Good discussion. I absolutely agree that pronouciation can be confusing. Even when I say "Kirtley" it can sound a lot like "Kirkley". And, yes, the vicar or the court clerk wrote what they heard, which often involved creative spelling.
Having said that, I've corresponded with Kirkley reseachers who tell me that Kirkley was the original spelling and that Kirtley is a variation. My independent research confirms this. I search and found 180-some Kirtley/Kirkley marriage/birth/death records in County Durham between 1545 and 1863. There are many early Kirkley records. The earliest Kirtley record is 1635.
