Notes for WILLIS SWINDELL:
Pvt. Willis Swindell served in theRevolutionary War at a very young age. He was said to have been a spy for theContinental Army. He was accepted for the DAR as a supplement, p. 205: "Swindle(Swindell) Willis b 3-5-1763 d 5-9-1851 m x Pvt NC." According to Syble Sayre,he was appointed patroller in Captain Thomas Daniels' district in 1800 or1808.205 He was a member of the Mattamuskeet Primitive Church in 1808. He wouldhave been married at this time to Ashley's mother (Willis' second wife). Also onthis church's roster was a couple with the last name of Ashley. Quite possiblythese two were Ashley's grandparents (this is still speculation).206 He movedfrom Randolph Co., North Carolina to Henry Co., Indiana. He appears in bothcounty's census records for the same year.

I Annmarah Swindell of the county of Hydeand State of North Carolina being of sound mind and memory but considering theuncertainty of my earthly existence, do make and declare this my last will andtestament in manner and form following, that is to say:
First - That my executor (herein afternamed) shall provide for my body a decent burial, suitable to the wishes of myrelations and friends and pay all funeral expenses, together with my just debts,howsoever and to whomsoever owing, our of the moneys that may first come intohis hands as a part or parcel of my estate.
Item: I give and devise to my eldest-sonCason E. Swindell twenty five acres of land adjoining Samuel Spencers land, tohave and to hold to him his heirs in fee simple forever.
Item: I give and devise to my son ThomasM. Swindell twenty five acres of land on the south side of the road running tothe Lake and in the East corner of the farm adjoining Seth Gibbs Joseph Youngheirs and Daniel Neal it being that part where on he now lives to have and tohold to him his heirs in fee simple forever.
Item: I give and devise to my daughterEmeline W. Swindell the remainder of my land together with the buildings where Inow live to be twenty five acres more or less. My will further is that mydaughter Emeline W. Swindell at my death shall have all of my personal property,the said land she is have and to hold to her heirs in fee simpleforever.
Item I give my three children an equalprivilege to the timber for the purpose of building and fencing until the landwhere on the said timber grows is cleared, also an equal privilege in the ditchand road running to the lake.
And lastly I so hereby constitute andappoint by trusty friend, Cason E. Swindell, my lawful executor to all intentsand purposes, to execute this my last will and testament according to the trueintent and mearning of the same and every parr and clause there of herebyrevoking and declaring utterly void all other wills and testaments by meheretofore made.
