebted to R.---and E.F. Capps as the administrators fo Wm. Capps, deceased, in the sum of eight hundred and forty five dollars and fifty cents under seal of the date of the 15th of this intent due 25th of December next, and am desirous to secure and make certain the payment of the same.Now if I should pay the said debt at the time aforesaid, then this deed to be void but if I should not then the said Cochran shall take into his possession and keep the above named negro man and all the estate to his proper use and benefit without further difficulty to the said Cochran as witness my hand and seal this the 17th day of February 1851.

This day F.R. Capps, with whom I am personally acquainted, came before me, C. P. Bondurant, Clerk of Weakley County Court, and acknowledged that he signed, sealed and executed the within Deed of Trust to J.W. Cochran, the within bargainer on the day it bears date and for the purpose therein contained.Given under my hand at office in the town of Dresden on this 3rd day of March 1851.
