In the name of God, Amen, I Robert Mays of Amherst County being in my proper senses and knowing the certainty of death, and the uncertainty of the time it may happen, do make and ordain this my last will and testament in manner and form following ( to wit)
I give to my son Jesse Mays one hundred and six acres of land, it being part of the tract of Land I purchased of Wm Tucker, whereon the said Jesse Mays has built and is now living,
Item I give to my son Pearce the ballance of the tract of land I purchase from Wm Tucker,
Item I give to my beloved wife Susannah the tract of land whereon I now live during her natural life, and at her death to be equally divided between my two sons Joseph B Mays and Ballinger Mays,
Item I give to my Joseph B Mays one sorrel mare mare [sic] a feather bed and furniture and a cow and calf;
Item I give to my son Ballenger Mays a sorrel mare (called Dimond), a feather bed and furniture and a cow and calf,
Item I give to my daughter Polly Mays one Negroe Girl named Sarah, a sorrel horse colt (out of mare called Kitty) a feather bed and furniture and a cow and calf,
The whole of the ballance of my estate I wish to remain in possession of my wife during her natural life and at her death for the whole with its increase to be equally divided between my childrfen above named, to wit Jesse, Pearce, Joseph B., Ballenger and Polly Mays, to theirs and to their heirs forever.
Finally I appoint my trusty friends Charles Tucker, J Smith and my son Pearce Mays Executors to this my last will and testament.

At a Court helf for Amherst County the 18th day of July 1808 this last will and testament of Robert Mays deceased was proven by the oaths of Charles Taliaferro, and Jas Clements, three witnesses thereto and ordered to be recorded. And Charles Tucker, John Smith and Pearce Mays the Executors named in said Will personally came into Court and qualified according to Law and together with John Crawford and John Fulcher their securities entered into and acknowledged their Bond in the penalty of $5000 current money conditioned as the law directs.

Ordered that the proceedings in the said County Court subsequent to the issue jointed between the parties be set aside, and that the cause be sent back to the said County Court with direction to the Court that if no other evidence appears exceptin what is contained in the Bill of exceptions, that the Def (e) n (se) be compelled to join in the demurrer.

This day came the parties by their attornies Declaration, plea and Issue and thereupon came a Jury to wit Benjamin Racker, George Taisley, David L Burford, Jacob Tyree, Drury Bell, John Tucker, John Hansard, Hugh Norvell, James Metcalf, Thompson Noel, WIlliam Penn and Jesse Woodrop who being elected, tried and sworn the truth to speak upon the issue joined upon their oath returned their Verdict in these words to wit: We of the Jury find that the paper mentioned in the Declaration and and (sic) plea and in the order of the Chancellor directing this issue, as purporting to be the last Will and Testament of Robert Mays Dec'd to wit : a paper bearing date the 3d day of June in the year 1806 signed and sealed by said Robert Mays attested by three subscribing witnesses to wit: Charles Taliaferro, Peter Taliaferro and James Clemens, and which is in the following words to wit: "In the name of God," etc. is really and truly the last Will and Testament of said Robert Mays Dec'd duly made and published according to law, at a time when the said Robert Mays was of sound and disposing mind. " Thompson Noel." Whereupon the Counsel for the Defendants in the issue moved the Court to certify to the Judge of the Superior Court of the Chancery held over in Stauton (?) that the Verdict of the Jury of aforesaid was contrary to the weight of eveidence in the trial. But the Court being of opinion that the said Verdict was supported by the evidence overruld the motion and refused to grant the Certification -- It is ordered that the Verdict found as aforesaid be certified to the said Superior Court of Chancery.
Court adjourned till tomorrow morning 10 o'clock.

Original Parish Established c1654, was divided into two parishes c 1700 which was known as St. Paul's and Overwharton. The latter is still serving parish and was named after Overwharton Parish Staffordshire, England.
Overwharton Parish was the first parish that we find our Mays ancestors in America. The Aquia Church, built at the time of Benjamin Mays was born in 1757, is just north of Fredericksburg, VA. Overwharton is actually named after Henry Meese's home in Oxfordshire.

