It is admitted that it is to the interest of all the heirs & coproprietors concerned that the land herein in question, a partition of which is sought by licitation, should be sold on the terms prayed for in plaintiff's Petition, procured the court orders, the property sold - to effect a partition.
Alonzo Nugent sworn says I am one of the Plaintiffs in this suit.I have brothers and sisters living.It is admitted that the wife of E. S. Gray one of the defendants herein is dead, that she left at her death six minor children as is alleged in plaintiffs petition.All the other heirs are of age - now at this time, Mrs. S. R. Lee, Jr., is the youngest of my sisters.Mrs. Lee has been married about four years.
I think that all the moveable property that belonged to the succession of my father and mother has been sold since the death of my father and mother.All the debts that existed against my father and mother prior to their death have been paid since their death.
Some of the land in question in this parish is hill land and some is bottom land.The heris and coproprietors derive no revenue from this land nor have they for four or five years past.That land is worth about $2.50 per acre.None of the land is cleare that I know of.I think that this land had better be sold and the money divided among the heirs.I think it would be against the interest of the heirs to have the land divided in kind.

This cause coming on to be heard, W. C. Roberts, Esq., appearing for plaintiffs and A. Thorpe and W. H. Peterman, Esqs., appearing for Mathew Nugent, defendant, a default having been taken against the defendants and on the trial hereof the default having been duly proven up against E. S. Gray as Natural Tutor to his children and against the defendants; it is ordered and adjudged and decreed that the report of the experts herein filed be and the same is hereby homologated and that the plaintiffs do have judgment against the defendants decreeing that the following described land, to wit:
SE 1/4 of SE 1/4 of Sec 11 T. 8 N. R, 2 W. and NW 1/4 of SE 1/4 of Sec. 11, T. 8 N. R.2 W. andSW 1/4 of SE 1/4 of Sec 11 T. 8 N. R. 2 W., and NW 1/4 of NW 1/4 of Sec. 13, t. 8. n. R. 2 W.,and NE 1/4of NE 1/4 of Sec. 14, T. 8 N. R. 2 W.
containing two hundred acres, situated in Grant Parish, Louisiana, be sold by J. Kemp, Jr., Sheriff of Grant Parish, Louisiana subject to appraisement as in sales under execution after due advertisement on the following terms, to wit:
The purchaser or purchasers to pay one third in cash on the day of sale and for the remainder to execute their or his two promissary notes for equal amounts bearing eight per cent per annum interest from date until paid duly "paraped Ne Varietur" before a Notary Public for identification in favor of the said Sheriff for the use and benefit of all parties interested, said notes to be secured by special vendors lien and mortgage in and upon the property purchased, in order that the money realized and to be realized from said sale may be divided among the heirs and coproprietors of said land according to law.
Said land to be sold in blocks of forty acres each as per the above description.The parties hereto to bear equally the costs.This done, read and signed in open court on this the 2nd day of February A. D. 1889.

Now come plaintiffs by Attorney and defendant Mathew Nugent by his attorney and show to the court that on the 17th day of April A. D. 1889, one hundredand twenty acresof the land decreed to be sold herein was sold on said day and brought the sum of two hundred and fifty-two dollars.
That the purchaser thereat tendered to and placed into the hands of the Sheriff the said sum in cash instead of executing notes as prayed for in the petition.That they are willing to accept said amount in cash instead of the notes as aforesaid.
They show that the purchaser thereat one of the defendants herein Mathew Nugent had paid on said property the sum of thirty four and 99/100 taxes on said property before the same hereof.
Wherefore they pray that the Sheriff be ordered to pay to the parties hereto equally his portion of the amount of money realized, after paying the costs of this proceeding and reimbursing the said Mathew Nugent the amount of taxes he has paid on said land, being the sum of Thirty four and 99/100 dollars and for general relief.

