This Indenture made the seventeenth day of February One thousand eight hundred and thirty four Between Paul Hinckley of Stephentown in the County of Rensselaer and State of New York of the first part and Azariah Hinckley of Stephentown in the County of Rensselaer and state of New York of the second part.

Whereas Stephen Van Rensselaer Esquire Lord and proprietor of the Manor of Rensselaerwyck by Indenture of lease duly executed bearing date the twenty second day of February one thousand seven hundred and ninety three did convene to the said Paul Hinckley his heirs and assigns for the term of sixty years a certain farm piece or parcel of land situate in the Manor Rensselaerwyck on the east side of Hudson River and which farm is in the said lease paid to contain sixty four acres of land subject to several exceptions reservations covenants conditions and agreements which are set forth in the said lease as by the same reference being thereunto had may more fully and at large appear and whereas the said Stephen Van Rensselaer by a certain other Indenture of lease duly treated bearing date the sixth day of May one thousand seven hundred and ninety one did convey to Jeremiah Vallet his heirs and assigns for the term of sixty years a certain farm piece or parcel of land situate in the Manor aforesaid and which farm is in the said lease said to contain seventy acres and five tenths of an acre of land Subject to several exceptions reservations covenants conditions and agreements which are set forth and contained in the said lease as by the same reference being thereunto had may more fully and at large appear and whereas the said Jeremiah Vallet by the name of Jeremiah Vallet jun. By an assignment written upon the back of the last above recited lease did assign transfer and set over all his right title interest and privilege to the said lease and promises therein mentioned on the eleventh day of October 1794 unto Paul Hinckley aforesaid his heirs and assigns.

Now this Indenture Witnesseth that the said party of the first part for and in consideration of the natural love and affection which the said Paul Hinckley has for his son Azariah Hinckley above named and also for and in consideration of the Yearly rents covenant and conditions hereinafter contained which on the past [and] behalf of the said parties of the second part his heirs executors administrators or assigns are or ought to be paid [Does] Kept and performed has granted bargained sold [aliened] released and confirmed and by these present Does grant bargain sell [alien] release and confirm unto the said party of the second part his heirs executors administrators and assigns All that certain piece or parcel of land being part of the above in part described promises and is bounded as follows to wit.Beginning at a tract tree landing at the east side of the Brook Commonly called the Black river and at the Southwest corner of a lot surveyed for Jeremiah Vallet and is marked on the Southeast side with red chalk “P.H. 1789 J.E.V.A.” and runs from the said tree due east fifty three chains then due south ten chains twenty three links then South sixty degrees fifty minutes west seven chains eighty links then due west forty one chains ninety links to a hemlock stake and stones at the east side of the said Black River and then up the stream thereof as it winds and turns to the place of Beginning containing sixty four Acres.

Also All that certain other piece or parcel of land being the same as conveyed by Stephen Van Rensselaer in the second above in part recited lease to Jeremiah Vallet and bounded as follows to wit. Beginning at a beach tree standing at the east side of the brook commonly called Black River and at the north west corner of the farm surveyed for Paul Hinckley and is marked on the south east side with red chalk “P.H. 1789 J.E.V.A.” and runs from the said tree due east fifty three chains then due north four chains ninety four links then due west twelve chains ten links then due north one chain then due east one chain eighty links then north eleven degrees east four chains ten links then due north ten chains twenty links then due west thirty six chains thirty eight links to a surveyed hemlock tree at the east of the before mentioned Black River and then down the stream thereof as it winds around to the place of Beginning containing seventy acres and five tenths of an acre to have and to hold the said last above described pieces or parcels of land and premises hereby intended to be granted with the appurtenances unto the said party of the second part his heirs and assigns to the role and only proper use benefit and behoof of the said party of the secondpart his heirs and assigns subject to the exceptions reservations conditions covenants and agreements in the said above in part recited lease continued.

Yielding and paying therefor during the continuance of this grant unto the said party of the first part his heirs or assigns the yearly rent of Five bushels of good clean merchantable winter wheat for the first above described piece or parcel of land containing as above described sixty four acres and also five bushels of good clean merchantable winter wheat for the second above described piece or parcel of land containing as above described seventy acres and five tenths of an acre at the mansion house of the said Stephen Van Rensselaer in the town of Watervliet in and upon the first day of January in each year.

And the said party of the second part for himself his heirs executors and administrators Does hereby covenant grant and agree to [cust] with the said party of the first part his heirs executors administrators and assigns in manner following that is to say that the said party of the second part his heirs executors administrators or assigns or some of them yearly and every year during the continuance of this grant shall and will well and truly pay or cause to be paid unto the said party of the first his heirs executors administrators or assigns the yearly rent above reserved at the days and times and in manner and form above expressed according to the true intent and meaning of these presents.

And Also that he the said party of the second part his heirs executors administrators and assigns shall and will at all times hereafter during the continuance of this grant bear pay and discharge all taxes charges and assessments which shall be hereafter taxed charged or assessed upon the said pieces or parcels of land and premises last above described or upon any part thereof and indemnify the said party of the first his heirs executors administrators and assigns against any costs and charges which he or they may be put to by reason of the nonpayment of the said taxes charges and assessments.And the said Paul Hinckley party of the first part for himself his heirs executors administrators and assigns Does hereby covenant promise grant and agree to and with the said parties of the second part his heirs executors administrators and assigns in manner following that is to say that the said party of the second part his heirs and assigns paying the said Yearly rent and performing fulfilling and keeping all and singular the covenants conditions and agreements herein contained shall and may at all times forever hereafter during the continuance of this grant practably and quietly have hold use occupy possess and enjoy the said piece or parcel of land and premises hereby granted with the appurtenances without the lawful [let] hindrance molestation interruption or denial of him the said party of the first part his heirs and assigns and of all other person or persons whatsoever except what may arise out of the reservations contained in the above in part recited original lease respecting the right of the Proprietor of the Manor to take what land may be judged necessary for the purpose of building Mills and the cutting and using Wood and timber for the cause.
