1854--61 Acre Deed Isham Thomas to William N. Capps
I, Isham Thomas, have this day bargained and sold and do hereby transfer and convey to William N. Capps and his heirs forever for the consideration of 150 dollars to me in hand paid a track of land in the State of Tennessee, County of Weakley, Range one section 4 of the 12th Surveyors District, bounded as follows.Beginning at J. W. Cochrans North West corner thence running South 50 poles to a stake Henry Capps North line thence West with said Capps line 56 poles to a stake with oak and dogwood pointers thence South 60 poles to a stake with a poplar pointer thence West 64/10 poles to a stake thence North 110 poles to a stake thence East 120/10 poles to the beginning containing by estimation 61 acres be the same more or less.To have and to hold the same to the said William N. Capps, his heirs and assigns forever I do covenant with the said William N. Capps that I am lawfully seized of said land, have a good right to convey it and that the same is unencumbered.I do further covenant and bind myself, my heirs and representatives to warrant and forever defend the title to the said land and every part thereof to the said William N. Capps, his heirs and assigns agains the lawful claims of any and all persons whomsoever.This 25th of May A.D. 1854.Executed and delivered in our presence.Isham Thomas X his mark (seal)

Personally appeared before me, E. J. Sooney, Clerk of Weakley County Court, James H. Hill and J.J. Capps, subscribing witnesses to the above and foregoing deed, who after being sworn depose and say that Isham Thomas, the above bargainor, signed, sealed and executed the said deed on the day it bears date and for the purposes therein mentioned.