Received the within writ on 22nd day of March 1889 and on same day and date I advertised the property described in the within writ and continuously advertised same for more than thirty days in a newpaper published in the town of Colfax, La. and call the Colfax Chronicle and before the day of sale I gave notice to the parties to appoint each, one appraiser to appraise said property when on 27th day of April A. D. 1889 the parties selected their appraisers, and they being sworn by me did appraise the property under oath as follows:SE 1/4 of SE 1/4 of section eleven to be worth in cash $30, and the NW 1/4 of SE 1/4 of section eleven to be worth in cash $50, and NW 1/4 of NW 1/4 of Section thirteen to be worth in cash $40, and NE 1/4 of NE 1/4 of Section fourteen to be worth in cash $40, and NE 1/4 of NE 1/4 of Section fourteen to be worth in cash $50.All the above being in T. 8 N. R. 2 W. and on 27th day of April A. D. 1889 about the hour of eleven o'clock, I proceeded to the courthouse in the town of Colfax, La., the time and place appointed for said sale and there read in an uadible voice, the writ commanding me to sell, the advertisement, the appraisement and the certificate of the recorder of morgages for the Parish of Grant and then cried the property at public auction at which time the SW 1/4 of SE 1/4 of Section eleven township eight north range two west containing forty acres more or less was adjudicated to William F. Logan for the price and sum of one hundred and two dollars, and the north west quarter of the south east quarter of section eleven and the North east quarter of the North east quarter of section fourteen township eight North range two west containing eighty acres more or less was adjudicated to Matthew Nugent for the price and sum of one hundred and fifty dollars, making a total of two hundred and fifty-two ($252) dollars received, which amount has been paid over to the Plaintiffrs and defendants of the within suit, less the sum of thirty four and 99/100 dollars paid Matthew Nugent on O.c as per receipted A/c filed herewith and less the further sum of four dollars taxes paid on the property described in the within writ for the year 1888and also less the further sum of seventy three and 33/100 dollars which I retained as costs of this suit and sale.
The south east quarter of south east quart of Section eleven and the North west quarter of North west quarter of Section thirteen Township eight north range two west containing eighty acres more or less remains unsold, for the reason of having no bid for same and I herewith return the within writ partially satisfied this 28th day of May A. D. 1889.

From this Precinct two sets of Delegates contest the right to seats in the Convention.A Meeting of the Democrats of the Parish was held on the 13th inst., the proceeding of which were regular.Upon the introduction of a resolution, intended as a test, a portion of those present left the meeting, and organized a separate one, from which second meeting Delegates was also sent to this Convention.Your committee think it was the duty of those who comprised the second meeting to have remained at the place where they first went, and to have out-voted the others if they had the numerical majority which they claim.By abandoning the meeting properly called and regularly organized, they deprived themselves of any legimate rights to send Delegates here.Besides, the vote on the resolution in the first meeting shows that a majority of the Democratic voters at the Precinct remained and participated in its proceedings.We therefore report the Precinct to be represented by ---John Eddleman

The petition of S. A. Neal and his wife, Emaline Neal, and William Stephens (sic) & his wife Mary Jane Stephens( sic), and Sarah Ann Z. Sanford, widow of S.B. Sanford, deceased, and James Harvey and his wife Laura Alice Harvey, and S. R. Lee, Jr. and his wife Martha Cornelia Lee, and Alonzo Wilkins (sic) Nugent and William F. Logan transfer for valuable consideration of the interest in the property hereinafter described owned by Charles(sic) Thomas Nugent. all of whom are residents of and domiciliated in your parish and State and Dennis Oliver Nugent a resident of and domiciliated in the parish of Avoyelles and State of Louisiana respectfully represent that one Mathew Nugent deceased departed this life in your parish & state on the 21st day of February 1879, leaving his widow & partner in community Julia Ann Nugent, who also departed this life during the month of May A.D. 1881, and the following heirs all of whom were of age at the death of their said mother Julia Ann Nugent;Mathew Nugent, Emaline Nugent, wife of S. A. Neal, Mary Jane Nugent, wife of William Stephens (sic), Sarah Jane Z. Nugent, widow of S. B. Sanford, Dennis Oliver Nugent, Henrietta Virginia Nugent deceased who was wife of E. S. Gray, Laura Alice Nugent, wife of James Harvey, Charles (sic) Thomas Nugent, Martha Cornelia Nugent, wife of S. R. Lee, Jr. and Alonzo W. Nugent, and two hundred & eighty acres of land more or less, two hundred of which is situated in your parish and state and the remainder in the parish of Winn and state of La. and two hundred & sixty head cattle more or less in your parish and state.
Petitioners further represent that neither the succession of the said Mathew Nugent deceased nor the succession of his said wife, Julia ann Nugent, deceased, owed any debts at the time of their deaths respectfully.
Petitioners further represent that before the transfer of the interest as heir, of the said Charles H. Nugent to the said William F. Logan of the land hereinafter described & since the death of the said Julia Ann Nugent, deceased, wife of the said Mathew Nugent deceased that they divided in kind about one hundred ninety head of the cattle left at the deaths of their father and mother & sold the remainder & divided the proceeds among them, & that by said action put an end to the successions of their father & mother as such, & that therefore no administration thereof is necessary.
Petitioners further represent that they are heirs & co-proprieters of said tract of land being & lying & situated in your said parish & state described as follows, to wit:
The South East 1/4 of the South East 1/4 of Section 11, Township 8
North Range 2 West; and the North West 1/4 of the South East 1/4 of Section
11, Township 8 North Range 2 West; and the South West 1/4 of the South East

