Thank you for that good summary of what Col. Hays and his fellow oficers were doing during that confusing time. I'm researching the Hays and Watts families of Jackson and CAss Co., MO in conjunction to publishing a collection of letters by Upton and Margaret Watts Hays and their relatives in Missouri and California. ( www.wattshaysletters.com ) In the fall of 1861, while Upton was a Captain in the Missouri State Guards, he and the neighborhood men around Westport, MO formed a band to protect the area from depredations by Jayhawkers. He was commissioned as a Lt. Col in the Confed. Army in 1862 and was in the process of reorganizing the 2nd MO Cav. into te 12th MO CAv. (Confed) when he was killed in a skirmish near Newtonia 12 Sept 1862. There are conflicting reports of his death but it was before the Battle of Newtonia.
Since Upton was killed in 1862, when I came across another Upton Hays who had received a Confederate pension in OK about 1928 I was curious who this was. I got thepension file for this 2nd Upton Hays, who was b. 1846 KY to see if he was a member of Col. Upton Hays' family. It appears that this was a pension scam, where a George Hayes had used the well known name of Upton Hays to obtain the pension. An older man posed as Pvt. Hays and received the pension. They established his service in the Confed. Army by going to a Confed. reunion and finding former soldiers who remembered the name of Upton Hays - but by 1928 these elderly men had forgotten who, exactly, Upton Hays had been. After Pvt. Hays died an Annie Hays (her real name) got the widow's pension, by posing as the wife of Pvt. Hays. When she died George Hayes and his sister got into an argument about who should get the money for her burial. Apparently Confederate Civil War pensions scams were common. They were administered by Commissioners in each state and not by the Fed. Gov.
