Maryland.In the Name of God Amen I John Wilder of Charles County in the province aforesaid being sick and weake of body but of sound & perfect mind and memory thanks be to almighty God and calling to mind the uncertainty of this life I do think it merits & forces intent to settle in the best manner what Estate it hath pleased God in his goodness to give me and after Committing my Soul to the mercy of its Dear redeemer Jesus Christ and my body to the Earth to be buried at the Discretion of my Executor hereafter named do make ordain & appoint this my last will & testament in manner & form following --
IMPR., I will & decree that all my Debts may be paid in Convenient time --
2ndly.I give and bequeath unto my son JOHN WILDER my Dwelling plantation to him & his heirs forever and also I give unto my said son John my Large Bible & walking cane --
3rdly.I give and bequeath unto my several children JAMES, MARY, EDWARD, SARAH, ANN and ASSENAH WILDER all the Rest & Residue of my personal Estate Quick & Dead to be equally Divided amongst them -- But further will that my son James shall have negro SAM in part of his share and my son Edward shall have negro JAMES in part of his share and my Daughter Mary shall have negro Lucy and Lucy's child Henry in part of her share and my Daughter Sarah shall have negro SARAH in part of her share and my Daughter Ann shall have negro GEORGE in part of her share and also my Daughter Assenah shall have negro BESS in part of her share --
4thly.I will & order that my negro JACK shall not be removed of my Plantation but that my son John to whom I have given my plantation shall be accountable to my Estate for his appointment --
5thly.My will & desire is that what Corn & meat shall be in my house or on my plantation at the time of my Death shall not be appraised but appledged to the support of my Children --
6thly.My will also is that the above negroes be severally Delivered to my Children respectively as they come of age marry or chuse his her or their guardian at the then value --
Lastly I make ordain & appoint my son John Wilder my sole Executor of this my last will and Testament In Testimony whereof I have hereunto set my hand and affixed my seal this 5th Day of December 1749.

On the back of the foregoing Will was endorsed the follg prob: to wit,
Charles County for 11th of February 1756 Robert Yates, John Scrogin & George Scrogin the three subscribing witnesses to the within Will and made oath on the holy Evangelists of Almighty God that they saw the Testator John Wilder sign & seal the within will and heard him publish & declare the same to be his last will & testament and that at the time of his so doing he was to be best of their apprehensions of sound & disposing mind & memory and that they severally subscribed their names as witnesses to the said will in the presence of the Testator & at his request which probate was taken in the presence of John Wilder heir at law to the Deceased who did not object to the same.

Charles County, Whereas Notly Mattox, Guardian of Charles Bruce, son John Bruce, late of Charles County, Gent, decd, applied himself to Robert Yates, a Charles County Justice, to appoint persons to view that tract of land called Chesnut Point, for his sd ward, which we have viewed as follows: 1 good dwelling house 15 feet square with outside chimney & closet, 1 new tobacco house 30X20 feet, 1 small house 10X5 feet, 139 panels of new fence, 387 panels of sorry old fence, 20 old apple trees, the annual value being worth 400 lbs of tobacco per year.

Edward Smoot added to his estate from time to time both by patent and by purchase. In 1755 he received a warrant, which was issued under the name of "Wilder's Mistake", for an unclaimed tract of land amounting to 66 1/2 acres between his plantation and that of John Wilder. In 1764 he patented "Sukey" of 22 acres, and in 1765 "Smoot's Trifle" of 3 3/4 acres.
In 1764 Edward Smoot purchased from William Mitchell, of Prince William County, Virginia, 153 acres of land lying in that county, the tract being a portion of 300 acres bought by Luke Cannon from Thomas Young, conveyed to Young by George Pemberton and conveyed to him by Charles Sneed to whom the land had descended by inheritance.

"The will of William Smoot was dated November 9, 1726, and proved in Charles County November 18, 1726, by Thomas Morris, Elizabeth Weedon, and Thomas Hawton. He bequeathed his son Thomas personalty at the age of 21 years and placed him under the guardianship of Mark Penn, naming the latter as the executor of his estate. To his son John, he devised personalty at the age of 21, and placed him under the guardianship of John Wilder.
The inventory of his personal estate was taken on March 15, 1726/27, and appraised at £30/13/7 by William Hawton and Robert Yates. William Barton and Thomas Smoot signed as the nearest of kin, and Thomas Smoot as the greatest creditor.
Prior to the inventory, however, his will was presented to the court on November 19, 1726, by Mark Penn as the executor, and Matthew Dutton and William Cage as his sureties."