This Indenture made this 19th day of September in the Year of our Lord 1796 between Benjamin Mays and Susannah his wife of the County of Amherst of the one part and Eaton Carpenter of the said party of the other part witnesseth that the said Benjamin Mays and Susannah his wife for and in the consideration of the sum of thirty five pounds to show in hand paid the receipt whereof they doth hereby acknowledge and have granted bargained sold delivered and by these present do grant sell and deliver unto the said Eaton Carpenter one tract or parcel of land lying and being in the County of Amherst on the Southwest side of (Thrasters) Creek containing by estimation eight five acres be the same more or less and courses as followeth, to wit: Beginning on the creek running thence North seventy degrees one hundred and ten poles to a Spanish Oak north ten degrees west twenty eight poles to a Spanish Oak North twenty two degrees east thirty poles to left hand of fork of said Creek thence down the said creek and wanders of the same South sixty degrees East thirty poles South forty poles South six degrees East eighty eight poles SOuth thirty degees East one hundred seventy poles South fifteen degrees East ten poles to the beginning. Served in the Revolutionary War as a private in the Company of Captain Woodruff of VA. Also served under Captain Bollings, Captain Bellinger, Captain Samuel Higginbotham and Colonel Gaines. He moved to Iredell Co NC in 1799.
(Benjamins Father Robert was married twice and their were children by both marriages. When Robert Mays died, the two families (children) had a court battle over their Father's property.)

At a Court held for Amherst County the 17th day of May 1808 this Letter of Attorney was duly certified from the Count of Iredell in the State of North Carolina and the same is ordered to be recorded into the Court Teste.
(The children Benjamin and James by the first marriage lost to the children of the second marriage.)
On August 25 1832 Benjamin appeared in court in Iredell Co, NC to obtain his pension. He mentioned four tours of duty that occurred over a period of four years from 1777 to 1781. He served in the Virginia Militia. Benjamin was 20 years old at the time.
The first tour was under Capt Ballinger. He was drafted and assisted in guarding the British in Albermarle County Virginia. His second tour was under Capt Higginsbotham, and was spent in a station at Richmond Virginia. His service was for two months at least. His third tour was under Capt. Higginsbotham and Col Gaines at New Glasgow. His fourth tour was under Capt Woodruff and Col. Gaines at the time of the Siege of New York. Col. Gaines commanded the regiment. He assisted until the surrender of Cornwallis in 1781. Benjamin was granted a pension. He received $20.55 per year for the rest of his life.

Larkin Benjamin Mays was a saddler by trade (leather worker)
Lived in Wilkes Co, NC 1840 and Watauga Co, NC 1850.
On August 15, 1812 in Kingston, Roane Co, TN, Larkin enlisted in the 24th Regiment of the army
regulars. Larkin was wounded in the left foot and was discharged in April 1813. Larkin spent time at Fort
Massac, Metropolis, IL, recuperating from his wound. In 1854 Larkin moved to Illinois with his son James
Rufus, daughter Minerva, and her husband James Hamlet. In 1864 Larkin applied for and received a
pension. At that time he was living in Sandoval, IL, with Minerva. Larkin was listed as being retired and
blind. Larkin died on Feb 3 1866 and is buried in IL.

Dear Sir i recieved your letter the 19th of May informing me that in order to procure pension i must prove
my first service and honable discharge and i do not claim to be in service any longer than that on
account of not being able to stand the March to canday and the taken me up Ohio near to a settlement
and thure capt Butler fave me a bill of directions to get out now must i miss getting pension or part of
pension on account of my disability to stand the march when i was just as willing a man as there was
i could not stay at fort massac by myself no i coud not go along
I should not tried to procure any pension if it had not bin for my neighburs since i have bin blind and not aable to make my living & my children has all gone but too & they are not able to keep me, i have been blind nearly ten year and i was raised by a revolutioner, bin raised true to my contry & i raised my family so to.

