Last Will andtestament of Aaron Cone January 14, 1832
In the name of God, Amen, I Aaron Cone of the State of Georgia and County of Bulloch, being infirmin body but in perfect memory, thanks be to God, calling into mind themortality of my body and (wet stain)-wing that it was appointed for all men todie. I make and ordain this my last Will and Testament that is to sayprincipally and first of all I give and recommend my soul into the hands of theAlmighty God that give it and my body to the ground to be buried in a decentand Christian manner and from at the discretion of my friends and Executorsnothing doubting but I shall at the last general resurrection receive it againby the favor of Almighty God; and as touching such worldly estate wherewith ithas pleased God to bless me with in this life I do give and dispose of in thefollowing manner. ___
Firstly, I do give and grantunto my son Peter Cone the following tracts of land, one surveyed for andgranted to William Denmark, ( then in Effingham County but now in Bulloch ,) onthe 25th of December 1770, then so deeded from Wm. Denmark to Stephen Denmark,from Stephen Denmark to Simeon Travice, from Simeon Travice to Matthew Carter andfrom Matthew Carter to myself, also I give unto my son Peter Cone the threetracts of land which he deeded to me, also I give him all the debts due fromhim to me; likewise one negro man named Tom, also one bed and furniture.____
Secondly I do give and grantunto my son James Cone one negroman named Jack, one rifle gun and one large pot, he has had his bed andfurniture.
Thirdly, I do give and grantunto my son Robert Cone, one negroboy named Dick, one large pot and one rifle gun, he has had his bed andfurniture.
Fourthly, I do give andgrant unto my son Barber Cone three tracts of land surveyed for myself inBulloch County joining the Call’s land and great Ogeechee, one tract of fivehundred acres granted to me on the 14th of October 1813 and two other tracts ofland, one contains four hundred forty four acres; the other or last tractcontains six hundred acres, each one of the last mentioned tracts were surveyedand granted to me on the 16th of November 1813; likewise one negro boy namedCharles and one bed and furniture, also one large pot and blacksmith tools.
Fifthly, I do give and grantunto my son Aaron Cone the following tracts and parcels of land. Viz thefirst tract granted originally to Rheuben Bynarm, ( then Effingham County but now Bullochfor two hundred acres, the grant is dated the 31st of December 1784 and deededby said Bynarmto AsaelFarmer and his deed is last, and deeded from said Farmer to me, his deed isdated the 26th of April 1799; the second tract granted to ValentineHollingsworth, ( then Effingham County but now Bulloch, ) for two hundredacres, the grant is the16th of November 1793, by said Hollingsworth deeded toElizabeth Ryall;Mrs Ryalls heirsdeeded it to me; the third tract granted originally to John Goldsmith, ( thenEffingham County but now Bulloch for three hundred acres, the grant is datedthe 10th of November 1795; on that tract my house now stands, said Goldsmithdeeded in his last will and testament, the deed is dated the 16th of march1796; the fourth tract granted originally to John Caswell, ( then EffinghamCounty but now Bulloch ) for one hundred seventy nine acres, the grant is datedthe 10th of November 1795, and is deeded by said Caswell to John Goldsmith, thefifth tract granted to myself for two hundred acres of land, the grant is datedthe 9th of November 1799; the sixth tract granted to myself for fifty acres ofland, the grant is dated 30th of October 1801; the seventh tract granted tomyself for four hundred acres of land, the grant is dated the 14th of October1813; the eighth tract also granted to myself for fifty acres of land, thegrant is dated the 16th of November 1813; likewise one negro boy named Amos,one bed and furniture, also one large pot, also one musket gun, ( unledgibile) I do give unto my grandson John Goodman one bed and furniture.
Seventhly I do give andgrant unto my grandsons Joseph Cone and William Cone jointly the followingtracts or parcels of land Viz;the first tract granted originally to Nathaniel Lundy, ( then Effingham but nowBulloch County ) for two hundred acres of land, the grant is dated the 22nd ofFebruary 1794, the second tract granted originally to William Pool for fivehundred acres of land, being only that part of the land that lies north of Carybranch, the grant is dated the 19th of March 1795, ( then Effingham County butnow Bulloch); the third tract granted to Matthew Carter for one hundred fiftyacres of land, the grant is dated the 19th of March 1795 ( then Effingham butnow Bulloch) the fourth tract of land granted to Matthew Carter for one hundredacres; the grant is dated the 10th of may 1798, ( then Effingham now BullochCounty) likewise one negro boy named Ezekiel, also each one of them one bedapiece. The land and Negro boy named Ezekiel which I have given to my grandsonsJoseph Cone and William Cone are to be kept for the use of my family untilWilliam Cone becomes twenty-one years of age, for I do not want to have mylittle grandsons to pay for their board. I wish my grandsons John Goodman,Joseph Cone and William Cone to be sent to school whence a school is withinreach, from July until March in every year and their tuition paid for out ofthe family land as long as it does last, afterwards out of their own property.
