I was checking on the death date that was presented to me, I posted in the email and looking for a source.
It appears the middle probate records were being used as a death date, but the initial 1841 filing of probate would indicate that John died after 1840 census and before May 15 1841.
I did not find a definitive date of death!
I am still puzzled why it took 7 years to settle his estate, even for this time period it was extremely slow process.
