To the Honorable ten Chancellors of the said State.
Humbly complaining show unto your Honors your Orator Gasper T. Ransey of the District Aforesaid that John Ransey late of the said District, leaving siezed in fee of considerable real estate lying and living in the District of Barnwell and Edgefield on the line dividing the said Districts on Hollow Creek and Savannah River, that is to say, a tract or parcel land containing about eight thousand acres adjoining lands of the"list of adjoining land owners".A tract or parcel of land containing two hundred acres adjoining "list of adjoining land owners",a tract or parcel of land containing about five hundred acres on Savannah River near Silver Bluff known as the red house tract bounded by the River and lands of"list of adjoining land owners", and a tract containing about six hundred and fifty acres adjoining lands of "list of adjoining land owners", all lying on or near the line dividing Edgefield from Barnwell District and partly in each District and having also pssessed as of his own ????? goods and chatels of the following names, "list of66 slaves".
And leaving so siezed and possessed of the said lands and slaves on or about the twenty second day of January one thousand eight hundred and forty seven, departed this life intestate leaving as his next of kin his daughter Mary K., who had intermarried with Arthur A. Simkins, his daughter Harriet T. Ransey, who is an infant under the age of 21 years, his sons William L. Ransey and your Orator, and his granddaughter Martha Thersea Bowers who has lately intermarried with Angus P. Brown each intitles to on undivided fifth part of this estate, and your orator futher showeth, that the intestate in his lifetime put the said Arthur A. Simkins and Mary K. his wife in possession of a tract or parcel of land containing about one thousand four hundred and fifty two acres lying in the District aforesaid bounded by Savannah River and lands of the intestate, known as the Lower Bluff, and of which the said Arthur a. simkins and wife are now, and were at the time of the intestates death in the exclusive enjoyment and possession .
Your Orator further showeth that it is for the interest of the intestates next of kin that the daid lands and slaves may be partitioned between them so that each may have his, her and their part or share thereof in severalty.????? and therefore that the said William L. Ransey, Arthur A. Simkins and Mary K. his fie, Harriet T. Ransey and Angus P. Brown and Martha t. his wife may answer make to all and singular the premises, and that a writ of partition may open out of, and under the seal of this honorable court directed to suitable persons as commissioners to make partitions of the said lands and slaves list???? The said defendants and your orator, and ?????? the said Arthur A. Simkins and Mary K. his wife shall elect to receive the tract or parcel of land advanced to them by the intestate in his life time as aforesaid as their full part or share of the intestates estate, that the said tract or parcel of land, as ??? value then of at the time of the intestates death exclusive of the improvement whidht the said Arthur A. Simkins and Mary K. his wirfe may have put thereon may be included and taken unto such partition, and divided in the same manner as if the same were a part of the intestates estate, and that your Honors may make such other and further orders and directions in the premesis as to your Honors shall deem meet.
May it please your Honors to grant to your Orator a writ of subpoena to be directed to the said defendants thereby commanding thereby a certain day and under a certain ???? therein to be limited personally to be and appear before your Honors in this honorable court, and then and there answer make to all and singular the premises, and to do and perform such order direction and ???? therein as to your Honors shall deem meet, and your Orator will ever pray and so forth.