containing two hundred acres, believed by the petitioners to be worth two
and 50/100 dollars per acre.
They show that they derive no revenue from said land and that it is greatly to their advantage to have the same partitioned by licitation after due advertisement.That part of said land is creek land and part is hill land, part being of much greater value per acre than the remainder & that it cannot be divided in kind among them without great inconvenience & loss & diminution in the value of same.They show that the said Henrietta V. Gray deceased, who departed this life on the 31st of July A. D. 1887, left at her death the following minor children who are interested herein, to wit:Laura Alice, Ella, Olivia, Ola, Lonnie & Carrie Gray, wherefore a Judicial partition is necessary to protect their rights & to that end that the said E. S. Grey should be recognized and confirmed as natural tutor of the said monor issue of his marriage with the said Henrietta V. Grey, deceased.
They further show that it is to the interest of all concerned that the said land be sold after appraisement as in sales under execution in tracts of forty acres each on the following terms, to wit:The Purchaser or purchasers to pay one third cash on day of sale & for the remainder to execute their or his two promissary notes for equal amount due one & two years respectively drawing interest at eight per cent per annum from date until paid, paragraphed "ne Varietur" by a Notary Public & secured by special vendors lein & privilege in & upon the property purchased.
Petitioners further show that two experts should be appointed to examine & report to the court under oath whether the said land can be conveniently divided in kind, without loss to any of the petitioners & a diminution in the value of same, or whether the same should be divided by licitation & that the proceeds may be divided among your petitioners.
Wherefore your petitioners pray that the said E. S. Gray be recognized and confirmed natural tutor of his minor children Laura Alice, Ella, Olivia, Ola, Lonnie & Carrie Grey, issue of his marriage with the said Henrietta Grey deceased on his qualifying according to law.That as natural tutor of his children the said minors, he be cited to appear & answer herein to according to law.
2nd - That two experts be appointed by the court to examine the land herein before described & report to the court under oath whether they think the said land can be divided in kind without inconvenience to any of the coproprietors or less to them & diminution of the value of said land or whether said partition should be made by licitation & the proceeds divided among your petitioners.Said report to be made wihtout unnecessary delay.
3rd - That on trial hereof petitioners have Judgment in their favor & against the said E. S. Grey a natural tutor of the minors & Mathew Nugent decreeing that the said land herein before described be sold subject to appraisement as in sales under execution by J. Kemp. Jr., Sheriff of Grant Parish Louisiana after due advertisement, according to the terms specified in the foregoing petition, to wt:The purchaser or purchasers to pay one third of the purchase price in cash on day of sale & the remainder to execute their or his two promissary notes for equal amounts bearing eight per cent per annum interest from date & paragraphed "Ne Varietur" for identification before a Notary Public and secured by vendors lien & special mortgage in and upon the property purchased and that said land be sold in tracts of forty acres each as per the description contained in this petition.
They pray for all orders necessary for general & equitable relief.