Sandoval Illinois Larken Mayse
Story told in Phillips family as recollected by Earl C Phillips at age 91. ( 19 June 1982)
Larkin Mays was lost in the woods during the Blackhawk War. For six days he wandered around in
circles and had only berries to eat. Larkin finally wandered into an Indian camp. The men were all gone
but the women in the camp fed Larkin. One Indian woman took a piece of deer meat, put her bare foot on
one end of it and tore off a piece which she threw in the pot. Larkin said that was the best meat he had
ever eaten.
In the Phillips family the story is told that James Mays, son of Larkin, married in North Carolina and came to Southern Illinois. No mention was made about Larkin and most family members was unaware of his existence.

Dear Nephew & Cousin,
We have just received your kind letter from the far west, and now endeavor to answer as well as we can. I, Absolom Mays, a son of Benjamin May am living and have lived, ever since I was married, about 14 miles north of Statesville. I married a daughter of James Watkins about a year after you left this county & we have had 7 children. My oldest son is dead. One son and 3 daughters are married and live in the county. One son and one daughter are single and live with us. I will tell you all I know about your grandfather’s family.
John Mays the oldest son of Benjamin Mays moved to the western district of Tennessee a great many years & we heard he was drowned in the Forked Deep River. He married James Gay’s daughter in this country. One of his sons was here some time ago.
Elizabeth Mays. the 3rd child of Benjamin Mays married William Slaven and lives in this county. She had, I think, 4 children. One of her sons is dead & lives several miles (?) below Statesville. One daughter married a Dowdy and moved to Georgia. After Slaven’s death she married a Leslie.
4th: daughter Grayanna married a Tally & moved to the west & we don’t know about them since.
5th: Williaim son of B Mays married a Roby and moved to Georgia. We have heard he was dead.
6th: Larkin .. His sons are in your country.
7th: Absolom Mays. son of B Mays, [Author of this letter.]
8th: Levi Mays. son of B Mays, married Elizabeth Leach and moved to Tenn. or western states. I know nothing more of him.
9th: Nancy Mays. daughter of B Mays, married Richard May [e]s. They live in Lincoln County. They settled east of Statesville and live near your grandfather’s old place.

Patsy. daughter of B Mays, married Hiram Gay. He died. She moved to Alabama.
Jacob Mays, son of B Mays, married a Vaughn & moved to East Tenn. We have not heard from him for several years.
My oldest child, Dorcy, married John Campbell. They live in Alexander County. They have two children, both sons. My daughter Elizabeth Amanda married James Wilson about 1855. She has a son. After that he treated her very badly. He ran away and left her: went to Illinois. From there he went to Iowa and has accumulated some property. As soon as the law of state would permit, she married again to George Allison. They live near Statesville and have 7 children. My daughter Miranda married J. Wilson McCleland . They live near me with 9 children. My son B. Nelson Mays died in 1846, aged 24. My son James Calvin married Martha Grey. They have 3 sons dead and one child living. My daughter Laura & son Hamilton live with me. I and your aunt Jane Mays, my wife, are old and weak, scarcely able to do anything. I am 75 years old.