Eighthly, I do give andgrant unto my daughter Sarah Goodman one negro girl named Lindy and herBed and furniture.___
Ninthly, I do give and grantunto my daughter Ann Jones two negrogirls named Polly and Sharlet,she has had her bed and furniture.___
Tenthly, I do give and grantunto my daughter KeziahSheffield two negrogirls named Zilphaand Amy, she has had her bed and furniture.__
Eleventh, I do give andgrant unto my daughter Frances Cone two negro girls named Phebe andEliza and her bed and furniture.___
Twelfth, I do give and grantunto my daughter Susannah Cone two negro girls named Lucy and Sarah and her bedand furiture;__and Icharge and direct my sons James Cone and Barber Cone to act as guardians forSusannah Cone, John Goodman, Joseph Cone and William Cone until they come ofage, or choose their own guardians.__
My stock of cattle are toremain on the plantation for the use of my own family, except thirteen cows andcalves for Joseph Cone and William Cone jointly next spring; and to JohnGoodman ten cows and calves next spring, also ten cows and calves and five cowsand yearlings to my beloved wife ( Hannah Cone ) next spring, and also to her teensteers of this description, four three year old steers and six two year oldsteers.__
First I want to have as manyof my steers sold as will pay my debts, and the remainder of the steers from twoyears olds and upwards to be left for the use of my family. The balance of mystock of cattle to be divided as follows, First to Sarah Goodman, secondly toBarber Cone, Thirdly to Frances Cone, Fourthly to Aaron Cone, Fifthly toSusannah Cone, to each one of these five but last mentioned grand sons six cowsand calves apiece. The remainder of my she cattle and sucklings to be equally dividedbetween my following children Sarah Goodman, Ann Jones, Barber Cone, KeziahSheffield, Aaron Cone,
Robert Cone is to have abeef every year, and Barber Cone is have a beef every year after he leaves thefamily out of the stock left for my family.__
The balance of the steers are notto be made use of only as the necelatiesof the family calls for them. I leave my stock of hogs, sheep, goats, bee hivesand crop for the careful use of my family; also my horse, mule, and oxen.__
My horse fed and Sony,wife's saddle, her bed and furniture I give to my beloved wife Hannah Cone.____
Also I leave a sugar mill,two carts, hand mill, plantation tools, household and kitchen furniture, areall to be left for the use of my family,__
Also it is with my daughterSarah Goodman to have the management and control of everything about the house,except my wife's room, she is to have the privalage of that.__
Also it is my wish forBarber Cone to have the management and control of everything on the plantationas long as he lives with the family; When Barber leaves the family, themanagement and control of the plantation will fall on Aaron Cone.___
I leave my negro man Dickand Mary his wife are to work for my family until my grandson William Conearrives at the age of twenty one years. ___
After that I do intend thatthey ( mynegro man Dick and Mary his wife) shall belong to my son Aaron Cone; like wisethe household and kitchen furniture to belong to my son Aaron Cone.___
I wish my son Barber Cone topay to Mr. George Mitchell five dollars; I have paid him all, but the fivedollars for finishing the wood work for a wagon; and when it is finished forBarber Cone to iron it off, afterwards to sell it and to take his pay for thework he does to it, out of the money which he gets for it; the surplus of themoney to go for the use of my family.__
I wish my son Barber Cone tosell my mill irons and still to appropriate the money which they fetch for theuse of my family.____
My daughter Sarah Goodman isto have the command of everything about the house except she gets married.
My son Aaron Cone must afterBarber leaves the place try to make support for the family with the hands thatare left on the plantation; unless he does marry; if he does, he is to have theprivilege of the little room, and a sufficient quantity of land to tend,together with an equal part of the cow penned land; also he is to have my markand brand,___
If my beloved wife cannotstay with the family, I want her to have the sixth part of my stock of cattlewilled, for the support of my family.
I do appoint James Cone,Allen Jones, and Barber Cone my lawful Executors to have full power over myestate (ineligible) to carry my will into complete effect.
