In the Name of God Amen, I John Hershberger of the Parish of Beckford in the County of Shenandoah and State of Virginia, being weak in my Body, but of Perfect and Sound mind and Memory, Thanks be to Almighty God for the Same, and I Calling to mind the mortality of Mankind, I do make and Ordain this my last Will and Testament in the Following manner and form first I _ecommend my soul into the hands of Almighty God, who gave it me, and my body I _ecommend to the Earth to be buried in a decent Christian like b_____ at the discretion of my executors not doubting but at the general resurrection I Shall receive the Same again by the Highly Power of God. And such worldly Estate wherewith it hath Pleased God to Bless me with in this life. I give devise and dispose of the same in the Following manner and form first. I give and devise unto my son Isaac Hershberger his heirs and assigns forever, one certain tract or Parcel of Land containing by estimation one hundred and sixty Acres Situation lying & being on Pass Run in the County of Shenandoah with a grist mill & said mill thereon together with all the appurtenances therewith belonging it being the Same land whereon my said Son Isaac Hershberger now lives ---___ ___ said Son Isaac Hershberger shall therefore pay unto my son Jacob Hershberger or to his heirs, one Hundred pounds Current Lawful Money of Virginia. Secondly, I give and devise unto my son John Hershberger his Heirs _ assigns forever a certain track or Parcel of Land containing one hundred acres of the _____ was lately Surveyed by Jacob Rinher, Situate lying & being on the Hawksbill Creek in the Said County of Shenandoah, it being the same land whereas my said son John now lives but my said Son John Hershberger shall therefore pay unto my son Jacob Hershberger or to his heirs one hundred pounds current lawful money of Virginia. Thirdly I give and devise unto my Son Samuel Hershberger his heirs and assigns forever, all the remainder of my land containing, by estimation one Hundred and Sixty two acres be the same more of less, Situated lying and being on the Hawksbill Creek in the Said County of Shenandoah it being the old Plantation whereon I myself now live and my said son Samuel Hershberger s[h]all therefore pay unto my son Jacob Hershberger to his heirs the sum of one hundred and twenty five Pounds Current Lawful Money of Virginia, also it is my will that my beloved wife Anna Shall have her Maintenance out of the said Plantation which I have given to my Son Samuel and that She Shall have the Right to live in the House I now live in During her natural life and Widowhood and also it is my will that my Said wife Shall have all her household utensil during her natural life without appraisement. Item, I give unto my Said Son Samuel Hershberger all the remainder of my personal Estate without appraisement, and also all that my said wife shall leave after her deceise?, of any thing I have give her shall also before the use of my said Son Samuel and his heirs all without Appraisement. Item. I give unto my son Jacob Hershberger the Sum of Three Hundred and Twenty five Pounds Current Lawful Money of Virginia to be paid unto him by my other three sons Isaac, John and Samuel as I have about Directed the. And I do hereby E_dain, Constiture and appoint my said Son Jacob Hershberger Sole executor of this my last Will and Testament and I do hereby Willi____ly Revoke disa______and disallow all former and other Wills and Testaments by me heretofore Made Ratifying allowing and confirming this and no other to be my last Will and Testament In Witness whereof I the Said John Hershberger have herewith let my hand and seal as and for my last Will and Testament this twentieth day of May in the Year of our Lord, One Thousand seven Hundred and Ninety The Words my - ____ were interlined before the signing and Sealing hereof Signed Sealed ____anounced by the said John Hershberger as of his last will & Testament in the Presents of us John _________ Martin ____ Ymorn Signed in German _____ ____ _____ Jacob Rinker
At a Court held for the County of Shenandoah on Monday June 8 1807 this Last will and Testament of John Hershberger Dec was Exhibited to the court and Proved by the Oath of Jacob Rinhert & affirmation of John Musselman & Martin Coffman with_____ thereto I order to be recorded on Motion of Jacob Hershberger the Executor in the will mentioned a Probate in Granted him in due form who made oath & Entered into Bond with David Strickler, Balser Hupp & Jacob Hiss his Security in the _enalty of Two Thousand Dollars Conditioned as the ____Deeds.