Dear Brother in answer to your kind and welcome Letter which I Received dated Dec the 20 1891.
I received it the January the 6, 1892. I will Say to you that we are all tolerable well I have had a bad Coff
for 10 or 12 years though I am stout of my age Considering every thing I will now proced to tell you a
bout my family.
My oldest childs name is Martha Jane.
Susanna & Sarah that is the girls names. John Larkin & James Morgan is the 2 boys names. you wanted
to know who they marred Martha marred Wiley Hamby and had 2 children. he went to war in 61 and few
days before the war Stopped he went over to the federal army and has never come back.
Susanna married a Pitts and has had know children by him. Sarah married J.B. Robbins son of Thomas
Robbins and has 5 children living I will not give none of their names they will give your their names in a
few days they are all going to write to you in a few days.
John Larkin married Nancy Cozort & has 8 children living 2 dead (twins) & James Morgan the young
child married Sally Nelson Daughter of Robert Nelson uncle of Thomas Nelson the preacher that
informed you of me. he was one of our best preachers we had in our country and if you see him any
more give him my best respects. I can not tell you in this letter all I want to a bout my family they will write
to you and let you know about them selves.
James Morgan is living in tennessee Sulvin County near Bristol about 60 miles from hear. John is living
on Buffalo at the pinion old place in Sara is living where Thomas Robbins lived when we left this contry
to go to the Indiana. in Sampson . Watauga County.
Susann is living on Tripletts Branch at the old Casy place where Brother
Thomas Day lived when you was in this contry a bout one mile from Dolph
Penleys South & East.
Martha is living one mile west of where me and Morgan lived when we moved to the flat top where we
lived when we started to the Indiana and I make her house my home. I stay some with Susan Some with
Sarah & some with John. Sara is all most a widow for James is purty near all his time out surverying for
some body. You want to know what became of your brother Wain & you sister Susan. Your brother Wain
was in this contry a little while before your Father & brother James moved from this country and started
back to the Indiana to his children and I have not heard from him since & Susan the old man Jake [Jack]
Robbins said today that she married Calvin Hartley, old Benjamin Hartlys son. You wanted to know how
long Father & Mother has been Dead. Mother has been dead 33 years and Father married again and
has bin dead 21 years. You wanted to know about my youngest sisters name was. Her name is Darcus.
Her and sister Sally is living about 1 mile from her and near where old Benjamin Woody lived when I and
you started to move to the Indiana. You wanted to know where all my Brother and Sisters was. William
the oldest is living on Buffalo near where uncle Tennison McCloud lived when you was here. Brothers
Thomas, John & James went to war and dide. Edward was shot & kiled on the Breast works near Kinston
in this state, he belong to the 4th Regt Company K & Samuel is living in Tennessee about 75 miles from
hear in what is far (fox?) River Cove. I herd from him a few days ago and he was laying very lowe not like
to live. I told you about Sally & Darcus Jane you know married George Moody she is living in Tennessee
Jonson County. Holley Thomas Robbins wife is dead. She has bin dead about 34 years. You wanted to
know what become of Bill Cottrell & wife they moved to Lower Creek near Lenoir& Bill has bin dead 4 or
5 years.
Rufus is one of our foremost preachers. James Cottrell & wife is Both dead. they died where Bill lived
when you left this contry his family is mitty scattered Some is ded & the Balance a hear and there.You
wanted to know who lives on the uncle Bill Cottrell place. Thomas Robbins & his youngest son Larkin
lives on it & I expect you an mistaken about uncle Sam Cottrell. It was uncle Sam Coutris (Curtir?) you
was thinking about the widow Lewis lives at the old place and down where Little bill lived.
John Lewis, a son in law Thomas Robbins lives now. You said it would be a Real Treat to hear form me
and family if it was not a treat to me and the children to hear from you. I know now what is the reason. It
was expected to us. We thought we would never hear from you any more. I never shall forget the kin
ness that you showed me and the children after Morgan died.
Dear brother I never shal forget you as long as I live. You don’t know how bad I want to see you. Martha
& Sarah was 2 of the proudest people you ever saw to hear from you.
James Robbins, Sarahs husband went to the post office & got the letter and red it to us. He will write to
you a long letter in a few days. You wanted to know about Nancy Nelsons son Stone. It was Rufus
Stories son whether or not he came back to this contry. He is back & is a very prominant yong man
Truthful and Honest so far as I know. Brother I will say to you that this country is hard but we are doing
as well as could be expected. You wanted to know how old I am I was borned 1818 the 15th day of
March which makes me 74 years old. I will close by saying to you to remember me & write son & tell me
who you married & what your children name are & who they married. Direct your letter to Nancy Mays,

Calvin Hartly went of f in the beginning of the war and I have not seen him since. I have nothing of importance to right to you only my family is all well. Father and Brother James and James Hamlet and family went to Illinois before the war and I have heard they was all dead. Sister Tildy is dead. Brother Morgan’s family is living where they was when you left and was all well the last account. Sister Tildy’s family is all well. I do not live where I did when you left this country. I have moved to Tennessee on the Elk river 5 miles from Duggers Forge. John I want you to come and see me if you possibly can and I want to know if you know anything of Brother Burten. And if you do give him my best respects and I want him to come and see me. John I did not know what had become of you. First there was a man by the name of Ninevolh Ford ( bet his name is Kenneth Ford) told me he was here and give me the name of the post office and told me it was great country. I would like to be there with my family if I could. I have one thousand things I would like to tell you, but I do not know as I shall ever see you if you do not come to this country.
