BROOKS, DAVID BROOKS, WILLIAM BROOKS, and SAMUEL HARKER, believing that there can not be a just partition in a certain parcel of land in the STRAITS, joining the land of OLIVER WHITEHURST & others containing 35 acres, and bound on the S by the water of the STRAITS, on the N by OLIVER WHITEHURST, on the E by ELIZABETH CHADWICK, & on the W by the JOHN ROBERTS LAND. The land being left by JAMES BROOKS, SR. to his daughters MARY ANN BROOKS & NANCY BROOKS, during their natural lives & then to their Heirs. Leffers describes the store and warehouse mentioned above as being occupied by HOWARD and CHASE, states that the line S20W 8 3/4p runs between the store and the warehouse, being 1 acre and 33 perches. --states that the 430 acres below is all low sand beach. June 2, 1830). Also 1/3 part of a TRACT OF LAND ON PORTSMOUTH containing 50 acres, .. beginning in the SW line of the heirs of SOLOMON DIXON deceased - in a gut or creek making up in the marsh, running with the middle of the gut or creek to JOSEPH CASEY'S heirs or REUBEN WALLACE'S deceased, with his line to the Horse Pen Creek and with the waters of that creek to the aforesaid line of the heirs of SOLOMON DIXON and from thence to the first station, and including the dwelling house or mansion house of said GEORGE R. Garrish, administrator of James C. Garrish, and Joseph Williams & Sally, his wife, respectively pray unto your worshipful, that FRANCIS O’NEAL, late of the County of Carteret departed this life, leaving a last will and testament and there in among other things loaned to his wife ELIZABETH O’NEAL all of his property and Negroes, during her natural life or widowhood. And that at her death or marriage, that same should be divided among his seven children, REBECCA, CLARISSA, LOVE, MARTIN, JOHN, BATEMAN, & SARAH O’NEAL. Your petitioners further showeth that; Rebecca O’Neal has Intermarried with JAMES C. GARRISH, CLIRISSA married FRANCIS JACKSON, LOVE married WILLIAM SCARBOROUGH, SALLY married JOSEPH WILLIAMS. Your petitioners further say that after the death of FRANCIS O’NEAL, FRANCIS JACKSON and MARTIN O’NEAL sold and conveyed their interest in the Negroes to JAMES C. The cause of George's death is not known. He was only 36 years of age and the following year his wife Polly died at the young age of 37 years. This would lead one to believe that she may have contracted a disease from her husband, but a closer examination of the ages of these early Scarboroughs at the time of their death, reveals that only two lived to be 40 years old, the others died in their 30's.

NOTE; I typed this item because it also gives us information on how they lived and perhaps how he died. We know that Littleton made his last voyage in August, also he died in August. Looking at the items purchased, it looks like he was in severe pain. Also the item "Blister Plaster" gives a hint to how he died. He may have died from an injury or from cancer. Since he made the voyage in August, it isn’t likely that the item was for bed soars.
ALSO: some family trees state that LITTLETON STYRON died in ALABAMA and that many of the people named in this estate were on the wagon train that left Carteret County in 1823. These records as well as others show that they did not join the others until later. Most of these left about 1840.

Your petitioners further show unto your worships, that the said LITTLETON STYRON, departed this life intestate on the ____ day of AD 18__ and that letters of administration upon the estate of said LITTLETON STYRON duly granted by the court to your petitioner SILVANIOUS DIXON. ELIZABETH STYRON TOOK A MORGATAGE ON HER PROPERTY FOR THE DEBT OWING JAMES AND T.B. WALLACE FOR THE AMOUNT OF $138.20 WITH ONE YEAR TO PAY. ELIZABETH STYRON and JOHN MAYO of the 2nd part and JAMES & T.B. WALLACE of the 3rd part.
(Elizabeth is indebted to James and T.B. Wallace for $138.20, 16 June 1830 when judgement was obtained before John Mayo, Esq. Of Portsmouth. Elizabeth transfers title to John Mayo for lot and house where she now resides, joining the lands of James Howard, Alpheus Whitehurst and T.B. Wallace on Portsmouth, being 10 acres, also one undivided share of 10 acres on Core Banks. Also land in Hunting Quarters that descended to her from her grandfather David Wallace, Sr decd. In the right of her father Robert Wallace decd. (This a security for her debt. John Mayo has power of attorney to sign over these properties if debt is not paid in one year).
Note: The house and 10 acres were sold to Samuel Dudley on 21 Oct 1831 Deed BK W-pg 262, It was after Elizabeth lost her home that she and other members of her family went to Alabama.
STYRON, CHRISTOPHER, 1830,
The earliest date found on the Estate papers of Christopher is June 1830. The settlement, or division of estate is dated April 1831. Records state that Christopher’s wife Mary had been appointed administrator of the account and had refused to divide same. A petition was put before the court by the heirs in June 1830 and Mary was summoned to appear. The records state that Esther and Benjamin were still minors. (This may be a clue that Christopher was married before and the older children were by the 1st wife. Since it is not likely that children would take judgement against their own mother. The two younger children were likely of the 2nd marriage, Mary being their mother).
By the time the estate was divided in April 1831 Mary had married again to William Wallace, who at the time of the settlement was guardian to the minor children. Also on at least one of the documents the widow was referred to as Mary Gaskins, which may have been her name prior to marrying Christopher. There was no inventory of the estate with the papers. The petition above states that at the time of his death he had a very large personal estate valued at "$5,000 or some other very large sum and also several valuable Negroes." The records were interesting since they told in what order the children were born.

