Notes for MARY JANE SMITH:
Mary Smith's son, William, refers to her as a white woman; on the 1851 Old Settler roll this family is listed in Saline District, family# 121, as John Burgiss, William and Jane (in that order).As a white woman, Mary would have not been enumerated unless she was considered an adopted Cherokee.The order of the listing would then indicate John as the head-of-household with his children William and Jane.The applications of other descendants variously refer to Mary as "Mary" or as "Jane".I believe her to be "Mary Jane Smith".On the Old Settler Payroll the descendants of John Burgess are William Burgess, Mary Hodge, and Jack S Burgess, listed as sons and daughter.These same three children claim as sons and daughter of the Jane that is listed on the Old Settler with John and William.Mary Hodge gives her age as 44 which would put her birthdate at 1848-1852 while statements of her brothers put her closer to 1848.I am making some presumptions here that Mary Hodge nee Burgess was born 1848 which would mean that she should appear on the Old Settler roll with her father John and her brother William, that Mary was named "Mary Jane" after her mother, that the Jane on the Old Settler with John and William was in fact Mary Jane Hodge nee Burgess, and that on the Old Settler Payroll William, Mary, and Jack claimed as children to what was actually Mary's own enumeration rather than their mother, Mary Jane Burgess nee Smith.HOWEVER; it's quite possible that Mary was born c1852 and that she had a sister, Jane, that was enumerated wtith John and William AND that when William, Mary, and Jack were listed as sons and daughter of Jane that they should have actually been listed as brothers and sister of Jane.

Notes for WILLIAM BURGESS IV:
The age difference between William and his siblings leads me to believe that he is a half-brother, this is supported by the fact that the [step?] mother Mary Smith had also married John Burgess' brother, George, and that while William and his siblings, Mary and Jack, were claiming as sons and daughter of John Burgess, only Jack and Mary claimed as step-sons of Geroge.
