In the name of God Amen. I DANIEL MCCARTY of the State of North Carolina and County of Lyncoln being tho the abundant mercy and goodness of God in my ordinary state of Health and of sound and perfect understanding and memory do constitute This my Last will and Testament, and deo desire it may be received by all as such, first I most humbly bequeath my soul to God my maker beseeching his most gracious acceptance of it through the all sufficient merrits and mediatations of my most compassionate redeemer Jesus Christ who gave himself to be an atonement for my sins is able to save the uttermost all that come unto to God by him, seeing he ever liveth to make intercession for them, and who I Trust will not reject me, a returning penitent sinner when I come to him for mercy in this hope and confidence in this hope I give my soul with confidence humbly beeching the most blessed and glorious Trinity one God most holy most merciful and Glorious to prepare me for the time of my dissolution and then to take me to himself into that peace and rest and incomparable filicity which he has prepared for all them that love and fear his holy name, Amen, blessed be God. I give my body to the Earth from whence it was taken in full assurance of its resurrection from thence at the last day as for my burial I desire it may be decent without pomp or state at the discretion of my dear Wife and my Executors hereafter Named, who I doubt will manage it with all requisite prudence as to my worldly state I will and positively order that all my debts be paid. first I give to my dear and Loving Wife all my Lands Tenements Houses and appurtances with Every parcel of the moveable property and furniture thereunto belonging during her life, and at her death, in the manner as follows. Likewise I give to my well beloved son in Law DAVID TOMLINSON his heirs and assigns forever three hundred acres of Land Lying and being on LITTLE RIVER IN GEORGIA. I also leave and bequeath to my son in law JOHN KELLEY the land which he now lives on and after the death of my wife all and every part of the household furniture and meat cattle I also leave and bequeath to my grandson DANIEL KELLEY son to JOHN KELLY one Negro fellow named DUBLIN to remain in possession of his parents till he becomes of age. I also leave and bequeath to my Daughter JEMIMAH BLAIR wife to HUGH BLAIR a negro girl named SARAH at her death the girl to bestowed with her increase to her son HUGH BLAIR. I also leave to my sons JOHN MCCARY and JACOB MCCARTY & Son in laws DAVID TOMLINSON, JOHN KELLY and SAMUEL JOHNSTON and my widowed daughter ANN BENNET the whole of the Estate of CORNELIUS MCCARTY Deceased formerly liveing on Santilena [St. Helena] Island to be Equally divided by the Executors of my Will I also leave and bequeath to my sons DANIEL MCCARTY and CORNELIUS MCCARTY and Son in laws HUGH BLAIR and JOSEPH BAKER five shillings sterling Each to be raised and Levied out of my whole Estate I do also constitute and appoint AGNESS MCCARTY my wife and JOHN MCCARTY my son and JOHN KELLY my son in law as Executors for this my last will and Testament in witness where of I have herunto set my hand and seal the fourteenth Day of August in the year of our Lord one thousand seven hundred and Eighty-Two, Signed Sealed and Delivered in the presence of us DANIEL MCCARTY (seal)

McCarty Deceased wheresoever any of the goods and chattels of the said Deceased are or do remain which shall be shown unto you by Agness McCarty & John Kelly and there view and appraise all and every the said goods and Chattels being first sworn and according to Law to make a True and perfect inventory and appraisement thereof and to cause the same to be Returned under your hands or any three of four of you to the said Agness McCarty and John Kelly on or before the first Day of June next insuing given under my hand and seal at my Office In the year of our lord 1786