1st. W. C. Roberts sworn says:I am the attorney of Record who brought this suit.
I have a written document in my possession signed by William F. Logan authorizing me to bring this suit - that document authorizes me to bring this suit.I have a letter in my possession from Mr. Oliver Nugent in which it is stated- in which it is stated that Mrs. Saran Ann Sanford said she did hope that I would defeat Matthew for he had acted so contrary all the time.The said written document is signed by all the plaintiffrs in this suit with the exception of Oliver Nugent and Mary Z. Sanford.I have letters from O. Nugent and it is by authority of these letters that I brought the suit forth (sic).The letter received from Oliver Nugent from which I have made the statement with reference to what he said regarding the said Mrs. Sanford was that this letter was received and the date of the institution of this (sic) suit Alonzo H. Nugent and Oliver Nugent came to me in Colfax and engaged me to bring a suit for the sale of this (sic) land and noted to me that all the heirs and coproprietors of this land except Matthew Nugent wished this suit brought and the land sold in order to settle the estate.

Now comes the plaintiffs herein and respectfully shows to the court that the original deed to the land sought to be partitioned in this action among the several heirs by licitation to their father Mathew Nugent, deceased and described in the original petition herein filed by them, which description in said petiton is made a part hereof by reference thereto, is in the possession of one of the defendants herein, Mathew Nugent.
They show that said deed is not of record in the Clerks Office, and that therefore no certified copy of same can be obtained by them.They show that they cannot safely go to trial without the production of said deed on the trial hereof as evidence of their father's title.Wherefore they pray that your Honorable Court grant unto them an order directing the Clerk of your Court to issue a rule(sic) to be served without delay on the said Mathew Nugent to produce the said deed in open court or or before the trial hereof in order that the same may be used in evidence on said trial, or else to show cause why he does not comply with said order.
They pray for costs and for general relief.

The following is the obituary of Mathew Nugent, Senior, as it appeared in the Colfax Chronicle, Saturday, March 11, 1879:
"An Old Citizen Gone
Mathew Nugent, Senior, an old and well known citizen of Grant Parish, died at his residence in this parish on Friday evening, February 21st, 1879.Mr. Nugent was one of the early settlers in this section, having lived in the immediate neighborhood where he died for nearly half a century.He leaves a large family to mourn his loss, who have our sympathy and the sympathy of a lot of friends, all of whom feel that in the death of Mathew Nugent, Senior, Grant Parish has lost a valuable citizen and the community an honorable Christian gentleman.His was a hoary head crowned with glory.Rest in peace."

Notes for JAMES ANDREW HARVEY: REFEREnce:The Colfax Chronicle, June 20, 1908, DIED: HARVEY - -At his residence in Pollock, La., on Friday, June 5, 1908, at 11:30 a.m., James A, Harvey, aged 59 years, 6 months and 16 days. He was born in Biloxi, Miss., November 29, 1848, but his parents moved to Winnfield, La., during his early days, and from thence to Grant Parish, where he spent the remainder of his life.He grew to manhood not far from Iatt post office and later made Pollock his home.He was twice married, to Miss Gray, a sister of Miss Ola and Messrs, G. W. and H. P. Gray, all of Pollock, to which union six children were born, one of whom survive him, viz:Mr. L. D. Harvey, of Rochelle, La.His second wife was Miss Laura Nugent, sister of Mr. Math Nugent, who still survives him. He was twice elected Assessor of Grant parish and only lacked a few days of completing his second term at the time of his death.He was a member of Anchor Lodge No. 261 F&AM, which he joined several years ago. He was a staunch Democrat in every sense of the word, and took great pride in assisting in promoting that party's interest at all times. In his death Pollock and her people and the entire citizenship of Grant parish has lost an honorable, upright and useful citizen, whose place can never be filled. Many were his friends, few, if any, his enemies; beautiful was his character, exemplary and inspiring was his every day walk of life. The funeral procession was conducted by the order of which he was so loyal a member, which left the familoy residence about 8 o'clock Saturday morning and proceeded to Liberty Chapel M. E. church, where the funeral sermon was delievered by the Rev. Howard G. Roberts, of the Bastrop, La., M. E. church, after which he was laid to rest in Liberty Chapel cemetery with Masonic honors. --Pollock News. |