The court also appointed son JAMES WILSON WADE administrator. Yet he does not appear in the estate papers or in the auction records, as a buyer or seller.

It appears by the inventory of his estate that Valentine Wade was a very wealthy man for the time. He had scales to weigh his gold and silver, brass tobacco box, china and silver ware. He had molds to make spoons and molds to make shot for his guns. 4 slaves, 2 geese, 3 goats, 44 head cattle, 24 horses, and 182 sheep.

**VALENTINE WADE ran a tavern on Portsmouth Island, his widow Mary bought the billiard table, so it looks like she planned to keep the tavern open herself or have someone else to run it.

Heirs are listed as; DAVID WALLACE, BENJAMIN BOURDEN (wife Nancy Ann Wallace), ROBERT WALLACE, JAMES WALLACE, POLLY NELSON, JOSEPH BOURDEN (wife Esther Wallace). In 1809 JOHN C. Eighty head of horses, "a few more have been seen, perhaps to the number of eight." 135 head of cattle, " a number more known of on Portsmouth and Hunting Quarters, but unable to express any number." 21 head of sheep and a number more.

Settlement of Account shows valuable information; NEAL made the coffin, tombstone was purchased from BLACKS SCOTT, JOHN STYRON took the tomb to Hunting Quarters and set it up.
(This tomb, along with other family members, is located directly in front of one of the doors to the clam hatchery at Atlantic. This cemetery is being abused and neglected. Clamshells are being dumped on graves. The owner of hatchery will not allow anyone on the property to visit graves. Four of us (members of the Historical Society) had to get a Sheriff’s Deputy to escort us on property to inspect the graves. Even with the escort, we were ordered off the property, but we didn’t leave until we had inspected the graves. We have tried to get help in protecting, fencing, etc. the cemetery. We have been informed that only a direct descendant has any authority in this endeavor. If a direct descendant will get a court order, members of The Friends of Portsmouth Island and the Carteret County Historical Society will assist in carrying out the order.

David Wallace’s heirs were living on Portsmouth Island in homes built on the family tract. When the property was divided, instead of deeding the property where the homes were located to the occupants. Lots were drawn and the home owners given the right to dispose of the buildings, as shown in the division below.
CARTERET COUNTY DEED BOOK S - PAGE 38 29th JUNE 1815 DAVID WALLACE'S property is divided among his heirs. JOHN C. WALLACE, heirs of ROBERT WALLACE, deceased, EASTER COOK, heir of JAMES WALLACE, deceased, DAVID WALLACE JR, NANCY BORDEN, EASTER BORDEN, MARY NELSON. The land on Portsmouth was, divided in seven parts and each heir drew a lot, with the oldest drawing first and so forth to the youngest. The division was as follows;
(1st) JOHN C. WALLACE drew front lot # 7, seven, valued at two hundred and thirty dollars, reserving to SAMUEL WHITEHURST, his house and two acres of land on which his house sits. Also back lot * 7, seven, the most extreme end lot up the banks valued at two hundred dollars.
(2nd) The heirs of ROBERT WALLACE drew front lot # 2, two, valued at three hundred dollars, along with back lot # 5, valued at one hundred dollars. also the WINDMILL valued at two hundred fifty dollars, situated on lot and an acre of land for the use of the mill, the land belonging to the heirs of ROBERT WALLACE only during the continuance of the said mill, then to revert back to the proprietors of lot # 3.
(3rd) EASTER COOK, heir of JAMES WALLACE drew front lot # 6, valued at two hundred fifty dollars, along with back lot * 6 valued at one hundred fifty dollars.
(4th) DAVID WALLACE JR. drew front lot # 5 valued at three hundred dollars subject to the buildings and other improvements being either sold or removed by the proprietors, together with back lot # 2 , valued at one hundred and twenty five dollars.

NANCY BORDEN drew front lot # 3 with all the buildings there on located valued at eight hundred dollars, with the exception of the WIND MILL and one acre of land as described in draw of the heirs of ROBERT 'WALLACE. Also back lot * 4 valued at seventy five dollars, reserving two acres of land on which the ACADEMY stands for the use of such, the said Academy free and forever.
(6th) EASTER BORDEN drew front lot * 4 valued at three hundred dollars, the owner of the building standing on the same having the right of taking it off. Also back lot # 3 valued at one hundred dollars.
(7th) MARY NELSON drew front lot # 1 with a small frame house standing thereon in which the said DAVID H. WALLACE, JR. lives valued at three hundred and fifty four dollars, with the exception of the widow of ROBERT WALLACE, deceased having a life estate in her dwelling and garden with the land which they stand and after her death, the heirs of ROBERT WALLACE have the right of selling or other wise disposing of said houses there on.
Furthermore the houses of DAVID WALLACE SR. situated on said lot # 'L are free and unconnected with the said lot # 1. The proprietor thereof has the right of selling or removing the same. The said MARY NELSON drew back lot # 1 valued at one hundred and fifty dollars.

WALLACE, JR , DAVID. 1827, June 18, 1827 JAMES WALLACE was appointed administrator of the estate. Estate papers found in Carteret Co, Craven Co and Hyde Co. States he owned land in all three counties, was a very wealthy man.

Very confusing account. Hire of Negroes, Inventory, Many notes due, suits trying to collect debts. Widow’s allowance.
(He had built a very large house in Hyde Co. which he sold when he moved to New Bern. His house in Hyde Co is still standing and is listed on the National Register of Historic Places.)
